EAGLE PLANNING AND ZONING COMMISSION
February 28, 2000

The Planning and Zoning Commission met in regular session on February 28, 2000.
Chairman Franden presiding.

CALL TO ORDER:

ROLL CALL: The following members were present FRANDEN, BLOOM,
DECKERS, NORDSTROM, TRENT A quorum is present.

CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with
one motion. There will be no separate discussion on these items unless the
Chairman, a Commissioner, member of City Staff, or a citizen requests an
item to be removed from the Consent Agenda for discussion. Items removed
from the Consent Agenda will be placed on the Regular Agenda in a
sequence determined by the Rules of Order.
. Any item on the Consent Agenda which contains written recommendations
from the City of Eagle shall be adopted as part of the Planning & Zoning
Commission's Consent Agenda approval motion unless specifically stated
otherwise.
A. Minutes of February 14, 2000.
Bloom moves to approve the minutes of February 14, 2000. Seconded by
Nordstrom. ALL A YE...MOTION CARRIES.
B. Findine:s and Conclusions for CU-8-99 - Dennis M. Baker & Associates: Project
Description: Dennis M. Baker & Associates, represented by Dan Torfin, is requesting
conditional use approval for a 48-foot high tower which acts as an architectural feature
for the Community Center within Two Rivers Subdivision No.1 (formally Quarter
Circle Ranch). The site is located on the west side of Eagle Road approximately %-
mile south of State Highway 44 at 1501 S. Eagle Road.

Project Description: Craig and Kristen Van Engelen are requesting preliminary plat
approval for the Colony n subdivision "Revised", a 50.27-acre, 49 lot (47-buildable)
residential subdivision located on the south side of Floating Feather Road
approximately Y2-mile west of Ballantyne Road.
Deckers would like to discuss item 3B.
B. Findine:s and Conclusions for CU-8-99 - Dennis M. Baker & Associates: Project
Description: Dennis M. Baker & Associates, represented by Dan Torfin, is requesting

Franden introduces the item.
Deckers concern is that the findings should reflect that the applicant will use the tower
for architectural purposes only. Specific language he suggests is as follows: The
applicant testified that the tower is for architectural purposes only, it is not the intention
of the applicant to use the tower for storage space, office space, or other human
habitation uses other than periodic maintenance.
Discussion.
Deckers moves to approve the Findings and Conclusions for CU-8-99 as amended
tonight. Seconded by Bloom. ALL A YE...MOTION CARRIES.

5. PUBLIC HEARINGS:
A. PPUD-¡-OO/PP-¡-OO/CU-¡-OO - Pacific Hei2hts Planned Unit Development -
Eae:le Heie:hts Development. Inc.: Eagle Heights Development, Inc., represented by
Ted Martinez and Joe Harris, is requesting preliminary development plan, preliminary
plat, and conditional use approval for Pacific Heights Subdivision, a 5.6-acre, 47-lot
(42-buildable) residential planned unit development subdivision located on the south
side of E. State Street approximately l,4-mile west of Edgewood Lane.
Franden introduces the item.
Vaughan notes that the item will need to be continued as additional information was
need from the applicant to complete the application review process.
Trent moves to continue this public hearing until the meeting of March 6th.
Seconded by Bloom. ALL A YE...MOTION CARRIES.
6.
NEW BUSINESS:
A. Discussion of the Local Land Use Plannine: Act:
General discussion.
Nordstrom expresses his concern regarding the responsibilities of the transportation
task force and how to get their concerns recognized. The Commission expresses
concern regarding excessive speeds being used on Highway 44, and inquires if the Ada
County Sheriffs Office could address the Commission regarding enhanced enforcement
in the area near the high school. Commissioner Nordstrom volunteers to contact the
Mayor regarding this issue and report back to the Commission.
The Commission would like to direct staff to draft a letter to address the drainage issue
at the comer of Eagle Road and Highway 44 (the bypass), or at least direct staff to
speak with the Mayor regarding the issue. Vaughan notes that the members of the
Commission, well as all members of the public, have the opportunity to fill out a
complaint form and then staff will address the issue as it applies to Eagle City Code.
Discussion.
McFadden addresses a few issues regarding the annexation of enclave parcels of land.
He also reviews recent court cases pertaining to planning.
General discussion.

Regarding application for Pacific Heights Planned Unit Development (pPUD-1-OO/PP-1-OO/CU-l-OO)
It appears from reviewing the legal notice to property owners dated 2-11-2000 that this development is
intending on providing sewer service and storm drainage for this development by tying into infrastructure
that is located in Merrill Subdivision # 2 by crossing private property. At this point in time no arrangements
have been made with the property owners (Rocky Mountain Fitness & Recreation Center LLC) to access or
cross this private property to access these connections. We foresee some potential problems from this
proposed development on the impact of our existing infrastructure as proposed.
The City of Eagle through our PUD process imposed certain criteria on the Rocky Mountain Business Pa1k
to provide amenities for the benefit of public use i.e. Cross access to adjacent properties, 10' wide bike
pathways, fully landscaped public berms and walkways through out the property connecting public streets
to public access areas etc. to ensure that our development would benefit the general public and well being
of the residents and visitors to the City of Eagle and help the flow from development to development. Upon
reviewing the proposed Pacific Heights Subdivision we see of no proposed public amenity to help visitors
or residents in general access through this development to adjacent developments, from State Street to Iron
Eagle Dr. We hope the City of Eagle will hold all PUDs to the same standards for public good.
We also noticed that they have not provided a road connection (even iffor emergency use) to E. Iron Eagle
Dr. that the City of Eagle and ACHD forced us to provide to this property.
Not withstanding the above-mentioned items, we feel that the proposed usage of this property has a positive
impact on the immediate surrounding developments and would enhance the City of Eagle.
