Minutes - 2000 - Planning & Zoning - 04/03/2000 - Regular EAGLE PLANNING AND ZONING COMMISSION April 3, 2000 7:00 PM The Planning and Zoning Commission met in regular session on April 3, 2000. Chairman Franden presiding. 1. CALL TO ORDER: 2. ROLL CALL: The following members were present FRANDEN, BLOOM, NORDSTROM. Absent: TRENT, DECKERS. A quorum is present. 3. CONSENT AGENDA: . Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. . Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of March 6, 2000. B. Minutes of March 20,2000. C. Findin~s and Conclusions for CPA-I-00 - City ofEa~le: Project Description: The City of Eagle, represented by Mark L. Butler, is proposing City initiated Comprehensive Plan Amendment to: I.) Modify a portion of the Comprehensive Plan Land Use Designation Map, generally as shown on the map reduction included with this report, changing an area currently designated as "Residential Two and Public/Semi-Public" to Mixed Use and to provide specific written criteria regarding certain Mixed Use areas. The site is generally located north of State Highway 44 at Ballantyne Lane; and 2.) Provide a master plan, with accompanying written criteria, for the Highway Districts having jurisdiction to consider regarding the re- construction of the intersections of State Highway 44 and Ballantyne Lane and State Highway 44 and State Street. D. Findin~s and Conclusions for FPUD-I-00 & FP-I-00 - Aries Development. LLC: Project Description: Aries Development, LLC, represented by Mike Hormaechea, is requesting final development plan and final plat approval for Brookwood Subdivision Phase 2, a 28-lot (27- buildable) residential subdivision. This 5.47-acre (approx.) phase of Brookwood PUD is located on the north side of Floating Feather Road approximately 1,680-feet east of Eagle Road. The site is within the Eagle City Limits. Seconded by Bloom. ALL AYE.. .MOTION CARRIES. 4. OLD BUSINESS: A. Discussion of Transportation issues. Franden lists some of the transportation concerns that the Commission has previously discussed and reiterates their concern regarding the water collecting at Eagle Road and Highway 44, and speeding near Park Lane. Discussion. Franden would like something in writing regarding the status or actions taken on the above mentioned items. 5. PUBLIC HEARINGS: A. A-I-OO/RZ-I-OO - Annexation and Rezone From RT to R-l - Crei~hton- Westbend LC: Creighton-Westbend LC, represented by Steve Benad, is requesting approval of an annexation and rezone from RT (Residential-one unit per five acres) to R-l (Residential-one unit per acre). The 55.2-acre site is located on the west side of Locust Grove Road approximately y,¡-mile north of Chinden Boulevard at 7165 N. Locust Grove Road. B. PP-2-00 - Wed!!ewood Subdivision - Crei!!hton-Westbend LC: Creighton- Westbend LC, represented by Steve Benad, is requesting preliminary plat approval for Wedgewood Subdivision, a 55.2-acre, 41-lot residential subdivision located on the west side of Locust Grove Road approximately y,¡-mile north of Chinden Boulevard at 7165 N. Locust Grove Road. Franden introduces the items 5A & 5B. Franden notes that separate motions will be made for each item. Steve Benad, representing Creighton Westbend LC gives a review of the application. Tape is turned on at this point in the meeting 7:10 p.m. Vaughan reviews the staff report. Deckers arrives at the meeting 7:20 p.m. Discussion between Vaughan and Commission. Franden opens the public hearing. Dale Knittel, from Meridian and representing the Zinger Lateral Water Uses Association. Questions whether or not the subdivision plans to utilize the shares of water allotted to this land. Requests the natural drainage of the property be left in tack. Discusses the need for the drainage to remain. The Zinger Lateral Board would like to be involved in the final planning for the water use and drainage of water for the Wedgewood Subdivision. See letter attached to minutes. Don Watts with AB Engineering is the engineer for this application. He addresses concerns expressed by Mr. Knittel and the Commission. Comments on how drainage from the Zinger Lateral has been allowed for in the design of this application. Joan Walters 1210 Joplin Lane Meridian, ill. Notes that the applicant should consult with the drainage district to make sure their drain water can be handled. Also states that there may be an environmental issue regarding the wetlands on this property. Mark Canfield co-owner of feels that the issues the Zinger Lateral can all be worked out. Discussion between Mr. Canfield and Commission. Discussion between Commission and Vaughan. Franden closes the public hearing. Nordstrom moves to approve A-I-001RZ-I-OO Annexation and Rezone from RT to R-l as presented. Seconded by Bloom. Discussion. ALL AYE...MOTION CARRIES. General Discussion. Deckers moves to approve PP-2-00 Wedgewood Subdivision with standard and site specific conditions of approval. Modifying standard condition #7 to read: All homes being constructed with individual septic systems shall have the septic systems placed on the street side of the home or shall have their sewer drainage system designed with a stub at the house front to allow for future connection to the public sewer system. Adding the condition that the preliminary plat shall be revised so that the portion of lot 2 block 6 below the bluff shall be split off as a separate lot and shall become lot 9 block 6. A note shall be placed on the plat that indicates that lot 9 is not a buildable lot at this time. Also adding that both entrances shall have a landscape island. Seconded by Nordstrom. ALL A YE...MOTION CARRIES Franden calls a 5 minute recess. C. PPUD-I-OO(*correction PPUD-2-00J/CU-2-00 - Winco Foods. Inc. Shopoio2 Center - Skyland Co. (dba Winco Foods): Skyland Co., represented by Billy Ray Strite with BRS Architects, is requesting preliminary development plan and conditional use approval for a five- pad site retail shopping center including Winco Foods, Inc. The 14.3-acre site is located at 310 1 E. State Street (located on the southwest corner of State Highway 44 and Horseshoe Bend Road extended). Franden introduces the item. Billy Ray Strite 1087 River St. Boise, Idaho