The regular meeting of the Eagle Planning and Zoning Commission was
called to order by Chairperson Sharp on July 7, 1981 at 7:30 P. M.
at the Eagle City Hall.
MEMBERS PRESENT: BROWNLEE, HILL, SHARP, SORENSON.
WAITE were excused.

Moved by BROWNLEE and seconded by SORENSON that the minutes of the
previous meeting of June 2, 1981 be approved as printed.
Motion resulted as follows: AYE: BROWNLEE, HILL, SORENSON. Motion
carried.
Chairperson Sharp announced that this was the time and the place for
a public hearing to consider a new Floodplain Ordinance which identifies
areas of special flood hazard; state the functions of the Zoning Administrator,
the Planning and Zoning Commission, and the City Council, and the procedures
for obtaining approval for any construction or development; creates an
Appeal Board and procedures for applying for and processing variances;
establishes general and special standards which must be met by all new
construction or substantial improvements; states that the Zoning Administrator
shall enforce the Ordinance and that violations shall be punishable as a
misdemeanor as outlined in Ordinance No. 40.
Frank Stoppeloo, 782 Arlington Drive, Eagle Idaho spoke to several items
in the ordinance that he wished the commission to study and evaluate before
making a recommendation to the council.
There being no further testimony the public hearing was declared closed.
Moved by HILL and seconded by BROWNLEE that in light of the testimony received
and the review of the ordinance that it be tabled and brought back for
consideration in work session and at the next regular meeting of the
commission.
Motion resulted as follows: AYE: BROWNLEE, HILL, SORENSON. Motion
carried.
Chairperson Sharp announced that this was the time and the place for a
public hearing to consider a new Subdivision Ordinance which will repeal
Chapter XVI, Trailers and Trailer Courts, and Chapter XVII, Subdivisions
of Ordinance No.1; setting forth general provisions to include purpose,
jurisdiction and administration; setting forth definitions; establishing
procedures for subdivision approval, design standards and improvement
standards; providing for special development subdivision; vacations and
dedications; variances; detection of violation, enforcement and penalties;
establishing procedures for amendment and providing for an effective date.
Councilman Krasen gave comments concerning the ordinance.
Frank Stoppello, 782 Arlington Drive, Eagle, Idaho asked the commission
to further study this ordinance and evaluate all phases before making
a recommendation to the council.
Ron Marshall, Route #1, Eagle, Idaho also requested the commission to table

this ordinance for further review of several items.
There being no further testimony the public hearing was declared closed.
Moved by SORENSON and seconded by HILL that action on this ordinance
be tabled until the next regular meeting and hopefully there will be
a work session before that meeting.
Moved by SORENSON and seconded by HILL to amend the original motion
to include the commission will receive any public written or oral
comments until July 21,1981 regarding said ordinance.
Amended motion resulted as follows: AYE: BROWNLEE, HILL, SORENSON.

Moved by HILL and seconded by SORENSON that testimony will be received
by the Planning and Zoning Commission on the flood plain ordinance until
July 21, 1981.

Chairperson Sharp announced that this is the time and the place for a
public hearing to consider changes to Eagle City Ordinance No. 55,
which revokes the current design review overly district map and replaces
it with a new map showing areas "A" and "B", which sets criteria for
individual business signs, pylon or detached street signs, and signs which are
not permitted; and adding a new sub-paragraph to paragraphs 5, Annex
liB", which states: Doors shall be framed in wood or anodized non-glaring
material.
Councilman Krasen made comments to the commission on this ordinance.
Carol West, 275 Harvey, Eagle, Idaho a member of the Design Review
Board spoke against this ordinance.
Ron Marshall, Route #1, Eagle, Idaho, chairman of the Design Review Board
spoke against this ordinance and presented pictures from Jackson Hole
Wyoming to show how signs could destroy the effect of a western theme.
A letter was read from Wayne Crosby, a member of the Design Review
Ordinance Commission stating he is quite vehemently opposed to any
change to Ordinance No. 55.
Gary Drown, Boise, Idaho, the developer who make the request for the
change to Ordinance No. 55 spoke in favor of the ordinance.
There being no further testimony to come before the commission, the

Moved by HILL and seconded by BROWNLEE that the Plan~ng and Zoning Commission
after hearing the testimony here tonight and review 'the ordinance would
recommend to the city council that they consider this chan1ng ordinance
and according to our best advice it does comply wi~ the compr~þen~ive
plan and it is in corfþliance with the state law in~~jn'gt'f~fto"1Hnafí~ès and it
has received all due notification that the planning and zoning recommend
to the city council that they not adopt the new ordinance, that we would
maintain the existing one at this time.
Motion resulted as follows: AYE: HILL, BROWNLEE. NAY: SORENSON.
Motion carried.
