PHONE 939.0431 June 3, 1980 The regular meeting of the Eagle Planning and Zoning Cowmission was called to order by Chairperson Sharp at 7:30 P. M. on June 3, 1980 at the Eagle City Hall. Officio members present: SORENSON, and WAITE. BROWNLEE, FISHER, SHÀDE, SHARP, Hoved by SHADE and seconded of the previous meetings of printed. Motion resulted as follows: SORENSON, and WAITE. Motion by FISHER to approve the minutes April 1 and 3, and May 6, 1980 as AYE: BROWNLEE, FISHER, SHADE, carried. The commission was in receipt of a letter from Attorney Welsh stating that the procedure followed for a zoning ordinance amendment request from Summer's Funer Home did not violate the provisions of the local planning act. ZONING ORDINANCE AMENDMENT - SUMÞ1ER' S FUNERAL Hm~F Moved by Shade and seconded by BROWNLEE to remove this request from the table. Roll call on the motion resulted as follows: AYE: BP.o'~~;\!LEE, FISHER, SHADE, SORENSON, and WAITE. Moved by BROWNLEE and seconded by SHADE to approve the Zoning Text Amendment for Summer's Funeral home to operate a mortuary in a C-2 zone classification with a conditional use and find as follows: 1. This request is in accordance with the adopted Comprehensive Plan. 2. The location of a mortuary within a C-2 district is compatible with other uses within such district. 3. Notice and hearing procedures were held in accordance with 67-6509, 67-5411 IDAHO CODE, and Article XVII of Eagle Zoning Ordinance #40. 4. A public hearing was held on May 6, 1980 and accepted public testimony concerning this proposed amendment to the zoning ordinance. June 3, 1980 Page 2 5. All public testimony was favorable. In addition to the above the commission also considered the impact this zoning text amendment may have upon public facilities and compatibility with the surrounding area. Roll call on the motion resulted as follows: AYE: BROWNLEE, FISHER, SHADE, SORENSON, and WAITE. Hotion carried. CONDITIONAL USE PERMIT - SUMMER's FUNERAL HOME Moved by SHADE and seconded by SORENSON to remove this application from the table. Roll call on the motion resulted as follows: AYE: BROWNLEE, FISHER, SHADE, SORENSON, and WAITE. Motion carried. Moved by SHADE and seconded by FISHER that the Eagle Planning and Zoning Commission recommend approval of the Conditional Use Application submitted by Summer's Funeral Home. This motion to recommend approval is made with due consideration to the public hearing on May 26th and further review of the staff recommendation on this application, .:the following standards are applicable. 1. This application does require an amendment to the zoning ordinance. 2. A mortuary will be harmonious with and in accordance with the general objectives or with any specific objectives of the Comprehensive Plan and/or the Zoning Ordinance. 3. The applicant says this building will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the exisiting and intended character of the general vicinity and that such use will not change the essential character of the same area. 4. It will not be hazardous or disturbing to existing or future neighboring uses. 5. It will be served adequately by essential public facilities and services such as highway, streets, police and fire protection, drainage structures, refuse disposal, water, sewer and schools. No business parking will be allowed on State Street. 6. It will not create excessive additional requirements at public costs for public facilities and services and will not be detrimental to the economic welfare of the coromunity. June 3, 1980 Page 3 7. It will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reasons of excessive production of traffic, noise, smoke, fumes, flare or odors. 8. It will have vehicular approaches to the property, but must have proper control over traffic entering State Street during a funeral procession. 9. It will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. 10. It must meet off street parking requirements of Section D Article XIV of Eagle Zoning Ordinance. 11. The applicant must meet the requirements of the Design Review Ordinance when remodeling exterior of the building.
