The Planning and Zoning Commission met in regular session on April 17, 2000.
Chairman Franden presiding.

TRENT. Absent DECKERS, NORDSTROM. A quorum is present.

CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with
one motion. There will be no separate discussion on these items unless the
Chairman, a Commissioner, member of City Staff, or a citizen requests an
item to be removed from the Consent Agenda for discussion. Items removed
from the Consent Agenda will be placed on the Regular Agenda in a
sequence determined by the Rules of Order.

from the City of Eagle shall be adopted as part of the Planning & Zoning

A. Findin~s and Conclusions for A-I-OO & RZ-I-OO - Crei~hton-Westbend
LC: Project Description: Creighton-Westbend LC, represented by Steve
Benad, is requesting approval of an annexation and rezone from RT
(Residential-one unit per five acres) to R-1 (Residential-one unit per acre).
The 55.2-acre site is located on the west side of Locust Grove Road
approximately Y4-mile north of Chin den Boulevard at 7165 N. Locust Grove
Road.
B. Findin~s and Conclusions for PP-2-00 - Creil!hton-Westbend LC:
Project Description: Creighton-Westbend LC, represented by Steve Benad,
is requesting preliminary plat approval for Wedgewood Subdivision, a 55.2-
acre, 41-lot residential subdivision located on the west side of Locust Grove
Road approximately Y4-mile north of Chin den Boulevard at 7165 N. Locust
Grove Road.
Bloom moves to approve the Consent Agenda. Seconded by Franden. TWO AYE:
TRENT ABSTAINS.. .MOTION CARRIES
4. OLD BUSINESS:
A. Discussion of Transportation issues.
Franden introduces the item.
Vaughan provides an update regarding the attendance of ACHD representatives at an
upcoming meeting. ITD representatives have declined the Commissions request to

attend a meeting to discuss ITD related issues. Franden acknowledges the letter
received from ITD in which they are not inclined to reduce the speed limit on Highway
44 near Park Rd. Discussion regarding drainage, or the lack thereof, at the intersection
of Eagle Road and the Bypass.
5. PUBLIC HEARINGS: None
6. NEW BUSINESS:
A. 0O-O3-S - Ar~us Place Subdivision - Lee Y oun~: Lee Young, represented by Julie
Parker with J.J. Howard, is requesting preliminary plat approval for Argus Place
Subdivision, a 2-lot, 20.75-acre residential subdivision located on the north side of
Beacon Light Road, approximately 1,200-feet east of N. Meridian Road. This
subdivision is located in the Eagle Area of Impact.
Franden introduces the item.
Lee Young 2850 W. Beacon Light Road Eagle, Idaho. Mr. Young explains his
intentions regarding this application, and asks for the Commission to approve his
proposal.
Vaughan reviews the staff report. General discussion.
Mr. Young states that the letter submitted to the Commission tonight will also be sent
the Eagle City Council. Feels the berm and landscaping is excessive for this site.
Discussion.
Bloom moves to approve 0O-03-S Argus Place Subdivision with site specific and
site specific conditions of approval, with the exception that site specific condition
#6 shall be waived. Seconded by Trent. ALL A YE...MOTION CARRIES.
B. 00-O4-ZC - Rezone From RT To Rl - Hal & La Raine Garrett: Hal and Laraine
Garrett, represented by Jean Cariaga with Roylance & Associates, are requesting a
rezone from RT (Rural Transition) to RI (Estate Residential). The 9.07-acre site is
located 660-feet south of Beacon Light Road, approximately Y2-mile west of Eagle
Road. This site is located in the Eagle Area of Impact.
C. 00-O9-PDRIOO-05-PR - Ptarmiean Subdivision - Hal and Laraine Garrett: Hal
and Laraine Garrett, represented by Jean Cariaga with Roylance & Associates, are
requesting preliminary plat approval for Ptarmigan Subdivision, a 3-lot, 9.07-acre
residential subdivision with a private road. The proposed subdivision is a resubdivision
of Lot 2, Block 1 of Anacortes Subdivision and is located 660-feet south of Beacon
Light Road, approximately Y2-mile west of Eagle Road. This subdivision is located in
the Eagle Area of Impact.
Franden introduces the item.

