MINUTES
FERRUARY 7, 1984
The Commission met in regular session on Tuesday, February 7, 1984,
at 7:30 p.m. at the Eagle Elementary School Library.
Roll call showed the following members present:
SHADE, SMITHSON.
HILL, VOGT, RUSK,
Moved by SHADE and seconded by VOGT to approve the minutes of the
meeting of January 3, 1984. Motion resulted as follows: AYE: VOGT,
SMITHSON RUSK, SHADE. Motion carried.
Moved by SHADE and seconded by SMITHSON to approve the Findings
of Fact and Conclusions of Law on the Conditional Use Permit application
submitted by Clarence Suiter on behalf of Robert DeShazo Builders.
Motion resulted as follows: AYE: SHADE, RUSK, SMITHSON, VOGT. Motion
carried. Dan BRADSHAW entered the meeting at this time
Ada County Transmittal 84-2 SU for an expansion of a gravel
operation was considered by the commission. It was decided by the
commission to ask AdaCounty for more information concerning the
project including a Reclamation Plan that has been approved by the
State Land Board. The Commission also decided to wait until this
information has been received before making a decision on the expansion.
Tom Wright and Al Marston made a presentation to the Commission
on several projects for Middlebrook. They also presented several
alternatives to changes to the Comprehensive Plan.
After listening to the imputeof two planners a motion was made
by SHADE and seconded by BRADSHAW that the Planning and Zoning Commis-
sion reconsider the philosophical direction of the Comprehensive Plan,
the question being should the Planning and Zoning and City Council be
permitted greater discretion in quiding development within the impact
area? Motion resulted as follows: AYE: BRADSHAW, SHADE, SMITHSON,HILL
NO: RUSK, VOGT. Motion carried.
A joint Council and Planning & Zoning work session was planned
with no specific date set.
Chairman HILL closed the meeting at 9:24 p.m.

Chairman HILL closed the public testimony at 8:45 P.M.
Moved by SHADE and seconded by RUSK that: The Planning and
Zoning Comm~ssion recommend to the City Council that the appli-
cation for a Conditional Use Permit, submitted by Robert DeShazo
Builders, Inc. dated October 31, 1983, would not be approved on
the basis that;
1.
The Conditional use permit is not necessary to accomplish
what is asked for in the application: and
2.
The plans as set forth in the application are not in
keeping with the Comprehesive Plan of the City of Eagle.
Roll call on the motion resulted as follows:
SMITHSON, VOGT, SHADE. Motion carried.

Chairman HILL presented AdaCounty transm~ttal #83-64-Cu-
Barbara Cimino, to construct a horse arena at the corner of
Beacon Light and Eagle Roads in the Eagle Impact area. Ernst
Herrman explained the project in detail to the commission, and
a neighbor in the area Mr. Don Carcloff, asked a few questions and
said that he had no major objections to the project. It was moved
by SHADE and seconded by BRADSHAW to recommend to the Ada County
Planning and Zoning approval of the Conditional Use Permit as long
as the purpose of the conditional use is for a horse arena and not
a rodeo grounds. Motion resulted as follows: AYE: BRADSHAW, RUSK,
VOGT, SMITHSON, SHADE. Motion carried.
Chairman HILL adjourned the meeting at 9:30 p.m.
