PHONE 939.0431 MINUTES MARCH I, 1983 The Commission met in regular session on Tuesday, March I, 1983 at 7:30 P.M., at the Eagle Elementary School. Chairman Jim Hill presiding. Roll call showed the following members present: BRADSHAW, MARSHALL, SHADE RUSK, VOGT, SMITHSON. HILL, Moved by SHADE and seconded by VOGT to approve the minutes of February I, 1983 meeting as printed. Motion resulted as'follows: AYE: BRADSHAW, MARSHALL, SHADE, RUSK, VOGT, SMITHSON. Motion carried. Chairman HILL announced that this was the time and the place for a public hearing to consider a request submitted by Leslie Cullen for a change to the Comprehensive Plan to redesignate a parcel of land presently designated as Flood Plain and Zoned R-5, to an Industrial Land Use. Public testimony in favor of the change was given by James Gipson, 82 E. State Street, Eagle, and Leslie Cullen, Rt. 3, Eagle. Verbatim testimony is on tape dated 3-1-83, #PMN 42 through 91, and tape #Cycles 70 through 127. There bèing no further testimony to come before the commission, the public hearing was declared closed. Moved by RUSK and seconded by SHADE that the Commission make a change to the Comprehensive Plan to allow the develope- ment of a Fabco Plant as requested by Leslie Cullen. Moved by SHADE to amend the motion to read: The Planning and Zoning Commission, having conducted and received oral testimony at the Public Hearing, and having reviewed the request for a change to the Comprehensive Plan by a letter submitted on February 8, 1983 from James Gipson Associates on behalf of Leslie Cullen, and that the public hearing and letter complies with the requirements set forth in the Eagle Comprehensive Plan, and furthermore that Planning and Zoning Commission has complied with Title 67-6509 of the Idaho Code concerning amending the Comprehensive Plan, therefore, it is the recom- mendation of the Planning and Zoning Commission that the City Council amend the Comprehensive Plan as requested. Roll Call on the original motion resulted as follows: AYE: BRADSHAW, MARSHALL, RUSK, SHADE, VOGT, SMITHSON. Motion carried. Roll call on the amended motion resulted as follows: AYE: VOGT, BRADSHAW, MARSHALL, RUSK, SHADE,SMITHSON. Motion carried. Discussion by the Commission indicated that at the previous public hearing, held on Februaryl, 1983 for a request by Mr. Leslie Cullen for a rezone from R-5 to M-I, that Mr. Cullen asked for a deferral rather than a withdrawl, and it was the commissions recommendation to allow a deferral, therefore, a EAGLE PLANNING & ZONING P. PHONE 939.0431 motion was made by SHADE and seconded by RUSK that the Planning and Zoning Commission recommend to the City Council to approve the rezone application received on December 23, 1982 from Leslie Cullen for a change from R-5 to M-l for property located on the West side of North Eagle Road and north of the Boise packing plant, said application meets all the requirements for rezone, furthermore, on February 1, 1983, the Planning and Zoning Commission conducted a public hearing at which time test- imony was received supporting the rezone application. Roll call on the motion resulted as follows: AYE: VOGT, BRADSHAW, MARSHALL, RUSK, SHADE, SMITHSON. Motion carried. Under unfinished business a motion was made by SHADE and seconded by BRADWHAW to delete the "Neighborhood Boundries" map from the comprehensive plan. Motion resulted as follows: AYE: BRADSHAW, MARSHALL, RUSK, SHADE, VOGT, SMITHSON. Motion carried.
