RESOLUTION No. 18-26
A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE THE FIVE-FOOT WIDE
PRESSURIZED IRRIGATION AND DRAINAGE EASEMENT LOCATED ADJACENT TO THE
NORTH PROPERTY LINE OF LOT 30, BLOCK 1, KESTREL COVE SUBDIVISION. AS SHOWN
ON THE ATTACHMENTS HERETO; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Core Building Co., represented by Ward Schwider, requested a vacation of the final
plat of Kestrel Cove Subdivision to remove the five-foot wide pressurized irrigation and drainage easement
shown adjacent to the north property line on Lot 30, Block 1 of (Kestrel Cove Subdivision); and
WHEREAS, On January 2, 2017, the Commission recommended approval of the vacation (VAC -
06 -17), to the Council; and
WHEREAS, Legal notice of the request for vacation was sent by certified mail to all property
owners within 300 -feet of the subject property on January 11, 2018; and
WHEREAS, On February 13, 2018, the City Council held a public hearing on the proposed
vacation (VAC -06-17), and voted to approve the vacation; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of
Eagle City Code, "Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, IDAHO.
The Eagle City Council hereby vacates the five-foot wide pressurized irrigation and drainage
easement shown adjacent to the north property line of Lot 30, Block 1, of the final plat of Kestrel Cove
Subdivision, as considered, heard and approved by the Council at its February 13, 2018 public hearing for
application number VAC -06-17 and as shown on the attachments hereto (Exhibit A).
This Resolution shall be in full force and effect immediately upon its adoption and approval.
ADOPTED by the Council of the City of Eagle, Idaho, this 28th day of August, 2018.