Ms. Cariaga reviews the application.
Vaughan reviews the staff report for both items 6B & 6C, requesting that 2 separate
motions be made.
Ms. Cariaga expresses concern regarding the private road review fee that is being

required under the site specific conditions of approval especially considering that Ada
County will be reviewing similar engineering criteria. Vaughan explains that Eagle
City Code requires the fee as well as the City Engineer's review. Ms. Cariaga also
comments that the cost of moving the barn will be substantial and then adding the
private road fee seems exorbitant and therefore hopes that some type of compromise
could be made to alleviate some of the financial impact on her client.
Trent moves to approve 00-04-ZC Rezone from RT to Rl with the site specific and
standard conditions of approval. Seconded by Bloom. Discussion. ALL
A YE...MOTION CARRIES.
Trent moves to approve 00-09-PDR/ 00-O5-PR Ptarmigan Subdivision with site specific
conditions #1-5 waiving the portion of the requirements that would cause the barn to be
moved and delete site specific condition #6.
Motion fails due to lack of second.
Trent discusses her motion.
Cariaga.
Bloom moves to approve 00-09-PDR/ 00-05-PR Ptarmigan Subdivision with the
site specific and standard conditions of approval. Seconded by Franden. ALL
A YE...MOTION CARRIES.
Discussion between the Commission, Staff and Ms.
Franden calls a 5 minute recess.
D. 00-04-S/99-14-PR - Tabasco Subdivision - Lynn Proctor & Rob Greiner: Lynn
Proctor and Rob Greiner, represented by Anne Marie Jones with Skinner Land Survey
Co. Inc., are requesting preliminary plat approval for Tabasco Subdivision, a 2-lot,
12. 12-acre residential subdivision with a private driveway. The proposed subdivision is
located approximately 800- feet east of Park Lane and approximately Y4-mile south of
Beacon Light Road. This subdivision is located in the Eagle Area of Impact.
Franden introduces the item.
Vaughan reviews the application and staff report. Discussion regarding the letter
received today by Brian and Barb Crowell regarding the proposed lighting of this
subdivision.
Bloom moves to approve 00-04-S/99-14-PR Tabasco Subdivision with the standard
and site specific conditions of approval. Adding a site specific condition that there
be a maximum of 6 commercial style lights/light poles in the subdivision.
Seconded by Trent. Discussion. Bloom clarifies her motion regarding the street
light criteria to specify a maximum of 6 lights residential type pole lights, no more
than 20 feet high with single head high pressure sodium bulbs. ALL

A. Staff: Vaughan informs the Commission that Mark Butler has resigned
to pursue other interests and the City Council has appointed him (Mr. Vaughan)
as the interim Zoning Administrator.

RE: Residential & Rural Lighting
We are writing to you in response to a situation where 21 commercial style lights are
being installed in a rural area northwest of Eagle. We feel that there are inadequate
guidelines for this type of lighting in a rural area. Ordinance 8-13-13 appears to address
retail or commercial use next to residential property, but what about residential use?
Can't there be a limit to lighting here, especially in rural areas? Would it be possible for
the you to look at this issue? Attached is information regarding Tabasco Subdivision.
The 21 lights are located primarily on one 7 acre lot. Nearby subdivisions do not have
ANY to this type of lighting. Buckhorn Estates, a subdivision of 40 homes, has no street
lights. Nor does Widgeion Lakes or Covington Place, all less than '/4 mile away.
In passing, someone mentioned that Halley has adopted a lighting ordinance similar to
what we are talking about. Pm sure you have seen it.
We respectfully request that the governing bodies address lighting issues in a rural area.

Our Homeowner Association representative has been in contact with you regarding the
Tabasco Subdivision, but we are compelled to enter our own comments for public record.
Please understand that we are not against the development; however, we have two
specific issues:
1. Conuncrcial Liehting
At this time, it appears that they are planning to install about 21 commercial
style lights, similar to what you find in a retail parking lot. (See attached
plat.) Some of the footings are operational, including one with a dual head
light. Human, let's do the math. With dual lights (assuming 3 lights or more
per pole are not installed), that can bring the total to 42 lights for the 2 lot
subdivision!
We strongly object to this kind of lighting in a residential, no less a rural,
setting. Nearby subdivisions do not have ANY of this type of lighting.
Buckhorn Estates, a subdivision of 40 homes, has no street lights. Nor does
Widgeon Lakcs or Covington Place, all less that '/4 mile away.
While the developer and other parties cite Ma County 8-13-13 "Lighting
Standards" as a guideline, clearly the intent of these guidelines are directed
towards commercial or retail 1..1, ..,:;es abutting residential parcels. What we
have here is a rural acreage, and the guidelines to not address residential
applications. With this type of commercial style lighting, it will diminish the
rural atmosphere.

SOLUTION: A more app. vr. 4.te type of lighting such as ground level lights
or yard pole lights morc standard to a residential setting. AND/OR
Verbiage written in the guidelines to address residential use of lights,
particularly in a rural setting.
2. Commercial Oneration?
In addition to the lighting, we question whether Lyn Proctor
intends to use the property in a business; albeit his electrical business or an
equestrian business. He has erected a large building with an ample power
source, and continues to construct multiple buildings. While he may state that
anything he does is for his private use, what is to keep him from operating any
public or business application once the final inspections and permits arc
released from the property? There is a high level of activity at this site.
We hereby respectfully request that the subdivision and permits prom be suspended
until the lighting issues are clearly identified and addressed satisfactorily by all parties,
neighbors, community and governing bodies.
