Findings - DR - 2018 - DR-19-0 MOD - Modification To The Master Sign Plan For Castlebury West Business Park No. 1, Include Monument Sign For St. Als Medical GroupBEFORE THE EAGLE DESIGN REVIEW BOARD IN THE MATTER OF AN APPLICATION FOR A DESIGN REVIEW FOR A MODIFICATION TO THE MASTER SIGN PLAN FOR CASTLEBURY WEST BUSINESS PARK NO. 1, INCLUDING A MONUMENT SIGN FOR SAINT ALPHONSUS MEDICAL GROUP FINDINGS OF FACT AND CONCLUSIONS OF LAW CASE NUMBER DR -19-09 MOD The above -entitled design review application came before the Eagle Design Review Board for their action on April 26, 2018. The Eagle Design Review Board having heard and taken oral and written testimony, and having duly considered the matter, makes the following Findings of Fact and Conclusions of Law; FINDINGS OF FACT: A. PROJECT SUMMARY: St. Alphonsus Medical Group, represented by Virginia Cunningham with Golden West Signs, is requesting design review approval to modify the master sign plan for Castlebury West Business Park No. 1, including a monument sign for Saint Alphonsus Medical Group. The site is located on the northwest corner of Chinden Boulevard and Meridian Road within Castlebury West Business Park No. 1 (Lot 4, Block 1). B. APPLICATION SUBMITTAL: The City of Eagle received the application for this item on March 22, 2018. C. HISTORY OF RELEVANT PREVIOUS ACTIONS: On April 10, 2007, the Eagle City Council approved an annexation and rezone from RUT (Rural Urban Transition) to MU -DA (Mixed Use with a development agreement), and preliminary plat for Castlebury West Business Park (A-19-06/RZ-25-06 & PP -19-06). On July 24, 2007, the Eagle City Council approved the common area landscaping within Castlebury West Business Park (DR -29-07). On August 28, 2007, the Eagle City Council approved the final plat for Castlebury West Business Park No. 1 (FP -08-07). On October 16, 2007, the Eagle City Council approved a medical office for Oasis Medical (DR -53- 07). On March 13, 2008, the Eagle City Council approved the final plat for Castlebury West Business Park No. 2 (FP -01-08). On April 8, 2008, the Eagle City Council approved a dental office for Castlebury Dental (DR -07-08). On July 29, 2009, the Eagle City Council approved a master sign plan for Castlebury West Business Park, including signage for Oasis Medical Center and Castlebury Dental (DR -19-09). On January 8, 2014, the City approved to change the name on the building and monument sign from Oasis Urgent Care to Saint Alphonsus Medical Group (DR -70-13). COMPREHENSIVE PLAN PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: • Protect and enhance the small town character of the City by requiring signage which is creative and distinctive, compatible with its surroundings, and an integral component of the style and character of the building to which it relates. B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: • Eagle City Code Section 8 -2A -2(B) The general theme of the Design Review Overlay District is to specify desirable building and landscape architectural styles and materials to create a sustainable and pleasing environment for residents and visitors alike. The architectural designs, materials, and graphics set forth in this article are complied to create a theme unique to the area called "Eagle Architecture". • Eagle City Code Section 8 -2A -6(A)(4) Signage for any project shall provide for business identification and minimize clutter and confusion on and off the site. a. The "overall sign concept" for multi -tenant business centers to assure that it addresses the continuity between tenant sign design and building design; b. The provision for effective and necessary business identification systems adapted to the building design; d. The continued maintenance of signs throughout their life; and e. The size, location, design, color, texture, lighting, landscaping, and hours of operations of all permanent signs and outdoor advertising structures or features to ensure that any such proposals do not detract from the function of, or design of, buildings, structures, surrounding properties, neighborhoods, or streets. • Eagle City Code Section 8 -2A -8(B): Definitions ANIMATED SIGN: Any sign which is designed and constructed to give its message through a sequence or progressive changes or parts or lights or degree of lighting, such as an electronic reader board. AUTOMATED SIGN: A sign with a fixed or changing display capable of displaying words, symbols, figures or images composed of, a series of light emitting elements or moving panels or parts; including, but not limited to: tripaneled, digital, electronic message boards, light emitting diodes (LED) signs or signs that in any other way move or create the illusion of movement. This definition does not include signs with copy that is manually changed. FACE OF SIGN: The surface of the sign area upon, against or through which the message is displayed or illustrated. HEIGHT OF SIGN: The vertical distance measured from the grade to the highest point of a sign or any vertical projection thereof. Architectural elements used above any sign area may be excluded from the maximum height measurement if the city determines that said architectural elements add to the character of the sign and do not create an overbearing appearance in relation to the sign, building and area. ILLUMINATION, HALO: Illumination of a sign from a light source that is not visible and is concealed or contained within the sign or located between the sign and the