MINUTES
MARCH 6, 1984
The Commission met in regular session on Tuesday, March 6, 1984,
at 7:30 p.m. at the Eagle Elementary School Library.
Roll call showed the following members presefi~:
SHADE, BRADSHAW.
HILL,
SMITHSON,
Moved by SMITHSON and seconded by SHADE to approve the minutes of
the meeting of February 7, 1984 as printed. Motion resulted as
follows: AYE: SMITHSON, SHADE, BRADSHAW, HILL. Motion carried.
Chairman HILL announced that this was the time and the place
advertised for a public hearing on an application for a Variance
submitted by Mr. & Mrs. Robert Baldwin.
Mr. Robert Baldwin testified that he would like a Variance
for property located at 305 Yellowpine, Eagle. The Variance would
allow construction of a home with a rear yard setback of fifteen feet
instead of the required twenty-five feet. He explained the unusual
conditions that exist concerning this lot. Written testimony in favor
of the variance was submitted by Ed Thomas, 311 Yellowpine, Eagle.
There being no further public testimony to be presented, Chairman
HILL closed the public testimony part of the public hearing. Moved by
SHADE and seconded by SMITHSON to recommend to the City Council approval
of the Variance for the Baldwins as outlined in the application,
dated January 30, 1984, the Commission having held a public hearing,
the information submitted having met all the standards as required by
state law, there being no testimony received in opposition of the
request, furthermore the commission received a letter in favor of
the request. After due and careful consideration we find that the
granting of this Variance will satisfy the answers to the following
questions:
A.
That special conditions and circumstances exist which
are perculiar to the land, structure or building involved
and which are not applicable to other lands, structures or
buildings in the same district;
B.
That a literal interpretation of the provisions of the
Zoning Ordinance would deprive the applicant of the rights
commonly enjoyed by other properties in the same district
under the terms of the Zoning Ordinance.
C.
That special conditions and circumstances do not result
from the actions of the applicant; and
D.
That granting the variance requested will not confer on
the applicant any special privilege that is denied by the
Zoning Ordinance to other lands, structures or buildings
in the same district.

Roll call on the motion resulted as follows:
BMITHSON, BRADSHAW, HILL. Motion carried.

Ada County Transmittal #84-4-CU for Richard Summers to
allow a temporary mobile home on property located on the south
side of State street, 1500 feet west of Highway 55 was considered.
The Commission decided to send the transmittal back to Ada County
with the following questions to be answered:
A.
That a copy of the application of the CUP be forwarded to the
Eagle Planning and Zoning Commission.
B.
That a plot plan of the precise location of the mobile home
on the property be submitted.
C.
Will a driveway be permitted coming directly off of State
street?
D.
How many highway cuts will be allowed for this property?
E.
The age of the relative that the mobile home will be used for?
F.
How often is a Conditional Use Permit reviewed by Ada County?
G.
What is the specific period of time that this conditional use
will be permitted?
H.
What is the relationship of the relative who will occupy the
mobile home to the applicant? and

The applicant is invited to the Eagle Planning and Zoning
meeting of April 3rd to explain the need for this CUP.
Ada County Transmittal #84-2-CU for Quinn-Robbins to expand
a gravel operation located south of the Boise River, 600 feet
east of Eagle Road was again considered. Moved by BRADSHAW and
seconded by SMITHSON to request that the applicant appear before
the Eagle Planning and Zoning Commission to explain the status
of the operation at the present time and the need for expansion.
Motion resulted as follows: AYE: SMITHSON, BRADSHAW, SHADE,
HILL. Motion carried.
The Commission decided to request a meeting with the City
Council on Tuesday, March 20th to discuss the amendments to the
Comprehensive Plan.
Chariman HILL closed the meeting at 8:55 p.m.
