Resolution - 2018 - 18-19 - Land Use Fee Schedule Update - 06/12/2018RESOLUTION NO. 18-19 A RESOLUTION AMENDING THE EAGLE PLANNING FEE AND DEPOSIT SCHEDULE (RESOLUTION 17-21) IN ACCORDANCE WITH EAGLE CITY CODE SECTION 1-7-4 AND UPDATING THE TITLE OF THE FEE SCHEDULE FOR CITY FEES; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, this resolution and the attached Eagle Planning Fee & Deposit Schedule do not increase the fee or amounts from previous Resolution No. 17-21, rather, it amends the language to split out the fee for waivers to allow waivers for accessory structure setbacks to not be charged the legal fee deposit; and WHEREAS, the City Council may approve the amendment of fees without a public hearing as such amendment is not a fee increase in excess of five percent (5%) of the amount of the fee last collected and is not an amendment imposing a new fee previously not collected by the City; and WHEREAS, the City Council has determined that good cause exists for updating the Eagle Planning Fee and Deposit Schedule and the title of Fee Schedule for City Fees; NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF EAGLE, Ada County, Idaho: Section 1: That the 2017 Eagle Planning Fee & Deposit Schedule attached hereto as Exhibit A and incorporated herein by this reference, is hereby approved with changes shown with underline text to be added and changes shown with strike -through text to be deleted; and Section 2: That the 2017 Fee Schedule for City Fees attached hereto as Exhibit B and incorporated herein by reference, is hereby approved with a title change to "2018 Fee Schedule for City Fees", with no other changes made; and Section 3: That the Mayor and City Council are hereby authorized to execute said schedules for and on behalf of the City of Eagle; and Section 3: That this resolution shall be in full force and effect immediately upon its adoption and approval.
