1. CALL TO ORDER: Mayor Ridgeway calls the meeting to order at 5:30 p.m.
2. ROLL CALL: BASTIAN, GOLD, PITTMAN, MITCHELL. All present. A
quorum is present.
3. PLEDGE OF ALLEGIANCE: Mayor leads the Pledge of Allegiance.
4. SERVICE RECOGNITION: The City would like to honor Michael Huffaker for
his service to the Eagle community while serving on the Parks, Pathways and Recreation
Commission, as a former City Council member, and Interim Mayor. Mayor Ridgeway
introduces Michael Huffaker and reads the Eagle Proclamation declaring August 29, 2018
as Michael Huffaker day in the City of Eagle. Mayor presents Michael with the City of
Eagle Proclamation and thanks him for his service to the Eagle community.
PRESENTATION:
A. Presentation by Valley Regional Transit (VRT) concerning existing and future transit
service in Eagle. (NBS)
Stephen Hunt displays a power point presentation and provides Council an overview of
the Fall 2018 Service Change Update. General discussion.
6. PUBLIC COMMENT:
This time is reserved for the public to address their elected officials regarding
concerns or comments they would like to provide to the City Council regarding
subjects not on the agenda. At tinges, the City Council may seek comments/opinions
regarding specific City matters during this allotted time. This is not the time slot to
give formal testimony on a public hearing matter, or comment on a pending
application or proposal. Out of courtesy for all who wish to speak, the City Council
requests each speaker limit their comments to three (3) minutes.

providing an effective date. The 0.38 -acre site is located on the east side of

P. Resolution No. 18-27 (Vigne D' Aquila Subdivision): A resolution of
the Eagle City Council to vacate the shared ingress/egress easement serving

effective date. The 10.48 -acre site is located on the east side of North
Ballantyne Lane approximately 760 -feet north of the intersection of West

Q. Resolution No. 18-28 (Mace River Ranch Sub. No. 4 Subdivision): A
resolution of the Eagle City Council to vacate a pond easement setback line
shown on Lot 58, Block 1, of Mace River Ranch Subdivision No. 4.; and
providing an effective date. The .57 -acre site is located on the north side of
South Brentbrook Lane (Private) at the intersection of South Brentbrook Lane
(Private) and South Hiddenwood Lane (Private) at 573 South Brentbrook

R. Resolution No. 18-29 City of Eagle's Endorsement of Ada Country
Highway District's Vehicle Registration Fee Reauthorization. (SR)
S. Memorial Bench for Ronald J. Ascuena: Request for Council approval
of a memorial bench to be located at the Ada/Eagle Sports Complex. (SR)
T. Michael Huffaker Day Proclamation: A proclamation of the City of
Eagle declaring August 29, 2018 Michael Huffaker Day in the City of Eagle
for his dedication and volunteerism while serving this community. (SR)
U. Resolution No. 18-30 — Communication Policy.
V. Public Pathway Construction, Survey Work, and Fence Construction
Expenditure: Request for Council approval of the expenditure of $9,200.00
(cost not to exceed $10,000.00) and authorization for Mayor to sign contracts
for the construction of a 10 -foot wide asphalt pathway, approximately 150 -feet
in length, located on the south side of State Highway 44, along the north side
of the Boise River approximately 1/3 -mile west of Linder Road at 5337 W.
State Street. Included in the request is an expenditure of $1,700.00 (not to
exceed $2,000.00) for pre and post pathway construction survey work, legal
description, and map exhibit and expenditure of $4,500.00 (not to exceed
$5,000.00) for construction of an extruded aluminum fence (looks similar to
wrought iron) along the north side of the pathway. (WEV)

W. Boise River Pathway Easement Agreement: Approval of easement
agreement between the City of Eagle and Shawn Nord regarding the grant of
easement for a 10 -foot wide paved pathway along the north side of the Boise
River. The easement area is generally located on the south side of State
Highway 44, along the north side of the Boise River approximately 1/3 -mile
west of Linder Road at 5337 W. State Street. (WEV)

Pittman: I had questions regarding the date history for a scribe error, it's not in
chronological order and I wasn't sure if that was supposed to be corrected. Errors on P.1
of 15, P. 3 of 15, P. 2. Zoning Administrator states that the corrections will be made.

