Minutes - 2000 - Planning & Zoning - 05/15/2000 - Regular ORIGINAL EAGLE PLANNING AND ZONING COMMISSION May 15, 2000 7:00 PM The Planning and Zoning Commission met in regular session on May 15, 2000. Chairman Franden presiding. 1. 2. CALL TO ORDER: ROLL CALL: The following members were present FRANDEN, DECKERS, NORDSTROM, TRENT. Absent: BLOOM A quorum is present. APPROVAL OF MINUTES: 3. A. Minutes of May 1,2000 Trent moves to approve the minutes of minutes of May Seconded by Deckers. ALL AYE...MOTION CARRIES 4. OLD BUSINESS: A. Discussion of Transportation issues. 1, 2000 as amended. Franden introduces the item. Clair Bowman, Executive Director of COMPASS, introduces Erv Olen and Ms. Pattie Reino who are also in attendance at the Commissions request. Mr. Bowman explains the role of COMP ASS and how it functions. COMPASS performs 3 tasks that are mandated by federal guidelines 1. Develop a long-range plan (Destination 20/20). 2. Prepare a budget document. 3. Formulate a staffing plan, also known as a Work Program. Erv Olen, with ITD, reviews the 1-84 Corridor Study including the history of the study and current activities regarding it. Discussion. Question and Answer period between the Commission Mr. Olen, Mr. Bowman, and Ms. Reino regarding speed limits, response time for City initiated requests, and budgeting. Franden calls a five-minute recess. 5. PUBLIC HEARINGS: A. CU-3-00 - Two - Two Story Office Buildin~ Hei2ht Exceptions - Dennis M. Baker & Associates: Dennis M. Baker & Associates, represented by Dan Torfin, is requesting conditional use approval for two 41.5-foot high building entry features which are proposed for the screening of the roof-top mechanical units. The site is located on the west side of South Rivershore Lane within Channel Center Subdivision at 599 South Rivershore Lane. Franden introduces the item. Jeff Cramer, 2413 S. Swallow Tail Lane Boise, Idaho representing Dennis M. Baker & Associates presents the application. Vaughan reviews the staff report. Franden opens the public hearing. Mr. Cramer responds to a question regarding Eagle Fire Department's letter regarding the application. The Eagle Fire Department has no objections to the project. Discussion amongst the Commission. Nordstrom moves to approve CU-3-OO Two Two Story Office Building Height Exceptions with site specific and standard conditions of approval. It shall be noted that this application is being approved because of aesthetic value not to squeak out more height exceptions within the City. Seconded by Trent. Discussion. Nordstrom states that the overhead presented tonight shall be known as Exhibit A. The architectural design, regarding the height exception, shall be generally tied to Exhibit A. Seconded by Trent. ALL AYE...MOTION CARRIES. B. CU-5-00 Hei~ht Exception Request For 42-Foot Hi~h Poles and Safety Nettin~ at Banbury Meadows Golf Course Drivin~ Ranee - Banbury Meadows. LLC: Banbury Meadows, LLC, represented by Cornel Larson, is requesting conditional use approval for the addition of 42-foot high wooden poles and safety netting along the north and east sides of the driving range at the Banbury Meadows Golf Course. The site is located on the west side of Eagle Road approximately Yz-mile north of Chin den Boulevard at 3023 S. Eagle Road. Franden introduces the item. Dick Phillips, 210 Murray Street Boise, Idaho representing Banbury Meadows LLc. Mr. Phillips notes that the only remaining aspects of this application is regarding the driving ranges, all other proposed netting and poles has been withdrawn from the application. Mr. Phillips reviews the application. Discussion between Mr. Phillips and the Commission. Vaughan reviews the staff report. Franden opens the public hearing. George Dillard, 135 W. Jakona Ln. Eagle, Idaho. Draws the Commissions attention to an agreement between Mr. Dillard and Banbury Meadows Golf Course. States the Developer has not been in contact with him since last year. He states that he has not been approached by the Developer regarding the netting. Believes the PUD needs to be changed or a mutual agreement between himself, his wife and Banbury Meadows Golf Course. Mr. Dillard feels the poles are unsightly, and possibly hazardous due to the creosote poles being installed. His drinking water and well could be in danger. He would like the application denied. Discussion between Mr. Dillard and the Commission. Morgan Masner, 3168 S. Whitepost Eagle, Idaho notes that he was on the City Council when this application was originally brought forward for approval. Mr. Masner concedes that the Council did not take into account that there is a prevailing easterly wind where the driving range is, or the fact that the tees would be moved forward and back. Mr. Masner feels that the original PUD should be complied with in so far that the number of poles, the distance between each pole and type of golf ball usage is all Page 2 of 4 K:\P&Z\MINUTES\Temporary Minutes Work Area\PZ-O5-15-00min.doc specified in the original PUD. Keith Watson, 260 W. Oakhampton Drive Eagle, Idaho. Mr. Watson agrees that the poles could be installed according to the Dillard agreement that has been signed, and according