PHONE 939-0431 December 4, 1984 The Planning and Zoning Commission met in regular session on Tuesday, December 4, 1984 at 7:30 p.m., at the Eagle Elementary School Library. Roll call showed the following present: SELTZER, VOGT, SHADE, RUSK, STOVALL, SMITHSON. Vice Chairman SHADE presiding. Moved by VOGT and seconded by SMITHSON to approve the minutes of the Special meeting of October 30, 1984 as printed. Motion resulted as follows: AYE: SELTZER, VOGT, RUSK, STOVALL, SMITHSON. Motion carried. Moved by VOGT and seconded by SELTZER to approve the Findings of Facts and Conclusions of Law as printed for the Comprehensive Plan Change. Motion resulted as follows: AYE: SELTZER, VOGT, RUSK, STOVALL, SMITHSON. Motion carried. Moved by RUSK and seconded by SMITHSON to approve the minutes of the Special meeting of November 20,1984 as printed. Motion resulted as follows: AYE: SELTZER, VOGT, RUSK, STOVALL, SMITHSON. Motion carried. Moved by VOGT and seconded by RUSK to approve the Findings of Fact and Conclusions of Law for the DeShazo PUD/CUP. Motion resulted as follows: AYE: SELTZER, VOGT, RUSK, STOVALL. Motion carried. Vice Chairman SHADE announced that this was the time and the place as advertised for a public hearing for a Variance submitted by Joseph Franks to build a garage in the rear yard setback on property located at 205 South 2nd St. Eagle, Idaho. Mr. Franks was the only person to speak at the public hearing and there was no unfavorable testimony. Moved by SELTZER and seconded by SMITHSON to recommend to the City Council approval of the variance. Roll call on the motion resulted as follows: AYE: SELTZER, VOGT, RUSK, STOVALL, SMITHSON. Motion carried. Ada County Transmittal 84-70-CU - Beagley for temporary living quarters for a relative, was considered. Moved by SELTZER and seconded by SMITHSON to forward the transmittal to Ada County with the recommendation that the request did not violate the Eagle Comprehensive Plan. Motion resulted as follows: AYE: SELTZER, RUSK, STOVALL, SMITHSON. NO: VOGT. Motion carried. Ada County Transmittal 84-7l-CU - MARTHA CORD request for a beer tavern one mile north of Highway 20 on the west side of Eagle Rd. , was considered. Moved by SELTZER and seconded by SMITHSON to recommend to Ada County that the application does not violate the Eagle Comprehensive Plan. Motion resulted. as Page 66 EAGLE PLANNING & ZONING P.O.
