RESOLUTION No. 18-25
A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE THE 35 -FOOT WIDE
LANDSCAPE AND IRRIGATION EASEMENT LOCATED ADJACENT TO THE REAR PROPERTY
LINE ON LOT 4, BLOCK 6, CARLENE ESTATES SUBDIVISION. AS SHOWN ON THE
ATTACHMENTS HERETO; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Robin Rissell, represented by John Bottles, requested a vacation of the final plat of
Carlene Estates Subdivision (formerly known as Wedgewood Subdivision) to remove the 35 -foot wide
landscape and irrigation easement shown adjacent to the rear property line on Lot 4, Block 6 of (Carlene
Estates Subdivision); and
WHEREAS, On July 10, 2017, the Commission recommended approval of the vacation (VAC -
03 -17), to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Idaho
Statesman on July 6, 2017, and July 13, 2017; and
WHEREAS, On July 25, 2017, the City Council held a public hearing on the proposed vacation
(VAC -03-17), and voted to approve the vacation; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of
Eagle City Code, "Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, IDAHO.
The Eagle City Council hereby vacates the 35 -foot wide landscape and irrigation easement shown
adjacent to the rear property line of Lot 4, Block 6, of the final plat of Carlene Estates Subdivision, as
considered, heard and approved by the Council at its July 25, 2017, public hearing for application number
VAC -03-17 and as shown on the attachments hereto (Exhibit A).
This Resolution shall be in full force and effect immediately upon its adoption and approval.
ADOPTED by the Council of the City of Eagle, Idaho, this 28th day of August, 2018.
