Resolution - 2018 - 18-28 - Eagle City Council To Vacate A Pond Easement Setback Line - 08/28/2018O\iGI\AL RESOLUTION No. 18-28 A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE A POND EASEMENT SETBACK LINE SHOWN ON LOT 58, BLOCK 1, OF MACE RiVER RANCH SUBDIVISION NO. 4. AS SHOWN ON THE ATTACHMENTS HERETO; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Weston Arnell, Gardner Mace Ranch, L.C., represented by Kristi Watkins of J -U -B Engineers, Inc., requested a vacation of the final plat of Mace River Ranch Subdivision No. 4, to remove the pond easement setback line shown on Lot 58, Block 1 of (Mace River Ranch Subdivision No. 4); and WHEREAS, On July 16, 2018, the Commission recommended approval of the vacation (VAC - 03 -18), to the Council; and WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Idaho Statesman on July 21, 2018, and July 28, 2018; and WHEREAS, On August 14, 2018, the City Council held a public hearing on the proposed vacation (VAC -03-18), and voted to approve the vacation; and WHEREAS, The City Council hereby finds that the proposed vacation complies with the provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of Eagle City Code, "Vacations and Dedications". NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO. The Eagle City Council hereby vacates the pond easement setback line shown on Lot 58, Block 1, of the final plat of Mace River Ranch Subdivision No. 4, as considered, heard and approved by the Council at its August 14, 2018 public hearing for application number VAC -03-18 and as shown on the attachments hereto (Exhibit A). This Resolution shall be in full force and effect immediately upon its adoption and approval. ADOPTED by the Council of the City of Eagle, Idaho, this 28th day of August, 2018.
