EAGLE PLANNING AND ZONING COMMISSION
Minutes
June 19, 2000
The Planning and Zoning Commission met in regular session on June 19,2000.
Chairman Franden presiding.

CALL TO ORDER:

ROLL CALL: The following members were present FRANDEN, BLOOM,
DECKERS, TRENT. Absent: NORDSTROM A quorum is present.

CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with
one motion. There will be no separate discussion on these items unless the
Chairman, a Commissioner, member of City Staff, or a citizen requests an
item to be removed from the Consent Agenda for discussion. Items removed
from the Consent Agenda will be placed on the Regular Agenda in a
sequence determined by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations
from the City of Eagle shall be adopted as part of the Planning & Zoning
Commission's Consent Agenda approval motion unless specifically stated
otherwise.

B. Findin~s and Conclusions for CU-3-00 - Dennis M. Baker & Associates:
Project Description: Dennis M. Baker & Associates, represented by Dan
Torfin, is requesting conditional use approval for two 41.5-foot high
building entry features which are proposed for the screening ofthe roof-top
mechanical units. The site is located on the west side of South Rivershore
Lane within Channel Center Subdivision at 599 South Rivershore Lane.
C. Findin~s and Conclusions for CU-5-00 - Banbury Meadows. LLC:
Project Description: Banbury Meadows, LLC, represented by Cornel
Larson, is requesting conditional use approval for the addition of twenty
four (24) 42-foot high wooden poles and safety netting along the north and
east sides ofthe driving range at the Banbury Meadows Golf Course. The
site is located on the west side of Eagle Road approximately Yz-mile north of
Chinden Boulevard at 3023 S. Eagle Road.
Item A is removed from the Consent Agenda and continued to the next meeting, as
Commissioner Trent did not receive them in her packet.
Franden removes item C from the Consent Agenda.
Bloom approves item 3B on the Consent Agenda. Seconded by Deckers. ALL
AYE...MOTION CARRIES.

C. Findin~s and Conclusions for CU-5-00 - Banbury Meadows. LLC: Project
Description: Banbury Meadows, LLC, represented by Cornel Larson, is requesting
conditional use approval for the addition of twenty four (24) 42-foot high wooden poles
and safety netting along the north and east sides of the driving range at the Banbury
Meadows Golf Course. The site is located on the west side of Eagle Road
approximately Y2-mile north of Chinden Boulevard at 3023 S. Eagle Road.
Franden inquires as to what the approval of the findings will signify. Vaughan informs
the Commission that by approving the Findings for CU-05-00 it will confirm the
Commissions previous action (of denial) on this item.
Deckers moves to approve Findings and Conclusions for CU-5-00. Seconded by
Bloom. ALL A YE...MOTION CARRIES.
4. OLD BUSINESS: None
5. NEW BUSINESS:
A. Review of Destination 2020 - Reeional Transportation Plan for Ada County.
Charles Trainer a representative with COMPASS reviews the Destination 2020 Plan.
Nordstrom arrives at the meeting at 7:08 p.m.
Trainer discusses rural arterials. COMPASS is requesting input ITom area cities as to
how proposed draft of Destination 2020 relates to the various Comprehensive Plans.
Discussion between Mr. Trainer and the Commission.
The Commission concurs to recommend to Council that the status of status of State
State Highway 44 between Linder Road and Highway 16 should be changed to a
principal arterial. They would also recommend that Council change the status of
Highway 16 The classification of State Highway 44 between Linder Road and Highway
16 should be changed to a principal arterial.
B. V AC-2-00 - Vacation to the final plat of Banbury Meadows Subdivision No.2-
Banbury Meadows LLC. Banbury Meadows LLC, represented by Roy Johnson, is
requesting City approval of a vacation to the final plat of Banbury Meadows
Subdivision No.2 to remove the drainage and utility easements along the side lot lines
of Lots I and 2, Block 21. The vacated drainage and utility easements are proposed to
be replaced with new 6-foot wide easements along the newly relocated lot lines. The
site is located on the north side ofW. Oakhampton Drive approximately 1/3-mile west
side of Eagle Road.
Franden introduces the item.
Roy Johnson 9225 Chinden Blvd. Garden City, Idaho representing Banbury Meadows
LLc. Johnson reviews the application.
Vaughan reviews the staff report.
Discussion amongst the Board.
Deckers moves to approve V AC-2-00 Vacation to the final plat of Banbury
Meadows Subdivision No.2 with staff recommendations. Adding one

