FINDINGS OF FACT AND CONCLUSIONS OF LAW
CASE NUMBER DR -16-18
The above -entitled design review application came before the Eagle Design Review Board for their action
on April 26, 2018, May 10, 2018, and May 24, 2018. The Board continued the item to June 14, 2018 and
made their decision at that time. The Eagle Design Review Board having heard and taken oral and written
testimony, and having duly considered the matter, makes the following Findings of Fact and Conclusions
of Law;
FINDINGS OF FACT:
A. PROJECT SUMMARY:
O'Reilly Auto Enterprises, LLC, represented by Tim Uhrik with TAIT, is requesting design review
approval to construct three (3) halo illuminated building wall signs and a monument sign for O'Reilly
Auto Parts. The 1.42 -acre site is located on the north side of West Chinden Boulevard Road
approximately 1,060 -feet east of North Linder Road at 1200 West Chinden Boulevard within Eagle
Island Marketplace (Lot 8, Block 1, Lazy P Subdivision).
B. APPLICATION SUBMITTAL:
The City of Eagle received the application for this item on March 22, 2018.
C. HISTORY OF RELEVANT PREVIOUS ACTIONS:
On February 24, 2009, the Eagle City Council approved a Comprehensive Plan Map and Text
amendment and annexation (once contiguous) and a rezone with development agreement for this site
(CPA -5-08 & A-03-08 & RZ-08-08).
On July 14, 2009, the Eagle City Council approved a design review application for the common area
landscaping for Eagle Island Marketplace, including Fred Meyer and eight (8) multi -tenant
retail/restaurant buildings within Lazy P Subdivision (aka Eagle Island Marketplace) (DR -13-09).
On July 14, 2009, the Eagle City Council approved a design review application for the master sign
plan for Eagle Island Marketplace (DR -14-09).
On November 10, 2010, the Ada County Board of County Commissioners approved a comprehensive
plan amendment, rezone with development agreement, master site plan and preliminary plat for Eagle
Island Marketplace (CPA -05-08, A-03-08, and RZ-08-08).
On November 23, 2010, the Eagle City Council approved Ordinance No. 652 for an annexation and
rezone with development agreement of the property associated with Eagle Island Marketplace.
Ordinance No. 652 also recognized the vested development rights associated with the approved Ada
County preliminary plat application number 201000571-S.
On February 8, 2011, the Eagle City Council approved a final plat application for the Lazy P
Subdivision (FP -01-11).

On April 5, 2012, Eagle City Staff approved a design review sign application to modify the master
sign plan for Eagle Island Marketplace (DR -14-09 MOD).

STAFF ANALYSIS PROVIDED WITHIN THE STAFF REPORT:
A. COMPREHENSIVE PLAN PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING
THIS PROPOSAL:
• Protect and enhance the small town character of the City by requiring signage which is creative
and distinctive, compatible with its surroundings, and an integral component of the style and
character of the building to which it relates.
B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS
PROPOSAL: None.
C. DISCUSSION:
• The applicant is requesting design review approval to construct three (3) halo illuminated building
wall signs and a monument sign for O'Reilly Auto Parts within Eagle Island Marketplace. The
building wall signs are proposed to be located on the north, south, and west building elevations.
The building wall signs are proposed to be constructed of three inch (3") deep fabricated
aluminum reverse pan channel letters, painted white, pegged off the face of the building 1 1/2 -
inches, and halo illuminated with white LED.
The monument sign is proposed to be located within the landscape area located north of the
sidewalk adjacent to Chinden Boulevard. The style, size, colors, etc. all comply with that which is
required within the master sign plan for Eagle Island Marketplace (DR -14-09 MOD). The
O'Reilly Auto Parts font, colors, and logo will be located on a white colored background.
STAFF RECOMMENDATION PROVIDED WITHIN THE REPORT:
Based upon the information provided to staff to date, staff recommends approval with the site specific
conditions of approval and the standard conditions of approval provided within the staff report.
PUBLIC MEETING OF THE BOARD:
A. A meeting to consider the application was held before the Design Review Board on April 26, 2018,
May 10, 2018, and May 24, 2018. The Board continued the item to June 14, 2018, at which time the
Board made their decision.
B. Oral testimony in opposition to the application was presented to the Design Review Board by no one.
C. Oral testimony in favor of the application was presented to the Design Review Board by no one (not
including the applicant/representative).

BOARD DELIBERATION: (Granicus time 45:26)
Upon completion of the applicant's and staff's presentations, the Board discussed during deliberation that:
The Board is in favor of the proposed building wall signs and monument sign.
BOARD RECOMMENDATION:
The Board voted 4 to 0 (Schafer, Baer, and Koci absent) to approve DR -16-18 for a design review
application to construct three (3) halo illuminated building wall signs and a monument sign for O'Reilly
Auto Parts for O'Reilly Auto Enterprises, LLC, with the following staff recommended site specific
conditions of approval and standard conditions of approval.
SITE SPECIFIC CONDITIONS OF APPROVAL:
1. A sign permit is required prior to the installation of any signs on this site.
2. The monument sign shall have a white colored background panel. The applicant may use their font,
colors, and logo on the white background panel.
3. Upon completion of the building wall signs, the monument sign, the required landscaping, the
applicant shall be required to request a site inspection to be completed by the Planning and Zoning
Department. Upon verification that the building wall signs, monument sign, and landscaping have
been completed in compliance with the approved plans, a certificate of completion will be issued.
NOTE: In the event a Standard Condition of Approval conflicts with a Site Specific Condition of
Approval contained herein the Site Specific Condition of Approval shall control.
STANDARD CONDITIONS OF APPROVAL:
1. A building permit/zoning permit shall be required prior to construction of any sign which is not
attached to a building with an active building permit.
2. Approval shall expire without notice to the applicant on the date of expiration of this Design Review,
as stipulated in Eagle City Code (one year from approval date).
3. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable
County, State and Federal Codes and Regulations shall be complied with. All design and construction
shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the City
Council.
4. New plans which incorporate any required changes shall be submitted for staff approval. Staff may
elect to take those plans to the Design Review Board and the City Council for review and approval.
5. Any changes to the plans and specifications upon which this approval is based, other than those
required by the above conditions, will require submittal of an application for modification and
approval of that application prior to commencing any change.
6. Any change by the applicant in the planned use of the property which is the subject of this application,
shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory
and legal restrictions in force at the time the applicant or its successors in interest advises the City of
Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said
requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is
sought.
7. Any modification of the approved design review plans must be approved prior to
construction/installation of such changes. Failure to do so may result in the requirement to modify the
project to comply with the approved design review and/or result in the inability to issue a certificate of
completion for this project.

CONCLUSIONS OF LAW:
1. The Board reviewed the particular facts and circumstances of this proposed design review application
(DR -16-18) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review
Overlay District, and based upon the information provided with the conditions required herein,
concludes that the proposed design review application is in accordance with the Eagle City Code and
the Eagle Comprehensive Plan.
2. The Board reviewed the particular facts and circumstances of the proposed design review in terms of
Eagle City Code 8-2A-13(B)(2)(i), and has concluded:
i. The building wall and monument signage will be required to be harmonious with the architectural
design of the existing signs throughout the Eagle Island Marketplace and will not cover nor detract
from desirable architectural features.
