Chaparral Rd, Eagle, Idaho To: Mayor Ridgeway and Council members, Over the past week you have received letters from me on behalf of CAIA and Eagle residents thanking you and attorney McClain for adding some requested changes to the ordinance, for which we are very grateful. We also sent proof of Alta Mesa's prolonged resistance to complying with statute and the state's continued failure to enforce those regulations. With that in mind, there are several other important changes which were recommended by both CAIA members and the council that are still missing from the current draft. I respectfully urge that you add those changes as outlined below: P9 7(k) Non-reactive and non -radioactive chemical tracers shall be used in all drilling fluids. * Should read: Nora -radioactive tracing or tagging additives.. unique for each permitted drift site must be added 10 all fluids used for drilling, as well as post -drilling well 'treatme Pts including hydraulic fracturing (aka fracking). The city shall be notified in writing of the formoia identifying such additive(s), so that any negative impacts on water sources (i.e, leaks, contamination of aquifers and surface waterways), can be tnost effectively traced directly to the source. We previously submitted evidence documenting that operators 'frequently Use these types of tracers in their normal drilling and completion processes so there's no reason why they shouldn't be required to use them in order to protect our precious, irreplaceable water aquifers and surface waterways, and to support litigation if/when contamination occurs. To my recollection the council had agreed to add this critical language. P9 15 (c) Setbacks/Location Post -extraction facilities shall not be constructed within: one-half of a mile from a highway one -mile from the property line of an occupied structure, a water well, ditches or canals, an occupied school, hospital/medical facility, or place of worship/assembly 'The one -mile distance is still a concern as it could be construed as prohibitive of development and we therefore ask that you consider either modifying these setbacks to the following distances: One-quarter of a mile from a highway One-half of a mile from the property fine of an occupied structure, a vt ater well. ditches or canals, an occupied school, hospitall'medical facility, or place of worship/assembly *OR that you simply use the same setback restrictions presently Linder 'extraction' (below), for 'post- extraction Pg 8 (c) Setbacks/location Fi Except as provided in I.C. § 47-319, oil and gas wells, tank batteries and gas processing facilities shall not be constructed within one-half of a mile of the property line of an occupied structure, place of worship/asserribly, medical facility/hospital, or school, domestic water well, canal, ditch or the natural or ordinary high-water mark of surface waters or within a one-quarter mile of a highway, iii) Oil and gas wells, 'lank batteries and gas processing facilities may be constructed less than one- half of a mile but more than one-quartel, of a mile from an occupied structure, domestic water well, if the operator has obtained the express written permission from the owner of the occupied structure or domestic water well. Pg 10 (8) and pg 17 (7) Waiver In the case of an application for permit under this section, a waiver from an imposed condition(s) shall be granted if the provision is in operational conflict with Chapter 3, Title 47 of the Idaho Code or the Rules Governing Oil and Gas Conservation or if an imposed condition(s) would actually or operatidna! y prohibit the extract;tin of oil and gas. The applicant will have the burden to shoty there is an actual or operational conflict and the local and state rules cannot be implemented harmoniously. *Remove waiver — on advice from legal counsel that it is redundant, and therefore unnecessary, and that it could potentially make it easier for an operator to sidestep these other protections authorized under LLUPA that we've all worked so hard to put in place. Idaho Statute: TITLE 47 -- 314 (10) To implement the purpose of the oil and gas conservation act and to advance the public interest in the orderly develcoment of the state's oil and eras resources it is Me provicecl that (b) No ordinance resolution repurrernent or standard of a city county or political SUtdivis,on except a state agency with authority, shall actually or operationally prohibit the extraction of oil and gas c - (c) (c) No ordinance. resolution, requirement or standard of a city county or political subdivision except a state agency %vith authority. shall actually or operationally prohibit construction or operation of facOl ties and infrastructure needed for the post -extraction Pg 4 (h) The operator shall provide a copy to the ciy of any incident reports or written complaints submitted to the Department; the Idaho Oil and Gas Conservation Commission, or any other state or federal agency within 15 days after the operator has notice of the existence of such reports or complaints. rOiU!0, L7vMot ter` tinitii r . ., , ,e4,6 Lu (-;Ity . Pg 7 (m) The applicant shall comply with all state and federal air quality regulations. The applicant shall report the receipt of any air quality complaints to the City within 10 days. * should be shorter time frame -- 24 hours (?) Pg 14 (k) The applicant shall comply with all state and federal air and water quality regulations. The applicant shall report the receipt of any air or water quality complaints to the City within 10 dans of receipt. * should be shorter time frame — 2 ;_; ;rs (?) There has been repeated discussion about the need for much shorter reporting timelines for any complaints against operators for air or water quality violations and/or other incidents. We suggest these reports need to be submitted to the city within 24 hours and a mitigation pian proposed to the city and residents within 48 hours of receipt. Brett Smith regrets that he couldn't be here tonight but he asked that I relay his grave concerns about the broadly modified language on Pg 7 (j) regarding ERT baseline testing and that you replace that text with the following very specific language: Pg 7 (j) Subsurface Baseline The applicant, at its own expense, shall provide, prior to drilling. documentation of baseline subsurface testing, conducted by an independent third -party. A subsurface characterization regarding known and potential water -bearing zones (aquifers) must be performed, utilizing noninvasive surface exploration methods that identify groundwater. The best known industry - accepted geophysical method for adequately characterizing fracture -driven chemical changes within a subsurface formation of interest (ie; aquifer) is the Electrical Resistivity Method and more specifically Electrical Resistivity Tomography (ERT). Thro_u_gh site-specific, comprehensive and detailed discussions with a qualified, unconflicted third party geophysicist the City Engineer shall determine which -geophysical method should be utilized.
