RESOLUTION No. 18-15
A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE THE 40 -FOOT WIDE SETBACK
LINE SHOWN ADJACENT TO THE WEST PROPERTY LINE OF LOT 12, BLOCK 1, PICCADILLY
VILLAGE SUBDIVISION AS SHOWN ON THE ATTACHMENTS HERETO; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Old Town, LLC, requested a vacation to the final plat of Piccadilly Village
Subdivision to remove the 40 -foot wide setback line shown adjacent to the west property line of Lot 12,
Block 1 (Piccadilly Village Subdivision); and
WHEREAS, On April 16, 2018, the Commission recommended approval of the vacation (VAC -
01 -18), to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Idaho
Statesman on April 19, 2018, and April 26, 2018; and
WHEREAS, On May 8, 2018, the City Council held a public hearing on the proposed vacation
(VAC -01-18), and voted to approve the vacation; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of
Eagle City Code, "Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, IDAHO.
The Eagle City Council hereby vacates the 40 -foot wide setback line shown adjacent to the west
property line of Lot 12, Block 1, of the final plat of Piccadilly Village Subdivision, as considered, heard
and approved by the Council at its May 8, 2018, public hearing for application number VAC -01-18 and as
shown on the attachments hereto (Exhibit A).
This Resolution shall be in full force and effect immediately upon its adoption and approval.
ADOPTED by the Council of the City of Eagle, Idaho, this 22nd day of May, 2018.