to the PUD. Feels the poles that are currently installed are quite unsightly. Also feels that low flight golfballs should be used. Dave Edrnark 3058 Whitepost Eagle, Idaho shows the Commission pictures ofthe existing poles. Mr. Edmark draws the Commissions attention to the length of the fencing in the original agreement as opposed to the existing. Originally it was to run only 250 feet and now it is proposed at around 900 feet. States that other golf courses do not have this type of fencing. Suggests berming as an alternative. States the poles are very ugly. Urges the Commission to deny this application and make the original agreement be abided by. Jerry Breaux and Clint Travis manage the golf course. Mr. Breaux discusses some of the challenges with managing the tees of the driving range. He also states that limited flight golf balls may solve Mr. Dillard's problem, but the balls will still fly left and right off of the range. He does not feel that changing the type of balls used is the solution for the problem. Mr. Travis states that the netting at Mr. Dillard's has an anchor that has been removed and that is sagging, but that it will be and can be fixed. Also states that the proposed fencing is around 750 feet not 900 feet. States that extensive efforts have been made with Mr. Dillard to solve the problem and protect his property. Discussion between Mr. Breaux, Mr. Travis and Commission. Carlene Canfield 1100 Clearview Ct. Eagle, Idaho. Expresses her concern with the unsightliness of the poles, possible health hazards, the disruption of the wildlife due to the installation of the netting. Feels that these issues need to be addressed and the application should be denied. David Levin 2771 N. Limerick Dr. Eagle, Idaho. Agrees with all of the comments tonight. Inquires why if the installation of trees along the 9th fairway is a sufficient barrier, why couldn't they do the same for the other side? Also suggests leaving the driving range tees on the mats and do not move them closer, this would alleviate the danger to Mr. Dillard's property. The poles are ugly and unsightly. Brian Yurgun 539 W. Oakhampton Drive Eagle, Idaho. Inquires as to the need to use the wood poles, instead ofthe steel poles. Peter Simom 3034 S. Whitepost Way Eagle, Idaho feels the Developer owes it to the community to address the concerns raised tonight. Stanley and Diane Moss 3100 Whitepost Way Eagle, Idaho. Mr. Franden reads their letter into the record. The letter is in opposition to the application. Walt Gann. Mr. Franden reads Mr. Gann's letter into the record. The letter is in favor of the netting on the north side of the range. Thomas and Christy Suciu. Franden reads the letter into the record. The letter is in opposition. Mr. Phillips rebuts public testimony presenting tonight. Explains their intentions regarding the pole installation. Mr. Phillips states that ifMr. Dillard will agree to a 20 feet netting on metal poles and sign off on the agreement, then it will be done. States that the poles can be topped off to 30 feet above the berms. Discussion between Commission and Mr. Phillips. States that the engineering for the metal poles was not possible to comply with, that's why they used the wood poles. Discussion of alternatives such as limited flight golf balls and tee positioning. Franden closes the public hearing. Discussion amongst the Commission. Deckers moves to deny CU-5-00 Height Exception Request For 42-Foot High Poles and Safety Netting at Banbury Meadows Golf Course Driving Range. The denial is based on the belief that the original agreement on record has not been proven to be insufficient and therefore the Commission does not find a reason to grant the conditional use for height exception. This issue was heard before the Planning and Zoning Commission regular session of April 3, 2000, presented as PPUD-2-00/CU-2-00 - Skyland Co. (dba Winco Foods). While we made no recommendations to you as to the architectural design of the proposed Winco buildings, we are greatly concerned about the entryway impact statement of this proposed development. As per the Comprehensive Plan, Section 5.5, Item F, how will this development be designed and developed in a manner that complements Eagle's rural residential identity? Being that this is a very sensitive, high profile development, we suggest that you investigate architectural design restrictions to be part of the conditions of approval. It may be prudent to forward this aspect of the development proposal to the Design Review Board for their comments prior to you enacting a final decision on the Preliminary Development Plan and Conditional Use Permit. Equally important to the architectural design is the landscaping plan's impact on the entryway statement of any such development similarly located. Please pay close attention to the landscape plan being proposed by the applicant. You may wish to expand upon the size in particular of the landscaped area being proposed at the entryway point. Finally, we feel that the traffic and floodplain issues are adequately covered in the recommendations that we forwarded to you in the form of the Site Specific Conditions of Approval.