Paul Woods, ACHD Commission, comments on Resolution #18-29 the City's
endorsement of the ACHD Vehicle Registration Fee Reauthorization. These fees will be

9. UNFINISHED BUSINESS:
A. ACTION ITEM: RZ-10-15 MOD2 & PP -07-15 MOD — Truman Cove Subdivision
(formerly known as Eagle Lakes Subdivision) — TPC Brooklyn Park Investors,
LLC: TPC Brooklyn Park Investors, LLC, represented by John Rennison, P.E., with
Rennison Engineering, is requesting a development agreement modification and
preliminary plat modification for Truman Cove Subdivision (formerly known as Eagle
Lakes Subdivision), a previously approved 301 -unit, 80 -lot (51 -single-family, 6 -multi-
family [consisting of 250 -units], 12 -commercial, 10 -common, and 1 -private street)
subdivision. The proposed subdivision modification includes 327 -units, 110 -lots (77 -
single -family, 6 -multi -family [consisting of 250 -units], 12 -commercial, and 15 -common).
The 75 -acre site is generally located on the south side of State Highway 44,
approximately 1,129 -feet west of the intersection of State Highway 55 and State Highway

Planner Williams: The Council held a public and continued the public hearing to take
additional testimony and to look at a revised plan. During your last Council Meeting the
hearing was closed and a motion was made by the Council to continue the application to
tonight, so the representative of the project could bring back a new plan or design. The
representative has submitted a revised design and the representative is here to present that
design.
John Rennison, the applicant, discusses the modification that have been made to the plan.

Agreement modification and Preliminary Plat modification for Truman Cove

fence where the single family detached homes are will all be single story. General

10. PUBLIC HEARINGS:
Public hearings will not begin prior to 6:00 p.m.
Public Hearings are legally noticed hearings required by state law. The public
may provide formal- testimony regarding the application or issue before the City
Council. This testimony will become part of the hearing record for that
application or matter.
A. ACTION ITEM: PP -05-18 — Woodcreek Estates Subdivision — SMKM, LLC:
SKMK, LLC, represented by Wendy Shrief with J -U -B Engineers, Inc., is requesting
preliminary plat approval for Woodcreek Estates Subdivision, a 9 -lot (6 -buildable, 3 -
common) residential subdivision. The 4.03 -acre parcel is located at the terminus of West
Enchantment Street, North Cobblestone Lane, and North Cobblestone Way at 489 North
Cobblestone Lane. (WEV)

Planner Williams displays a power point presentation and provides an overview for the
Council.
Trails Coordinator Noyes displays a site plan and discusses the PPRC recommendations.
General discussion.
Zoning Administrator Vaughn discusses the pathway locations. The applicant is willing
to grant an easement for the City to construction the pathway in the future. Displays a
cost comparison of what pathways costs. Discusses the cost of the construction of a
pathway and if the developer does not build the pathway should there be a monetary
benefit to the City. General discussion.
Mayor: I would like to ask if there is any ex parte contact by any member of Council or
any conflict of interest on this issue. (Mayor has no response from Council.)

appropriate then you would need to include that.

City Attorney McLain: Motion Language should state: in lieu of the requirement to
construction an asphalt or concrete pathway the applicant shall contribute $25,671.00 to
the City. Such funds shall be restricted to the use of design and construction a pathway
along the Dry Creek Pathway system. The Contribution needs to be prior to issuance of
building permits.
Bastian moves to approve PP -05-18 Preliminary Plant for Woodcreek Estates
Subdivision that we strike Site Specification Condition #14 and substitute in its
place "in lieu of the required asphalt or concrete pathway the applicant shall
contribute $25,671.00. Such funds shall be restricted for the design and
construction of a pathway and needs to be prior to the issuance of building permits.
Zoning Administrator Vaughan: I want to clarify for the record: in your statement
about the contribution, you did not state that it needs to be solely allocated for use
by the City along the Dry Creek pathway system. Bastian: this needs to be changed.
General discussion. Planner Williams: Site Specific Condition of Approval #13 and
#14 should read as follows: Site Specific Condition #13. Provide a blanket
pedestrian pathway easement located north of the New Dry Creek Canal within the
adjacent property to the west (owned by the applicant) to facilitate the continuation
of the Dry Creek Pathway. Upon final determination of the pathway location the
easement document shall be provided for review and approval by the City Engineer
and City Attorney and shall be recorded in the Ada county recorder's office prior to
construction of the pathway. Site Specific Condition #14. In lieu of the required
asphalt or concrete pathway (located adjacent to Dry Creek), the applicant shall
contribute $25,671.00 to the City. Such funds shall be solely allocated for use by the
City for the design and construction of a pathway along the Dry Creek pathway
system. The $25,671.00 shall be provided prior to the issuance of building permits.

