The Planning and Zoning Commission met in regular session on
Tuesday, January 22, 1985, at the Eagle Elementary School Library.
Roll call showed the following to be present:
SELTZER, WILSON, STOVALL, SMITHSON.
HILL, RUSK,
Moved by SELTZER and seconded by RUSK to approve the minutes
of the December 4, 1985 meeting as printed. Motion resulted as
follows: AYE: RUSK, SELTZER, SMITHSON, WILSON, STOVALL. Motion
carried.
Moved by RUSK and seconded by SELTZER to approve the Findings
of Facts and Conclusions of Law as printed for the Joe Franks
Variance. Roll call on the motion resulted as follows: AYE:
RUSK, WILSON, SELTZER, STOVALL, SMITHSON. Motion carried.
Moved by SMITHSON and seconded by STOVALL to elect JIM HILL
as Chairman of the Planning and Zoning Commission. Moved by RUSK
and seconded by WILSON to elect BOB SHADE as Vice Chairman of the
Commission. Moved by RUSK and seconded by WILSON to close the
nominations for Chairman and Vice Chairman. Motion to the close
the nominations resulted as follows: AYE: RUSK, SELTZER, WILSON,
STOVALL, SMITHSON. Motion carried. Motion on the ballot of
canidates resulted as follows: AYE: RUSK, SELTZER, WILSON,
STOVALL, SMITHSON. Motion carried.
Chairman HILL presented Ada County Transmittal #83-78-CU -
Jim Marshal for the Commissions consideration. Moved by RUSK
and seconded by SELTZER to recommend to Ada County approval of
Transmittal #83-78-CU- Marshal with the same stipulations as
recommended by the City Council. Motion resulted as follows:
AYE: RUSK, SELTZER, WILSON, STOVALL, SMITHSON. Motion carried.
Chairman HILL announced that this was the time and the place
as advertised for a Public Hearing on a preliminary plat for the
Eagle Rim Estates Subdivision. Chairman HILL presented the applica-
tion to the public and unfavorable testimony was received from
the following:
Patrick Monture - 200 N. Edgewood Lane, Eagle, Idaho
Wallance C. Smith - 409 Winged Foot Place, Eagle, Idaho
Earl Cohick - 1165 Pebble Beach, Eagle, Idaho
James Bostwick - 1293 Cerramar Ct., Eagle, Idaho
Carol West - 275 Harvey St., Eagle, Idaho
Les Madsen - 662 Eagle Hills Way, Eagle, Idaho
Lloyd Gilkey - 8524 Wichita Dr., Boise, Idaho
Norma Gilkey - 426 N. Edgewood Lane, Eagle, Idaho
Favorable testimony was received from the engineer for T.W. Investments,
J. J. Howard - 2636 N. 32nd Boise, Idaho

Chairman HILL closed the public testimony portion of the Public
Hearing at 8:05 p.m. and opened it up for discussion before the
Commission. Moved by SELTZER and seconded by SMITHSON to delay
the decision on the Eagle Rim Estates until the next meeting or
until the answers to the following questions are available: A
copy of the Protective Covenants can be presented showing the
minimum square footage of the homes; an explanation from the
Eagle Water Company concerning availablity of water and water
pressure to the subdivision; how access to Edgewood would be
handled for the lots on Edgewood; and an explanation of the
difference in the acreage of the total subdivision as indicated
in a letter from Harold Cox, an engineer representing the City.
Roll call on the motion resulted as follows: AYE: SELTZER,
RUSK, WILSON, STOVALL, SMITHSON. Motion carried.
Jim Gipson, artichect for Robert DeShazo, present the
final application for the DeShazo Conditional Use permit/
Planned Unit Development. Moved by RUSK and seconded by SMITHSON to
recommend to the City Council approval of the final plat of
the DeShazo Conditional Use Permit/Planned Unit Development
including the request for additional density which would allow as per
for six townhouses instead of five. Roll call on the motion Section Q,
resulted as follows: AYE: RUSK, SELTZER, WILSON, SMITHSON. Ordinance
NAY: STOVALL Motion carried. #40
Chairman HILL adjourned the meeting at 9:05 p.m.