structure/wall. Illumination from the source of the light becomes visible in darkness when the light is reflected off of the wall/structure upon which the sign is attached. ILLUMINATION, PUNCH THROUGH LETTER: A sign with letters, logos or other sign graphics that are opaque (no light is permitted to shine through them), that are attached to a sign cabinet or structure that allows light to shine through it. The distance between the letters, logos, or other sign graphics and the background (surface of the cabinet or structure) is a maximum of one- half inch (1/2"). The light source is concealed within the cabinet or structure and is not visible except that illumination from the light source shines though transparent (nonopaque) background material for no more than one-fourth inch (1/4") around the letters, logo, and other graphics, creating a halo effect. MASTER SIGN PLAN: A plan designed to show the relationship of signs for any cluster of buildings intended for business occupancy, or any single building containing more than one business or any arrangement of business buildings or shops which constitute a visual entity as a whole. These include developments such as shopping centers, mini -malls, business parks, and multi -tenant commercial, office or industrial buildings housing four (4) or more businesses. Additionally, a master sign plan may be submitted for a single business if the owner chooses to submit an application for a master sign plan for said business. MONUMENT SIGN: A freestanding sign with a solid base, including rock signs, or with supports that are designed to be structurally similar to the sign construction, and which incorporate architectural features which complement the sign construction. Pole type supports are not permitted for monument signs, unless enclosed within the monument sign structure. Page 4 of 13 K:\Planning Dept\Eagle Applications\Dr\2009\DR-19-09 MOD Casdehury Bu, Park MSP drl.doc SIGN AREA: The entire area within a single, contiguous perimeter enclosing the extreme limits of writing, representation, logo, emblem or any figure or similar character, together with any form or other material or color forming an integral part of the display, or used to differentiate such sign area from the background against which it is placed. The sign area shall not include the necessary supports or uprights on which the sign is placed, and superficial, nonilluminated column covers, ornamental trim and other such incidental objects attached thereto, or portions of the sign structure which are not designed to convey a message. • Eagle City Code Section 8 -2A -8(C)(2): Monument Signs: a. For single -tenant buildings which are not within the DDA, TDA, or within a "shopping center", monument signs shall not exceed eight feet (8') in height and the sign area shall not exceed sixty (60) square feet per side. • Eagle City Code Section 8 -2A -8(C)(8): Automated Signs: a. Automated signs may be permitted as a part of a monument sign and shall be prohibited in all other types of signs if the city determines the following: (1) The lighting shall be harmonious with and in accordance with the general objectives, or with any specific objective of this article; (2) The lighting shall be installed, operated, and maintained to be harmonious and appropriate in appearance with the existing and intended character of the general vicinity and will not change the essential character of the same area; and (3) The lighting will not be disturbing to existing or future neighboring uses. (Ord. 665, 2-14- 2012) c. All automated signs that utilize light to create change may change frame content through dissolve, fade or scroll features only. No sign shall be operated in a manner which the sign, sign structure, design or pictorial segment of the sign shows full animation, growing, flashing, rotating content, or otherwise creating an illusion of movement, except for single color text only message displays scrolling or traveling across the sign area. (Ord. 665, 2-14-2012) d. The signs shall only change frame content not more than once every eight (8) seconds. The change of content must change immediately within a period of less than one second. (Ord. 756, 8-23-2016) e. Based on brightness measured in nit (an illuminative brightness measurement equivalent to 1 candle per square meter measured perpendicular to the rays of the source); automated signs that utilize light to change frames shall contain an autodimmer allowing for no more than five thousand two hundred (5,200) nit illumination between sunrise and sunset and up to three hundred (300) nit illumination between sunset and sunrise. f. The automated sign portion of any sign should be constructed into the sign in a manner in which it is subordinate to the overall design of the sign. The automated sign portion of any sign shall not exceed twenty percent (20%) of the face of any sign. g. Where more than one sign is allowed only one sign may contain an automated sign. • Eagle City Code Section 8 -2A -8(C)(13) Sign Illumination: a. The city must find that any illuminated sign permitted under the specific regulations within this article is designed such that brightness levels are controlled to assure a soft, subtle effective light in accordance with other city regulations intended to create and maintain the Eagle architecture theme, while encouraging energy efficient lighting. Illumination types, styles, and practices not listed herein shall be prohibited unless