A. ACTION ITEM: Ordinance No. 802 (Syringa Construction Rezone): An ordinance
changing the zoning classification of the real property described herein from MU (Mixed
Use) classification to MU -DA (Mixed Use with a Development Agreement); amending
the zoning map of the City of Eagle to reflect said change; and providing an effective
date. The 0.6 -acre site is located on the south side of East Dunyon Street approximately
660 -feet west of the intersection of South Parkinson Street and East Dunyon Street at
2177 East Dunyon Street. (WEV)

Rezone): An ordinance annexing certain real property situated in the unincorporated area
of Ada County, Idaho, and contiguous to the corporate limits of the City of Eagle, to the
City of Eagle, Idaho; changing the zoning classification of said real property described
herein from RUT (Rural -Urban Transition) to R -4 -DA -P (Residential with a
Development Agreement - PUD); amending the zoning map of the City of Eagle to reflect
said change; directing that copies of this ordinance be filed as provided by law; and
providing an effective date. The 3.94 -acre site is located on the southwest corner of South
River Creek Avenue and West State Street (Hwy 44) at 5335 West State Street. (WEV)

City attorney McLain discusses the request for an amendment to the waiver and McLain's
recommendation not to amend the waiver. General discussion.

Bryon Ertz, 91 S. Pit Lane, Nampa, Idaho, I respectfully disagree with the Attorney on her
definition of LUPA. Discusses the waiver provisions in Idaho Code and his interpretation
of the Code.
Julie Fugate, 1861 NW 24th Street, Fruitland, Idaho, you are all heroes for the State of
Idaho. Please take the extra steps to make the recommended changes.

attorneys and they all reached a very strong consensus that this amendment to the waiver
is critical. The ordinance that you passed is profound. But everything can be undone by
an operator that wants to use this waiver. The paper I gave you has to do with insurance.

December meetings are more difficult. Discussion on having one meeting in December.

