PHONE 939.0431 November 4, 1980 The regular meeting of the Eagle Planning and Zoning Commission was called to order by Chairperson Sharp at 7:30 P. M. on November 4, 1980 at the Eagle City Hall. MEMBERS PRES ENT: ALLRED, BROWNLEE, SHADE, SHARP, HILL. SORENSON were excused. WAITE was absent. FISHER and The minutes of the previous meeting of October 7, 1980 were corrected as follows: Page 1, paragraph 5, line 6 ADD: "There being no further testimony to come before the commission, the public hearing was declared closed." Moved by ALLRED and seconded by BROWNLEE to approve the minutes as corrected. Motion resulted as follows: AYE: ALLRED, BROWNLEE, SHADE, HILL. Motion carried. SHADE submitted a revised copy of Ordinance #60 to all members of the planning and zoning and discussed the changes with the commission that had been made in the previous draft. "Delete stars and change to alphabet. Section 2, paragraph b. as refers to footnote (f) add at the beginning of line three "for the lots indicated" and add on line four after structures, "and a six inch lot line setback for the other interior side yard. The six inch lot line setback extends as a vertical plane such that no portion of the building cuts said plane." Moved by SHADE and seconded by ALLRED whereas, the city council has referred Ordinance #60 to the Planning and Zoning Commission, whereas on October 7, 1980 the planning and zoning commission held a public hearing and, whereas, the planning and zoning commission has considered the comments raised at the public hearing and have carefully reviewed the issues connected with the ordinance it is hereby recommended by the planning and zoning commission to the city council that a redrafted Ordinance #60, attached as part of the motion be approved. Roll call on the motion resulted as follows: AYE: ALLRED, BROWNLEE, SHADE, HILL. Motion carried. Zoning Ordinance Amendment request #1-80 submitted by Mel Lawrence to allow dry line sewers and septic tanks in a density greater than R-l. Moved by SHADE and seconded by ALLRED, whereas we are in receipt of a request from Mel Lawrence for an amendment to thg zoning ordinance to allow septic tanks and dry line sewers in (f[~~sity§> greater than R-l, whereas on October 7, 1980 this request was the subject of a public hearing where testimony both pro and con was received, and whereas subsequently the planning and zoning commission received a statement from the Eagle Sewer District in which they stated that a policy has been adopted by that district that they did not approve a dry line septic system, and whereas~ on this date the commission carefully considered the testimony received at the public hearing) therefore, November 4, 1980 Page 2 the statement of the Eagle Sewer District and other matters hereby recommends to the city council that the request of Mel Lawrence to amend the Eagle Zoning Ordinance not be approved. SHADE offered the following amendment to his motion: The paragraph immediately preceeding the paragraph starting therefore, the following paragraph be inserted. whereas, there is no approved plan submitted by the Eagle Sewer District as to timing and layout of the sewer system it would appear premature to grant the request of Mr. Lawrence. ALLRED seconded the amendment. Roll call on the amendment resulted as follows: AYE: ALLRED, BROWNLEE, SHADE, HILL. Motion carried. Roll call on the original motion resulted as follows: BROWNLEE, SHADE, HILL. Motion carried. AYE: ALLRED, There being no further business to come before the commission, the meeting was adjourned.