representing WlNCO. Mr. Strite has no problem with the staff report. Discusses discussions with adjoining property owners. Discussion between Mr. Strite and the Commission. Dave Roylance with Roylance and Associates 391 W. State Street Eagle, Idaho. Mr. Roylance is the civil engineer for this project. Mr. Roylance shows the Commission a FEMA map that shows the property in the 500-year floodplain map. He is aware that another early draft ofthe proposed FEMA map does show a significant portion of this property being in the floodway. Mr. Roylance has been trying to obtain more data regarding this draft map but has been unable to obtain it from FEMA. Vaughan reviews the staff report in detail. General discussion. Franden opens the public hearing. Douglas Foote, 10381 Mimine Road Boise, Idaho. Points out his property location on the map. Conveys results of his conversations with ACHD and ITD regarding stoplights. Discusses excessive speeds, difficulty turning, and accidents that have occurred at the location of Highway 44 and Horseshoe Bend Road. Comments on the floodplain location ofthis property. Would like street lighting installed. Feels there will be high noise and traffic flow. Does not want the store to be located on this site. It is too high of a traffic area states the road should be 6 lanes with a deceleration lane. Also discusses ground drainage and that ifthe area is paved it will cause problems. Gary Enselman works for Ada County Highway District. Comments on the signalization and states that it is ITD jurisdiction for the intersection of Horseshoe Bend Road and Highway 44. Discussion between Commission and Mr. Enselman. John Ewing 3931 Chiver Creek Meridian, Idaho. He is part of a partnership that owns 24 acres east ofthis site, and is representing Eagle Nursery's 7 acres, and also owns 24 acres west of Eagle Nursery. He is in full support ofthis project. Franden closes the public hearing. Bloom feels ITD should comment on this application prior to action on it. Discussion amongst the Commission. Franden calls for a 5 minute recess. Billy Ray Strite responds to questions from the Commission. Notes that a traffic study was done on this site by Earth Tech. Discusses the traffic study. He suggests that there will be a deceleration lane. Discussion. John Ewing offers to have Earth Tech come and discuss their traffic study. Deckers discusses the entry way aspect of the site as related to the Comprehensive Plan. Also expresses his concern that the project could possible be in the floodway. McFadden provides guidance regarding the existing FEMA maps and the proposed FEMA maps and advises the Commission as to direction they may take. Nordstrom moves to approve PPUD-I-00/CU-2-00 Winco Foods, Inc. Shopping Center with site specific and standard conditions of approval. Adding the following site specific condition that the drawing submitted tonight (to be known as Exhibit A) by the Developers representative showing a more detailed landscape plan shall be entered into the record and when the final development plan is submitted we have good picture detail of the landscaping as it will be in its final form. The entrance on the north west corner of the property be designed in a pork chop design allowing only right turns in and right turns out of that entrance. This condition may be revised only if there is consideration by ITD regarding the stop light at that intersection. A deceleration/acceleration shall be included to allow traffic to flow in and out of the entrance on the north side of the property. We encourage the developer to bring back a landscape statement in the corner of Horseshoe Bend Road and Highway 44 creating more visual enhancement for the sake of it being one of the entry corners into the city. Seconded by Deckers. Discussion. Nordstrom amends his motion to state that the entryway between pad 1 and pad 2 may be re-opened at such time that it is warranted, approved by ITD/ACHD and installed. Northwesterly entrance shall not be changed to a full-access driveway (from the pork chop design - right in/right out) until a traffic signal is installed at which time approved. The version of the FEMA maps, which are in effect at the time the City Council approves the final development plan, shall be the maps that are applicable to this application. Dale Knittel, representing the Zinger Lateral Water Users Association. I have been the Secretary--Treasurer of this association since 1996. I have two areas of concern to express at this hearing. 1. The Zinger Lateral Water Users Association Executive Board would like to know if the Wedgewood Subdivision is planning to use the 45.2 miners inches of irrigation water allotted to this parcel? We would encourage this development to utilize the available irrigation water ITom the Zinger Lateral Ditch. Irrigation water has been provided this property for many years and this property is an automatic member of the Zinger Lateral Water Users Association by virtue of the shares of water assigned to this parcel by the Settlers Irrigation District. We would like to provide future input concerning how the access of their irrigation water could best serve this subdivision 2. The Zinger Lateral Executive Board requests that the natural drainage of this property be left intact. Historically this property has the capability to drain excess water fÌ"om the Zinger Lateral Ditch system. This is very important to our association when excess runoff water ITom a sudden storm adds unplanned water to our system. Power outages are another problem when pumps above this area of the ditch shut down during unexpected outages. The excess water can overflow banks and water diversion boxes and pose a potential problem of flooding. The ability to divert water through this property is very important to us. Previously developed subdivisions on our ditch did not have the foresite to keep natural drains intact. Excess water ITom unplanned events are a real concern and we feel that this property could help this association when the need arises. The Zinger Lateral Board requests that we be involved in the final planning for the water use and drainage of water for the Wedgewood Subdivision.