EAGLE ORDINANCE #792:
The applicant shall provide proof of a certificate of comprehensive general liability
insurance in the amount of no Tess than fifteen million dollars ($15,000,000) per
occurrence with an aggregate of thirty million dollars ($30,000,000) and a company
authorized to do business in the state of Idaho shall write the policy. The policy shall not
contain any exclusions of coverage for hydraulic fracturing or mining extraction
activities. The applicant shall also provide proof of operator's extra expense liability
coverage in the event of well failures in the amount no less than one million dollars
($1,000,000).
The certificate shall require at least 30 day notice to the City prior to termination of
coverage for any reason. The applicant shall secure substitute liability insurance
coverage prior to actual termination: failure to maintain comprehensive general liability
insurance shall result in immediate withdrawal of the permit by the City. At time of
application, the applicant shall provide written indemnification for the City.
EMMETT CITY DRAFT ORDINANCE:
Indemnification Clause: Each permit issued by the City of Emmett Zoning
Department shall include the following: "Operator does hereby expressly release and
discharge all claims, demands, actions, judgments, and executions which it ever had,
now has or may have, or claim to have, against the City and/or its departments, its
agents, officers, servants, successors, assigns, sponsors, volunteers, or employees,
created by, or arising out of personal injuries, known or unknown, and injuries to
property, real or personal, or in any way incidental to or in connection with the actions
Of inaction of the Operator or its agents. or caused by or arising out of, that sequence
of events which occur from the Operator's or its agents actions or inactions. The
Operator shall fully defend, protect, indemnify, and hold harmless the City and/or its
departments, agents, officers, servants, successors, assigns, sponsors, or
volunteers, or employees from and against each and every claim, demand, or cause
of action and any and all liability, damages, obligations, judgments, losses, fines,
penalties, costs, fees and expenses incurred in the defense of the City and or its
servants, successors, assigns, sponsors, volunteers, or employees, including,
without limitations, personal injuries and death in connection therewith which may be
made or asserted by Operator, its agents, assigns, or any third parties on account of,
arising out of, or in any way incidental to or in connection with the performance of the
work performed by the Operator under any permit.
7. Required Insurance Coverage:
a. The applicant shall submit with the application a certificate of
comprehensive general liability insurance in the amount of no less than
three million dollars ($3,000,000.00) per occurrence with an annual
general aggregate coverage of five million dollars ($5,000,000.00). The
policy shall be written by a company authorized to do business in the
state of Idaho. The certificate shall require at least thirty (30) days' notice
to the city prior to termination of coverage for any reason.
b. Excess (or umbrella) liability insurance: Minimum limit of fifteen million
dollars ($15,000,000.00) providing excess coverage for each of the
perils insured by the preceding liability policies.
c. Control of well insurance:
1. Minimum limit of ten million dollars ($10,000,000.00) per occurrence,
with a maximum deductible of two hundred fifty thousand dollars
($250,000.00) per occurrence.
2. Policy shall cover the controlling of a well that is out of control,
redrilling or restoration expenses, and seepage and pollution
damage.
d. Underground reservoir (or resources) damage coverage shall be on an
occurrence basis, shall not be limited to sudden and accidental
occurrences, shall not have a discovery or reporting limitation and shall
not exclude damage to water tables, formation or strata.
e. Environmental impairment (or seepage and poll) coverage shall be
either included in the comprehensive general liability coverage or as a
separate coverage. Such coverage shall not exclude damage to the
lease site. If environmental impairment (or seepage and pollution)
coverage is written on a "claims -made" basis, the policy must provide
that any retroactive date applicable precedes the effective date of the
issuance of the permit. Coverage shall apply to sudden and accidental
pollution conditions resulting from the escape or release of smoke,
vapors, fumes, acids, alkalis, toxic chemicals, liquids, oil and gas, waste
material, or other irritants, contaminants or pollutants. Such policy shall
provide for a minimum combined single limit coverage of ten million
dollars ($10,000,000.00) per occurrence. A discovery period for such
peril shall be for the life of the well, which is up to the time when the well
is abandoned and capped, plus fifteen years.