recommendation: it shall be verified that the relocation of parcel #1 to the east
does not encroach into the wetland. Seconded by Bloom. ALL AYE...MOTION
CARRIES.
6. PUBLIC HEARINGS:
A. A-3-00/RZ-2-00/CU-4-00/PPUD-3-00/PP-3-00 - Countryside Estates Planned
Unit Development - Capital Development: Capital Development and Tom Ricks,
represented by Becky Bowcutt and Richard Cook with Briggs Engineering, are
requesting an annexation and rezone from RT (Rural Transition) and A-R (Agricultural-
Residential) to R-I-P and R-2-P (Residential one unit per acre maximum and two units
per acre maximum - PUD), conditional use, planned unit development preliminary
development plan, and preliminary plat approvals for Countryside Estates Planned
Community. The development consists ofa 62.73-acre, 112-lot (96-buildable)
residential subdivision. The site is located near the northwest corner of Ballantyne
Lane and State Street. (This item will not be heard - a new public hearing will be
scheduled.)
This item will be heard at the July 10, 2000 Commission meeting.
B. A-4-00 & RZ-3-00 - Annexation and Rezone From RT to R-E - FAM
Developers Inc: FAM Developers Inc., represented by Roylance and Associates P.A.,
is requesting annexation and a rezone from RT (Residential- one unit per five acres)
to R-E (Residential- one unit per two acres). The 15-acre site is located at the
northeast corner of Ballantyne Lane and Floating Feather Road.
C. PP-6-00 - Oakley Estates Subdivision - FAM Developers Inc: FAM Developers
Inc., represented by Roylance and Associates P.A., is requesting preliminary plat
approval for Oakley Estates Subdivision, a 15-acre, 8-lot (7-buildable) residential
subdivision located at the northeast corner of Ballantyne Lane and Floating Feather
Road.
Vaughan informs the Board that items 6 B & 6C will need to be continued to a date
determined by the Commission, as the applicant failed to post the site as required by
Eagle City Code. Discussion.
Deckers moves to continue A-4-00 & RZ-3-00 - Annexation and Rezone From RT
to R-E and PP-6-00 - Oakley Estates Subdivision to the August 14, 2000 meeting.
Seconded by Bloom. ALL AYE...MOTION CARRIES.
D. PP-4-00 - Aquila Subdivision - Eaele VilIaee LLC: Eagle Village, LLC,
represented by Jack Coonce with Oppenheimer Development Corporation, is requesting
preliminary plat approval for Aquila Subdivision. The 5.61-acre, 7-lot commercial
subdivision is located on the northwest corner of State Street and Palmetto Avenue.
Franden introduces the item.

Corporation. Mr. Coonce reviews the application.
Vaughan reviews the staff report. Discussion between Vaughan and Commission.

Nordstrom moves to approve PP-4-00 Aquila Subdivision with staff
recommendations. Seconded by Bloom. ALL AYE...MOTION CARRIES.
7. REPORTS:
A. Commission: Bloom would like input on The Colony I & II regarding the
substandard landscaping and what actions are being taken regarding it. Discussion
regarding temporary signage violations. Deckers discusses Council action regarding
Pacific Heights. Deckers expresses concern that Council member Merrill testified in
favor of Pacific Heights, and yet also acted (voted) on the item when it was before
Council. McFadden provides legal comment regarding Ms. Merrill giving testimony.
Deckers questions action regarding Tabasco Subdivision. Vaughan notes that is
extremely difficult to regulate properties such as these that are outside of our city limits.
Franden notes that he will not be in attendance at the July 10, 2000 meeting.
Nordstrom will also not be in attendance. Bloom states there is a good chance that she
will not be able to attend. The Commission chooses to reschedule the July 10, 2000
meeting to a special meeting on July 24, 2000 due to a lack of quorum on the 10th date.
