The following is a summary of Ordinance No. 792, adopted by the City Council of the City of
Eagle, Ada County, Idaho, on June 26, 2018:
AN ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY IDAHO, REPLACING TITLE
8, CHAPTER 3, SECTION 5, PARAGRAPH J, WITH "OIL AND GAS EXTRACTION",
DEFINITION, PURPOSE, ZONING CLASSIFICATION, PERMIT REQUIREMENT, PERMIT
APPLICATION, ISSUANCE OF PERMIT, SITE DESIGN AND INSTALLATION, AND
WAIVER; REPLACING TITLE 8, SECTION 5, PARAGRAPH K, WITH "OIL AND GAS
POST -EXTRACTION", DEFINITION, PURPOSE, ZONING CLASSIFICATION, PERMIT
REQUIREMENT, PERMIT APPLICATION, ISSUANCE OF PERMIT, SITE DESIGN AND
"OFFICIAL SCHEDULE OF DISTRICT REGULATIONS"; PROVIDING A SEVERABILITY
CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
Section 1: Amends Title 8, Chapter 3, Section 5, Paragraph J, Eagle City Code, deleting "Filling,
Grading, Lagooning, Dredging Or Other Earth Moving Activity" and amending to "Oil and Gas
Extraction", relating to the following subcategories: (1) definitions of terms; (2) purpose of
ordinance; (3) zoning classifications of oil and gas well sites; (4) permit requirements; (5) permit
application requirements; (6) issuance of permit process; (7) site design and installation
requirements; and (8) waiver.
Section 2: Amends Title 8, Chapter 3, Section 5, Paragraph K, Eagle City Code, deleting "Gravel
Pits, Rock Quarries, Sand And Clay Pits And Other Natural Resources of Commercial Value" and
amending to "Oil and Gas Post -Extraction", relating to the following subcategories: (1) definitions
of terms; (2) purpose of ordinance; (3) zoning classification of post -extraction facilities; (4) permit
requirements; (5) permit application requirements; (6) site design and installation requirements;
and (7) waiver.
Section 3: Amends Title 8, Chapter 2, Section 3, Eagle City Code, "Official Schedule of District
Regulations", relating to the Land Use Table, and the designation of Oil and Gas Extraction and
Oil and Gas Post -Extraction.
Section 4: Provides for severability.
Section 5: Provides an effective date and for publication by summary.