Popular Geophysical Surveying Methods
Ground -Penetrating Radar (GPR)
Ground Penetrating Radar (GPR) is used to pinpoint the location of buried objects. Unlike conventional metal
detectors. radar can locate both metallic and nonmetallic objects, as well as identifying subsurface voids. The GPR
instrument transmits electromagnetic radar energy into the ground, a portion of which is reflected back to the
instrument, when an electrical contrast exists at the detected subsurface object. GPR is an excellent profiling tool
(ie, creates a cross-sectional image of the subsurface), as it continuously records an image of the reflected energy as
the antenna is traversed across the ground surface, to yield a cross-sectional view of the subsurface. The radar wave
travels at a velocity unique to the material properties of the ground being investigated and when these velocities are
known, or closely estimated from ground conductivity values and other information, two—way travel times can be
converted to depth measurements. Penetration into the ground and resolution of the image produced are a function
of ground electric conductivity and dielectric constant.
GPR works best within the upper 100 feet of the subsurface and due to its depth limitation and inability to image
vertical or high -angle features (ie, fractures) GPR cannot detect deep fractures such as those created by oil/gas
drilling and fracking operations.
Electromagnetic Induction (EMI)
Electromagnetic induction (EMI) utilizes the principle of induction (Maxwell's Law) to measure the electrical
conductivity of the subsurface. A primary alternating electric current of known frequency and magnitude is passed
through a transmitting coil that generates an induced primary magnetic field into the subsurface soil. Associated
subsurface eddy currents in turn induce a secondary current in underground conductors to create an alternating
secondary magnetic field that is picked up by the receiving coil. Unlike GPR, EMiI does not create a cross-
sectional image of the subsurface, but rather a series of lateral changes in the subsurface response to the induced
electrical current.
Like GPR, EMI works best within the upper 100 feet of the subsurface and due to its depth limitation and inability
to image vertical or high -angle features (ie, fractures) EMI cannot detect deep fractures such as those created
by oil/gas drilling and fracking operations.
Electrical Resistivity Tomography (ERT)
Electrical resistivity tomography (ERT) or electrical resistivity imaging is a geophysical technique (or imaging
subsurface structures from electrical resistivity measurements made at the surface, or by electrodes in one or more
boreholes. Electrical resistivity contrasts are frequently found between dry and water -bearing subsurface soil.
different soil or rock types and along the boundaries of buried manmade features and the surrounding soil. Using
an electrical apparatus with current and potential (voltage) electrodes, an electrical resistivity versus depth profile
or cross-sectional image is created. ERT is primarily controlled by the quantity and chemistry of the pore fluids
within the subsurface soils and rock. For this reason, ERT is an excellent tool for detecting the presence of
manmade fracking fluids that are migrating upwards or laterally through recently created joints or
fractures and can image the subsurface as deep as one mile.
Magnetics (MAG)
This is an efficient and effective method to survey large areas for ferromagnetic (iron -bearing metal) underground
piping, tanks and drums. Ground magnetic measurements are usually made with portable instruments at regular
intervals along more or less straight and parallel lines that cover a survey area. The magnetometer is a sensitive
instrument used to map lateral variations in the Earth's magnetic field.
Magnetics does not create a cross-sectional image of the subsurface and is completely unable to detect non-
metallic drilling and/or fracking fluids that have been injected into subsurface fractures.

Seismic Refraction and Reflection (SEIS)
Seismic refraction and reflection investigate the subsurface by generating arrival time and offset distance
information to determine the path and velocity of an elastic disturbance at the ground surface. The disturbance is
created by introduced impulsive energy into the ground that is subsequently detected by regularly -spaced
geophones that record the arrivals of compressional (Vp or P wave) energy waves. The data are plotted in time -
distance graphs (ie, cross sections) from which subsurface properties and associated depths are calculated. The rays
associated with an expanding energy wavefront are refracted across or reflected from layer boundaries whenever a
difference in elastic and density properties exists. In seismic refraction, the first critically refracted rays travel along
a layer interface at the speed of the "fastest" underlying layer (within the depth of investigation) and are
continuously "fed" back to the surface, where they are detected by the line of geophones. In seismic reflection, ray
reflections from numerous (not just the fastest) subsurface interfaces (within the depth of investigation) are
continuously "fed" back to the surface, where they are detected by the line of geophones.
Like ERT, SEIS is capable of imaging very deep structures and layers but (unlike ERT) SEIS refraction is hard
pressed to image the high -angle or vertical fractures that often result from fracking operations. SEIS reflection is
capable of detecting such fractures but only when sufficiently abundant reflected rays are recorded at the surface
line of geophones. To achieve sufficient resolution, very "tight" (ie, closely spaced) lines of geophones are
required at considerably higher cost than a comparably effective ERT electrode array requires. Additionally, even
the most detailed SEIS survey could conceivably "overlook" incipient (small) fracking-fluid filled fractures,
whereas ERT, by virtue of its ability to detect small electrochemical changes could conceivably detect these
tracking -based fractures.
Though SEIS is capable of deep imaging, its relatively higher cost and potential for overlooking small, high -
angle fractures, it is a distant second choice tool for detecting possible subsurface damage caused by oil/gas
drilling and fracking operations.
Gravimetric Method (Gravity)
Gravity meters sense extremely small variations in the gravitational field at a series of different locations over an
area of interest. The objective in exploration work is to associate these variations with differences in the distribution
of densities attributable to different rock types. The gravity method can be a relatively easy geophysical technique
to perform and interpret. It requires simple but precise data processing, with the accurate determination of a
station's elevation being the most difficult and time-consuming aspect. The technique has good depth penetration
when compared to the GPR, EMI, RES and SEIS resistivity methods and is not affected by the high conductivity
values of near -surface clay rich soils. Additionally. lateral boundaries of subsurface features can be easily obtained
by measuring the derivative of the gravitational field. However, its main drawback is the ambiguity of the
interpretation of gravity anomalies, since the latter can be caused by numerous source bodies. An accurate
determination of the source usually requires outside geophysical / geological information or ground -truth.
Though Gravity is capable of deep measurements, its inherent ambiguity completely eliminates it as a means
of detecting possible subsurface damage caused by oil/gas drilling and fracking operations.
Remote Sensing (RS)
In contrast to onsite observations, Remote Sensing (RS) is the acquisition of information about an object or
phenomenon without making physical contact with it. RS methods include Light Detection and Ranging (LIDAR),
which carefully measures distances and creates Digital Elevation Models (DEMs) which can predict flooding. RS
includes satellite imagery of the Earth's surface in varying electromagnetic frequency bands such as visible light
(aerial photographs). ultraviolet or infra -red, the latter of which can "see" things (ie, stressed vegetative cover) the
human eye often misses. RS also includes Magnetics (see above) associated with relatively large disturbances in
the Earth's magnetic field, hut in no way measures the considerably smaller changes associated with buried objects
like tanks and drums!
Because RS only measures surface features and effects, it is entirely inappropriate as a means of detecting
potential subsurface damage caused by oil/gas drilling and fracking operations.

