BOX 477 - EAGLE, IDAHO 83616 - PHONE 939-6813 July 3, 1984 The Commission met in regular session on Tuesday, July 3,1984, at 7:30 p.m. at the Eagle Elementary School Library. Roll call showed the following members present: SMITHSON, VOGT, RUSK. HILL, SHADE, Moved by SHADE and seconded by SMITHSON to approve the April minutes as printed. Motion resulted as follows: AYE: SHADE, VOGT, RUSK, SMITHSON. Motion carried. Moved by SHADE and seconded by SMITHSON to approve the Findings of Fact and Conclusions of Law on Ordinance #91, amendment to the Subdivision Ordinance #88, as printed. Motion resulted as follows; AYE: SHADE, SMITHSON, VOGT, RUSK. Jim Gipson, architect for Dr. Joel Courtial, asked for a decision concerning a boundary line between a commercial zone and a residential zone. There being no specific lot discription avail- able at this time, a decision could not be given. Chariman HILL announced that this was the time and the place for a public hearing on a rezone request by John Robison and Richard Bechtold for 9.5 acres located West of Edgewood Lane and South of the Eagle Hills Golf Course. Mr. Robison presented the proposal to the Commission and the public. Several questions were asked of the applicant by the Commission and some of the people present. Public testimony began at 8:00 p.m. Written testimony was received from Vinette Southwick opposing the rezone. There being no further written or oral testimony presented, Chairman HILL closed the public testimony portion of the public hearing at 8:05 p.m. Motion by SHADE and seconded by RUSK to recommend to the City Council approval of the rezone application by Richard Bechtold and John Robison to rezone 9.5 acres located West of Edgewood Lane and South of the Eagle Hills Golf Course from A to R-5 for the following reasons: 1. That the property in question is within the City Limits: 2. That Central Sewer and Water are available to this property: 3. That the Community Design and Land Use Sections of the Comprehensive Plan list the property as Residential. Roll call on the motion resulted as follows: AYE: SHADE, SMITHSON, RUSK, VOGT. Motion carried. Ada County Zoning Transmittal #84-37-CU was presented for consideration. The request is for a Conditional Use to permit a 1440 sq. ft. building for personal storage on property located in the Area of Impact. Motion by RUSK and seconded by VOGT to recommend to Ada County for approval of #84-37-CU. Motion resulted as follows: AYE: RUSK, VOGT, SHADE, SMITHSON. Motion carried.
