A. FPUD-S-99 & FP-lS-99 - Final Development Plan and Final Plat for Two
Rivers Subdivision (formerlv Ouarter Circle Ranch) - Dennis M. Baker &
Associates: Dennis M. Baker & Associates, represented by Dan Torfin, is requesting
final development plan and final plat approval for Two Rivers Subdivision (formerly
Quarter Circle Ranch), a 97-lot (77-buildable) residential subdivision. This 47.92-acre
phase of Quarter Circle Ranch PUD is located on the west side of Eagle Road
approximately 1600-feet south of State Highway 44.

M. Baker & Associates: Project Summary: Dennis M. Baker & Associates,
represented by Dan rodin, is requesting final development plan and final plat approval
for Two Rivers Subdivision (formerly Quarter Circle Ranch), a 97-lot (77-buildable)
residential subdivision. This 47.92-acre phase of Quarter Circle Ranch PUD is located

6. PUBLIC HEARINGS:
A. CU-8-99 - Additional Hei~ht Request for a 48-foot Hi~h Architectural Tower -
Dennis M. Baker & Associates: Dennis M. Baker & Associates, represented by Dan
Torfin, is requesting conditional use approval for a 48-foot high tower which acts as an
architectural feature for the Community Center within Two Rivers Subdivision No. I
(formally Quarter Circle Ranch). The site is located on the west side of Eagle Road
approximately %-mile south of State Highway 44 at 1501 S. Eagle Road.

Deckers moves to approve CU-8-99 additional height request for a 48-foot high
architectural tower with the standard and site specific conditions of approval.
Seconded by Nordstrom. Discussion. ALL AYE...MOTION CARRIES.
B. A-I-OO & ZOA-I-00 - City Initiated Annexation with rezonine - City of Ea!!le:
City of Eagle, represented by Mark L. Butler, is proposing City initiated annexation of
land with rezoning to Eagle City Zoning designations (a full size map is located at
Eagle City Hall). Also, in accordance with the Eagle 2000 Comprehensive Plan, the
City of Eagle proposes: to further define industrial uses within the M-I "Light
Industrial District" and M-2 "Heavy Industrial District"; to change the "Industrial Park
District" designation to a "Business Park" designation; to make zoning designation
changes to the official zoning map (a full size map is located at Eagle City Hall); to
modify the Schedule of District Use Regulations to change the M-IA zoning
designation to BP zoning designation; and to modify the Schedule of Building Height
and Lot Area Regulations to change the M-IA zoning designation to BP zoning
designation.
Chairman Franden introduces the item.
Butler reviews the application in great detail and explains that this meeting is

specifically to hear comments on the zoning designations of the land that is proposed to
be annexed.
Franden calls a five minute break.
Franden opens the public hearing.
Murray Feldman, 101 S. Capital Blvd. Boise, Idaho, is representing WinCo. Mr.
Feldman is here to discuss the southwest comer of Old Hwy 55 and State Street and its
rezoning. WinCo would like the C-2 zoning to remain, and discusses their reasoning
for the zoning to go unchanged.
Richard Meires, 2500 Rocket Bar Eagle, Idaho. Comments on the inadequacy of the
newspaper noticing. The property he is concerned with is off of Beacon Light and near
the Rocket Bar Subdivision area. He is opposed to the zoning change, most people own
5 acre lots and like that minimum size, he would suggest an AR zoning.
Steve Maglecic. Is concerned with the area of Clear Creek Drive and the flood plain.
Currently most are 5 acre lots, and would like the size to stay the same or very similar.
Norm Waugh, Rocket Bar Lane Eagle, Idaho. Does not want his property to be annex,
would like the lot size to remain 5 acre lots. He does not use, and will not use city
facilities, he fears higher taxes.
John Jantez, 142 E. Clear View Eagle, Idaho. He does not feel the zoning shown on the
map will work, and would like the lot size to remain at 5 acres.
Billy Ray Strite, 1087 River Street Boise, Idaho. Mr. Strite comments on the property
on the Southeast comer of Hwy 44 and Old Moon Valley Road. He has no problem
with the MU zoning with a development agreement.
Ann Kreminshi 2639 Rocket Bar Road Eagle, Idaho. Would like the zoning to be AR in
the Rocket Bar area.
Ron Taylor 3585 W. State Eagle, Idaho. His house would be directly impacted by the
Camille Beckman project. Would like a buffer area around the perimeter where the
proposed development and his property meet so that the Beckman project does not
negatively affect his property.
Franden closes the public hearing.
General discussion.
Commission decides to continue deliberation on this item to the February 14,2000
meeting.

The proposed Annexation includes properties within th Winward/River
CH0 , Clearvue, and Sandy Springs subdivisions covering abou acres

These and other properties lie directly south of the Eagle Island State Park
on the south side of the Boise River, in the far southwest part of the City
Impact area. The subdivisions are zoned RE and the other lands in this area
AR. There are about 75 landowners total in the area.
Objections to the Application referenced above include, but are not limited
to the following concerns expressed by the landowners:
1.) What services from the City of Eagle will be added to our area with the
annexation that are not already adequately provided for from other
municipalities? (Meridian library, post office, fire protection and
emergency response units, weed and pest control, etc.)
2.) If these services are assumed by the City of Eagle, the greater distance
and traffic congestion coming from Eagle will greatly slow the response
time to this area, especially for emergency situations.
3.) How can Eagle provide expansion services to our area (sewer, etc.) as
growth occurs without extreme expense to the City, and how will
construction across the Boise River be overcome without environmental
damage and extreme costs for other alternatives.
4.) Concerning employment, social and economic ties from our area, we are
more dependent upon and more closely associated with Meridian and
Boise, not the City of Eagle.
5.) All subdivisions currently have strong covenants, legal documents that
self regulate area growth, quality of life, environmental concerns, and
resident protection, so further restriction, taxes, and governing from the
City of Eagle is not needed.
6.) Inclusion of our area into the City of Eagle should be by voluntary
application by the landowner such as occurred at Sugarberry and
Creighton Heights to the east of our area, not by action initiated by the
City. The Idaho legislature is now considering a bill to make annexation
through a vote by landowners, which most States now have.
In summary, there are no apparent advantages or benefits to the residents of
this area for annexation at this time, and it would be better left to the
landowner's choice. The City of Eagle would incur an extreme expense to
provide expansion services, or by assuming the responsibilities of existing
services provided now by other municipalities. In addition, Eagle is not
geographically located to efficiently service this area.
