MINUTES
NOVEMBER 1, 1983
The Commission met in regular session on Tuesday,
November 1, 1983, at 7:30 P.M. at the Eagle Elementary
School Library.
Roll call showed the following members present:
VOGT, RUSK, SHADE.
HILL,
Moved by RUSK and seconded by VOGT to approve the minutes
of the October 4, 1983 meeting as printed. Motion resulted
as follows: AYE: VOGT, RUSK, SHADE, HILL. Motion carried.
SMITHSON and BRADSHAW intered the meeting at this time.
Chairman HILL announced that this was the time and the
place advertised for a public hearing on an application sub-
mitted by ESCO INC. for a Flood Plain Development Permit to
construct Phase I., II., and III. of a project including an
animal clinic located at 589 E. State Street. Paul Kunz,
Engineer for the project presented information concerning
elevation and other criteria pertinent to the application.
Richard B. Smith, 701 Wyndemer, Boise, spoke in favor of
the project, and Barr N. Smith, 2202 Hillway, Boise, spoke
in favor of the project. Commission member SHADE asked the
engineer, Paul Kunz, eleven questions from the Flood Plain
Ordinance, Section 6, Chapter 4. There being no further
testimony, either oral or written, to be entered, Chairman
HILL closed the hearing and called for discussion. It was
moved by SHADE and seconded by RUSK that on November 1, 1983,
an application from ESCO. INC., for development permit in
compliance with Flood Plain Ordinance #82 was addressed by
the Planning and Zoning Commission: an outline and descrip-
tion of the project was presented by Mr. Paul Kunz, a certif-
ied engineer and licenses with the State of Idaho, also testi-
mony from Mr. Barr Smith and Richard B. Smith in support of
the application. No testimony was presented in opposition of
the project. The property under consideration is described
in the application as being located at 589 E. State Street,
Eagle. The Eagle Planning and Zoning Commission finds that
the questions outlined in Section 6, Chapter 4, of the Flood
Plain Ordinance #82 have been satisfactonly met, thoes issues
involving the opinions of a professional engineer were add-
ressed by Mr. Kunz satisfactorily. Therefore, the applica-
tion and testimony supports the approval of this application
for development in the Flood Plain and the Planning and Zoning
Commission so recommends approval to the Eagle City Council.
Roll Call on the Motion resulted as follows: AYE: VOGT,
RUSK, SHADE, BRADSHAW, SMITHSON. Motion carried.

Under old business, the corrections for parts of the
comprehensive plan were reviewed and Chairman HILL announced
that a review of the new comprehensive plan will be on the
agenda for the December 6th meeting.
Chairman HILL adjourned the meeting at 8:35 P.M.