Geologic Methods
I don't know of any geologic method (ie, expensive and intrusive borings) that effectively shows the extensive
spread of "frack fluids" through a newly made fracture into an adjacent rock formation. Such drilling / sampling
can confirm newly -introduced fluids, but only on a point -by -point basis. To perform an effective (ie, extensive)
characterization, numerous boreholes would need to be drilled and at tremendous expense to the permittee.
Because borings have the potential (like drilling operations do) to penetrate otherwise impermeable water -confining
subsurface layers, an expensive multi -boring subsurface characterization carries the added risk of degrading the
integrity of the subsurface environment.
Due to its relatively high cost per single -point sample (ie, boring), Geologic Methods are best
utilized as a confirmatory tool and not an extensive subsurface characterization tool.
In Closing
Without a doubt, the best method is ERT, because it is highly sensitive to the subsurface electrochemical changes
that oil/gas drilling and fracking can create. To be fair, ERT is also adversely impacted by the Earth filter, such that
resolving deep electrochemical changes (due to fracking) is somewhat degraded. However, the impact of high -cut
filtering on ERT is considerably less than the other methods (ie, SEIS reflection) with respect to the detection /
imaging of deep subsurface chemical changes. The physics of ERT (ie, electrical responses) best applies to the
subsurface manmade fracture -fluids scenario.
The current language in the Ordinance (Section 5 j) starts out very well, until the "Approved Methods" are listed.
With the exception of ERT (and possibly SEIS reflection at considerable cost), all of the other methods are
entirely inappropriate! In fact, recommending anything other than ERT would play right into the hands of a
potentially unscrupulous permittee, when the selected unwitting (unqualified) or compromised (money often
buys "experts") geophysical surveyor performs the before -after surveys that yield false negatives (no fractures) and
provides a "professional", third -party "no -impact" interpretation, when in fact the method simply failed to detect
the target features!
At the risk of sounding arrogant, the City Engineer is more than likely unqualified to "determine which methods
should be utilized'', unless s/he is a properly trained and experienced (ie, qualified) geophysicist and/or seeks
guidance from a qualified geophysicist who is familiar with the geophysical surveying methods discussed in this
treatise. As an experienced geophysicist with an advanced degree from a nationally -recognized engineering and
earth sciences school (Colorado School of Mines), I just now feel adequately qualified to address the geophysical
surveying methods discussed herein. Section 5j of the Ordinance should not only remove reference to the City
Engineer (unless adequately qualified) but should define a qualified geophysicist as someone with sufficient
experience with and/or knowledge of those methods discussed herein.
