EAGLE PLANNING AND ZONING COMMISSION
September 25, 2000

The Planning and Zoning Commission met in special session on September 25, 2000
Vice-Chairman Deckers presiding.

CALL TO ORDER:

ROLL CALL: The following members were present BLOOM, DECKERS,
NORDSTROM, CADWELL. Absent FRANDEN. A quorum is present.

APPROVAL OF MINUTES:
A. Minutes of September 05,2000.
Bloom moves to approve the minutes of September 5, 2000 as amended. Seconded
by Nordstrom. ALL A YE...MOTION CARRIES.
4. OLD BUSINESS:
A. RZ-IO-OO- Rezone from A-R to R-I-DA for West Valle v Baptist Church
- West Valley Baptist Church: West Valley Baptist Church, represented
by Mark Butler with Land Consultants Inc., is requesting a rezone from A-R
(Agriculture-Residential) to R-I-DA (Residential-one unit per acre with
development agreement) The site is located on the north side of State
Highway 44 approximately 800-feet east of Park Lane at 3702 West State
Street.
B. CU-IO-OO -West Valley Baptist Church and a SO-foot hie:h tower - West
Valley Baptist Church: West Valley Baptist Church, represented by Mark
Butler with Land Consultants Inc., is requesting a conditional use for a
church and a 50-foot high tower for a cross. The site is located on the north
side of State Highway 44 approximately 800-feet east of Park Lane at 3702
West State Street.
Mark Butler withdraws both applications.

PUBLIC HEARINGS:
A. RZ-ll-00 - Rezone from R-4 to CBD - Robert Runyan: Robert Runyan
is requesting a rezone from R-4 (Residential) to CBD (Central Business
District). The 0.18-acre site is located on the east side of Park Road
approximately 200-feet north of State Street at 74 Park Road.
Deckers introduces the item.
Mark Butler 222 EState St. Eagle, representing the applicant presents the application.
John McFadden, City Attorney reviews the staff report for Bill Vaughan who was
unable to attend the meeting due to an emergency. Mr. McFadden addresses the
parking availability and the reason for the staff recommendation for denial being as
the parking spaces are not wide enough. Discussion between McFadden and Deckers.
Deckers opens the public hearing.
Steve Clark 162 Park Road, Eagle, Idaho is in favor of the rezone as it will enhance
the neighborhood.
Ken Ward 303 Park Road, Eagle, Idaho does not want to see a business in his
residential neighborhood.
Bob Runyon 3638 Holl Drive, Eagle, Idaho the property owner, reads a letter from
D.W. Taylor a neighboring property owner who is in favor of the rezone.
He also addresses the parking issue. The history of the building is that it was used as a
commercial business previously.
Mr. Butler addresses the Commission and responds to their questions.
Bill Vaughan arrives at 7:18 pm.
Deckers calls a brief break.
Vaughan addresses the Commission.
Discussion between Vaughan and Commission regarding driveway width, vehicular
patterns and landscape buffering.
Discussion amongst the Commission.
Deckers closes the public hearing
Nordstrom moves to deny RZ-ll-OO - Rezone from R-4 to CBD - Robert
Runyan Seconded by Bloom. Nordstrom amends his motion to say that we
welcome this use but it needs to be more in compliance and conformity because
of the precedent it will set in the whole area. We encourage this use in this area
but more needs to be done to accomplish this task. Seconded by Bloom. ALL
A YE... MOTION CARRIES.
B. RZ-12-00 - Rezone from A (Aericultural) to MU-DA (Mixed Use - with
Development Ae:reement) - Coulter Properties LLC: Coulter Properties
LLC, represented by Tom Bauwens with the Dakota Company Inc., is requesting
a rezone from A (Agricultural) to MU-DA (Mixed Use with a Development
Agreement). The 24.84-acre site is located on the west side of Edgewood Lane
approximately 2,000-feet north of East State Street.
Deckers introduces the item.
Larry Durkin 380 E Park Center Blvd SuitelOO Boise, Idaho representing the Dakota
Company presents the application.
Discussion between Commission and Mr. Durkin.
Vaughan reviews the staff report.

