Meeting Minutes
June 26, 2018
1. CALL TO ORDER: Mayor Ridgeway calls the meeting to order at 5:30 p.m.
2. ROLL CALL: BASTIAN, GOLD, PITTMAN, MITCHELL. All present. A
quorum is present.
3. PLEDGE OF ALLEGIANCE: Mayor leads the Pledge of Allegiance.
4. PUBLIC COMMENT: NONE
This time is reserved for the public to address their elected officials regarding
concerns or comments they would like to provide to the City Council regarding
subjects not on the agenda. At times, the City Council may seek comments/opinions
regarding specific City matters during this allotted time. This is not the time slot to
give formal testimony on a public hearing matter, or comment on a pending
application or proposal. Out of courtesy for all who wish to speak, the City Council
requests each speaker limit their comments to three (3) minutes.
5. ADDITIONS, DELETIONS OR MODIFICATIONS TO THE AGENDA:
INCLUDING THE CONSENT AGENDA:
A. City Staff requests. None
B. Mayor or City Council requests. Mayor removes Item #6B as he has made some
corrections to the policy.
6. CONSENT AGENDA:
• Consent Agenda items are considered to be routine and are acted on with one
motion. There will be no separate discussion on these items unless the Mayor, a
Councilmember, member of City Staff, or a citizen requests an item to be
removed from the Consent Agenda for discussion. Items removed from the
Consent Agenda will be placed on the Regular Agenda in a sequence determined
by the City Council.
• Any item on the Consent Agenda which contains written Conditions of Approval
from the City of Eagle City Staff, Planning & Zoning Commission, or Design
Review Board shall be adopted as part of the City Council's Consent Agenda

located on the east side of North Meridian Road at the southeast corner of
West Caliper Court and North Meridian Road at 2044 and 2400 North

H. Findings of Fact & Conclusions of Law for CU -02-18 — Church Steeple
Height Exception — Allan Christean, PM: Allan Christean, PM, represented
by Gene Ulmer, AIA, with Gene C. Ulmer Architecture, is requesting
conditional use permit approval for a height exception to 69 -feet for a church
steeple. The 5.24 -acre site is located on the east side of North Lanewood Road
at the northeast corner of North Lanewood Road and West Venetian Drive
within Lanewood Church Subdivision (Lot 1, Block 1). (WEV)
I. Findings of Fact & Conclusions of Law for CU-01-18/PPUD-01-18/PP-02-
18 — Snocivalmie River Subdivision No. 2 Planned Unit Development —
White Sturgeon, LLC: White Sturgeon, LLC, represented by Justin Martin,
is requesting conditional use permit, preliminary development plan, and
preliminary plat approval, for Snoqualmie River Subdivision No. 2, an 81 -lot
(70 -buildable, 11 -common) residential planned unit development. The 29.26 -
acre site is located on the west side of North Palmer Lane approximately
1,125 -feet west of Palmer Lane and approximately 800 -feet south of the
intersection of North Palmer Lane and West Floating Feather Road. (WEV)
Bastian moves to approve the Consent Agenda as presented except for Item #6B
which is being removed from the Consent Agenda. Seconded by Pittman. Bastian:

6B. City of Eagle Memorial Policy: A request for Council to adopt the Memorial Policy.

Bastian moves to approve the City of Eagle Memorial Policy as written except for

13. EXECUTIVE SESSION:
74-206. EXECUTIVE SESSIONS — (1) An executive session at which members of
the public are excluded may be held, but only for the purposes and only in the manner
set forth in this section. The motion to go into executive session shall identify the
specific subsections of this section that authorize the executive session. There shall
be a roll call vote on the motion and the vote shall be recorded in the minutes. An
executive session shall be authorized by a two-thirds (2/3) vote of the governing
body. An executive session may be held:

Public Hearings are legally noticed hearings required by state law. The public
may provide formal- testimony regarding the application or issue before the City
Council. This testimony will become part of the hearing record for that
application or matter.
A. ACTION ITEM. CU -10-15 MOD/PPUD-04-15 MOD – Planned Unit
Development Modification for Eaglefield Commons Subdivision – Peter Harris:
Peter Harris is requesting a planned unit development modification approval to modify
the required setbacks within Eaglefield Commons Subdivision No. 1. The 4.78 -acre site
is located on the north side of W. Escalante Drive approximately 125 -feet west of the
intersection of W. Escalante Drive and N. Linder Road. (WEV)

Patricia Minkiewicz, Deerfield Court, I walked in on this presentation and this is a pretty
tight fit. Discusses car sizes and pickup trucks and the size of the garage. This is just
something that I observed. General discussion.
Ed Raffo, 550 Racing Water Way, I live across the street. Is there any option to make the
houses smaller? We like the idea of people parking behind their home. Is there no
parking on one side of the street? We do want the area to be filled in.

