Minutes - 1980 - Planning & Zoning - 04/01/1980 - Regular EAGLE PLANNING & ZONING P. O. BOX 477 - EAGLE, IDAHO 83616 - PHONE 939-0431 April 1, 1980 The regular meeting of the Eagle Planning and Zoning Commission was called to order at 7:30 P. M. on April 1, 1980 by Chair- person Sharp at the Eagle City Hall. Members present: ALLRED, BROWNLEE, FISHER, SHARP, SORENSON, SHADE. WAITE was excused. Ex-Officio Members present: RICHARDS. HILL was excused. Moved by ALLRED and seconded by SHADE to correct the minutes of February 5, 1980 as follows: Page 2, Paragraph 3 - add- Motion resulted as follows: "ALLRED, BROWNLEE, SORENSON, KUNKLER voted aye. Motion carried." Motion resulted as follows: AYE: ALLRED, BROWNLEE, FISHER, SORENSON, SHADE. Motion carried. Chairperson Sharp introduced new commission members to the council. WAITE, HTtL, RICHARDS. (J.eyyrl/yY~J Chairperson Sharp announced that this was the time and place for a public hearing on a conditional use application submitted by the Eagle Church of the Nazarene to construct a church and day care center in an R-5 Zone located on the south side of Highway 44 just east of Robert Morley home. Jim Gibson, 187 E. Beacon Light, architect for the development, made a presentation to the commission. Pastor Ball, Taylor Street,spoke in favor of the project. There being no further testimony the public hearing was declared closed. Moved by ALLRED and seconded by SHADE that the planning and zoning commission recommend to the city council approval of the conditional use permit of the Nazarene Church contingent on their compliance with the following items. 1. Access road is to be built to Ada County Highway District standards and flared where it joins State Street and that the front of the property will be designed so that adjacent properties can use this frontage as a roadway to the access road being built by the Nazarene Church. 2. Water and sewer facilities to be approved by the Central District Health. April 1, 1980 Page 2 Motion resulted as follows: AYE: SORENSON, SHADE. Motion carried. ALLRED, BROWNLEE, FISHER, The final plat of Eagle Village #3 was presented to the commission by Dean Briggs, engineer for the developer. Moved by SHADE and seconded by FISHER that the planning and zoning commission recommend to the city council that they approve~ the final plat of Eagle Village #3 subject to the developer complying with the following conditions: 1. Submit a copy of the suretya~reement with the Ada County Highway District in the amount of 100 percent of the estimated cost of offsite improvements or the completion and acceptance of said improvements prior to recording the final plat. 2. Submit a letter of approval of the drainage plan by the Ada County Highway District and the County Engineer prior to recording the final plat. 3. Fence-cover irrigation ditches or canals through/adjacent to the subdivision or bond in the amount of 100 percent of the estimated improvement cost prior to final recording. 4. Approved fire protection facilities to be provided to comply with requirements of the Eagle Fire Department. 5. All street names to be approved by the Ada County Department of Public Works prior to submitting the final plat for recording. 6. Submit a letter of acceptance for water service from the Eagle Ranch Water Company prior to recording the final plat. 7. Submit a letter of acceptance for sanitary sewer service from the Eagle Sewer and Water District prior to recording the final plat. 8. Installation of service utilities to comply with require- ments determined by the public utilities providing service. 9. Minimum building setback lines shall be in accordance with the zone standards in effect for the area and delineated on the final plat. April 1, 1980 Page 3 10. All lot, parcel or tract size to meet dimensional standards established for the zone in which they are located. 11. Prior to submitting the final plat for recording the following endorsements or certifications must be executed: Signatures of owners or dedicators, Certificate of the Engineer, Certificate of the County Engineer, Certificate of Central District Health Department, Certificate of the City Clerk. 12. The final plat to be reviewed by the Ada County Assessor prior to submitting the final plat for recording. 13. Wet line sewers are required. 14. Submit a copy of the restrictive covenants. 15. The park must be deeded to the city within one year with a plan for the development that they will provide. Further, the topography will be put into a usable condition as approved by the city council. Motion resulted as follows: AYE: SORENSON, SHADE. Motion carried. ALLRED, BROWNLEE, FISHER, Moved by SORENSON and seconded by SHADE that a public hearing be held on May 6, 1980 to consider a request from Summers Funeral Home to change the zoning ordinance to allow a mortuary in a C-2 zone classification with a conditional use permit. Motion resulted as follows: AYE: SORENSON, SHADE. Motion carried.