Victor Louwen, 262 N. Edgewood Lane, Eagle, Idaho Mr. Louwen is concerned about
the tremendous amount of density in a very small area.
Dick Sievers, 869 E Spartan Eagle, Idaho thinks the site should be strictly residential.

Discussion amongst the Commission.
Discussion between Deckers and Vaughan.
Deckers moves to approve RZ-12-00 - Rezone from A (Agricultural) to MU-DA
(Mixed Use - with Development Agreement) - Coulter Properties LLC with the
Staff recommendations to the Development Agreement. With the following
exceptions. 1) In item 2.5 on page 6 of 8 strike words City of Eagle 2) Add a
condition that the properties to the west and north shall be buffered by single
family residences with the exception that a convalescent home shall not require
such buffering. Seconded by Nordstrom. ALL A YE...MOTION CARRIES.

C. CU-12-00 - Trollev Square Shoppine: Center - Coulter Properties LLC:
Coulter Properties LLC, represented by Tom Bauwens with the Dakota
Company Inc., is requesting conditional use approval for Trolley Square
Shopping Center. The 26.9-acre, 23-lot commercial shopping center is
located on the north side of State Street approximately 1O0-feet east of
Palmetto Avenue.
D. lli-2-00 - Trollev Square Subdivision - Coulter Properties LLC:
Coulter Properties LLC, represented by Tom Bauwens with the Dakota
Company Inc., is requesting preliminary plat approval for Trolley Square
Subdivision, a 26.9-acre, 23-lot commercial subdivision. The site is located
on the north side of State Street approximately lOG-feet east of Palmetto
Avenue.
Both items will be combined for the public hearing

Richard Stievers, 869 E. Spartan Eagle, Idaho does not want to see drive-ins.
Mark Butler, 1640 Washam Road, Eagle, Idaho, Mr. Butler comments that this site
will be a major boost for the downtown and is in favor of the project.
Pat Dobey with Dobey Engineers presents the Traffic Report.
Larry Dirkins rebuttal addresses the term "Flex Space" and discusses the potential for
drive-thru restaurants.
Steve Sweet with Quadrant Consulting 405 S. 8th Street Boise, Idaho addresses the
drainage plan
Discussion between Mr. Dirkins and the Commission.
Deckers closes the public hearing for both items.
Deckers Moves to continue CU-12-00 - Trolley Square Shopping Center -and
PP-12-00 Trolley Square Subdivision - Coulter Properties LLC, to October 2,
2000. Seconded by Bloom. ALL A YE...MOTION CARRIES.
E. !TUD- 7-00/CU-14-00 - Reta~l Deve!opment of North America Shoppine:
Center: Retail Development of North America, represented by Billy Ray
Strite with BRS Architects, is requesting preliminary development plan and
conditional use approval for a seven-pad site office/retail shopping center.
The 6.24-acre site is located at 3001 E. State Street (located on the southeast
comer of State Highway 44 and State Highway 55 extended).
Deckers introduces the item.
Ron Bath, 1729 Whitney Lane, Eagle Idaho, representing Retail Development of
North America presents the application.
Vaughan presents the staff report.
Discussion between Vaughan and Commission regarding ACHD and traffic issues
Discussion between Bath and Commission.
Vaughan addresses the Commission regarding future development in this area.

Deckers closes the public hearing
Deckers moves to continue PPUD-7-00/CU-14-00 - Retail Development of North
America Shopping Center until a traffic report for this development is
proposed. Include in the traffic report for the purpose of this traffic analysis
the drive thru for pad I shall be removed. The deeded access shall be right in-
right out only and the east driveway shall also be right in-right out only.
Seconded by Bloom. ALL AYE... MOTION CARRIES.

backing of the Planning & Zoning Commission members at the City
Council meeting on September 26, 2000. Seconded by Deckers.