Bastian moves to approve CU -10-15 MOD/PPUD-04-15 MOD — Planned Unit
Development Modification for Eaglefield Commons Subdivision with the following
change in the staff recommendations, P. 4 strike the minimum coverage on the 3rd
one down and strike the 15' front and also have a statement that the homes would
be restricted to single story only, no duplicate elevation shall occur, setbacks shall
not be less than 10' nor more than 15' with variation on the front of the homes.
Discussion. Bastian: that the minimum coverage of front 10' rear 30' side 5' and
street side 10' include only Lots 3, 2, 4, 5, 6, 7, 8, 9. So 2 through 9. Seconded by
Gold. ALL AYES: MOTION CARRIES
B. ACTION ITEM. ZOA-01-18 — Zoning Ordinance Amendment — City of Eagle: An
ordinance of the City of Eagle, Ada County Idaho, replacing Title 8, Chapter 3, Section 5,
Paragraph J, with "Oil and Gas Extraction", Definition, Purpose, Zoning Classification,
Permit Requirement, Permit Application, Issuance of Permit, Site Design and Installation,
and Waiver; replacing Title 8, Section 5, Paragraph K, with "Oil and Gas Post -
Extraction", Definition, Purpose, Zoning Classification, Permit Requirement, Permit
Application, Issuance of Permit, Site Design and Installation, and Waiver; amending Title
8, Chapter 2, Section 3 "Official Schedule of District Regulations"; providing a
severability clause; and providing an effective date.
The City of Eagle is conducting public hearings to consider adopting regulations and
permitting requirements for oil and gas extraction and post -extraction activities within
City limits. This includes emergency preparedness requirements and plans, water quality
monitoring, mitigation and remediation, and other matters related to the health and safety

Over the past week you have received letters from me on behalf of CAIA and Eagle residents
thanking you and attorney McClain for adding some requested changes to the ordinance, for
which we are very grateful.
We also sent proof of Alta Mesa's prolonged resistance to complying with statute and the
state's continued failure to enforce those regulations. With that in mind, there are several
other important changes which were recommended by both CAIA members and the council
that are still missing from the current draft. I respectfully urge that you add those changes as
outlined below:
P9 7(k)
Non-reactive and non -radioactive chemical tracers shall be used in all drilling fluids.

we therefore ask that you consider either modifying these setbacks to the following distances:
One-quarter of a mile from a highway

In the case of an application for permit under this section, a waiver from an imposed condition(s)
shall be granted if the provision is in operational conflict with Chapter 3, Title 47 of the Idaho Code or
the Rules Governing Oil and Gas Conservation or if an imposed condition(s) would actually or
operatidna! y prohibit the extract;tin of oil and gas. The applicant will have the burden to shoty there
is an actual or operational conflict and the local and state rules cannot be implemented
harmoniously.
*Remove waiver — on advice from legal counsel that it is redundant, and therefore unnecessary, and
that it could potentially make it easier for an operator to sidestep these other protections authorized
under LLUPA that we've all worked so hard to put in place.

There has been repeated discussion about the need for much shorter reporting timelines for any
complaints against operators for air or water quality violations and/or other incidents. We suggest
these reports need to be submitted to the city within 24 hours and a mitigation pian proposed to the
city and residents within 48 hours of receipt.
Brett Smith regrets that he couldn't be here tonight but he asked that I relay his grave
concerns about the broadly modified language on Pg 7 (j) regarding ERT baseline testing and
that you replace that text with the following very specific language:
Pg 7 (j) Subsurface Baseline
The applicant, at its own expense, shall provide, prior to drilling. documentation of baseline
subsurface testing, conducted by an independent third -party. A subsurface characterization
regarding known and potential water -bearing zones (aquifers) must be performed, utilizing
noninvasive surface exploration methods that identify groundwater. The best known industry -
accepted geophysical method for adequately characterizing fracture -driven chemical changes within
a subsurface formation of interest (ie; aquifer) is the Electrical Resistivity Method and more
specifically Electrical Resistivity Tomography (ERT).
Thro_u_gh site-specific, comprehensive and detailed discussions with a qualified, unconflicted
third party geophysicist the City Engineer shall determine which -geophysical method
should be utilized.