otherwise deemed by the design review board and city council to be consistent with the Eagle architecture theme. c. Floodlighting is permitted only through the use of incandescent, LED and high pressure sodium light sources. d. Exposed neon is permitted when used to create the sign letter(s) or as an architectural element as part of the sign design. A clear covering may be permitted for protection of the neon element. e. Halo illumination is permitted. f. Metal halide is not permitted as a light source for signage. g. All types of internal illumination is prohibited, except for automated signs and drive- through/drive-up service menu board signs as regulated in this article. • Eagle City Code Section 8 -2A -8(C)(15): Master Sign Plan: The master sign plan may be approved by the city with elements that require suspension or relaxation of the height, area, number of signs, or locations of signs specified within this article if the design review board finds that extraordinary conditions exist which allow suspension or relaxation, but that any suspension or relaxation will still meet the intent of this article and: a. The development site contains unique or unusual physical conditions such as topography, proportion, size or relation to a public street that would limit or restrict normal sign visibility; or b. The proposed or existing development exhibits unique characteristics of land use, architectural style, site location, physical scale, historical interest or other distinguishing features that justify variation from conventional development; or c. The proposed signage incorporates special design features such as logos, emblems, murals, statuaries or similar architectural elements that are designed in a manner determined by the city to be architecturally compatible to the sign and area. (Ord. 756, 8-23-2016) C. DISCUSSION: • The applicant is proposing to modify the master sign plan for Castlebury West Business Park to modify the Saint Alphonsus Medical Group monument sign. The applicant is proposing to remove an existing monument sign (noted as sign "C" below) and replace it with the proposed Saint Alphonsus Medical Group monument sign. The proposed monument sign is constructed of fabricated metal painted metallic silver with a cultured stone base. Pursuant to the approved Castlebury West Business Park master sign plan (DR -19-09), there are currently three (3) existing monument signs located adjacent to Chinden Boulevard. Monument sign "A" below was approved to be ten -feet, nine inches (10' 9") tall and contains three (3) tenant panels. Monument sign "B" below was approved to be eight -feet (8') tall and contains two (2) tenant panels. Monument sign "C" below was approved to be eight -feet (8') tall and is a single -tenant sign. In addition, all three (3) monument signs were designed to complement the buildings located within the business park and the surrounding residential neighborhood. Additionally, the existing monuments signs complement the architecture of the existing buildings and each other. The proposed monument sign would not complement the buildings nor the other monument signs. Eagle City Code Section 8-2A-6(A)(4)(e) states that size, location, design, color, texture, lighting, landscaping of all permanent signage shall not detract from the function of, or design of, buildings, structures, surrounding properties, neighborhoods, or streets. To achieve a recommendation of approval, the applicant should provide revised monument sign elevations showing the addition of stone, earth tone colors, etc., to complement the existing monument signs. The revised monument sign elevations should be reviewed and approved by the Design Review Board and City Council prior to the issuance of a sign permit. • The proposed monument sign is 12 -feet tall and the face of the sign is 63 -square feet. Eagle City Code Section 8 -2A -8(C)(2) requires single tenant building monument signs to be a maximum of 8 - feet tall and the face of the sign to be 60 -square feet. In addition to changes to the appearance of the sign, the applicant should be required to provide a revised sign elevation showing the monument sign at a maximum height of 8 -feet and the face of the sign to be a maximum of 60 - square feet. The revised sign elevation should be reviewed and approved the Design Review Board and City Council prior to the issuance of a sign permit. The total sign area proposed on the monument sign is 63 -square feet. The percentage of sign area for the electronic message center is 22%. Eagle City Code Section 8-2A-8(C)(8)(f) allows automated signs to be a maximum of 20% of the face of the sign. The applicant should be required to provide a revised monument sign elevation showing the automated sign with an area of 12 -square feet (20% of the 60 -square foot maximum sign area allowed). The revised monument sign elevation should be reviewed and approved by the Design Review Board and City Council prior to the issuance of a sign permit. • Staff recommends the following changes to the "Castlebury West Business Park Master Sign Plan," with strike through text to be deleted and underlined text to be added so as to be in compliance with Eagle City Code. Castlebury West Business Park Master Sign Plan 09 This criterion has been established for the mutual benefit for all tenants. Conformance will be strictly enforced and any non -conforming or unapproved signs must be removed or brought into conformance at the expense of the tenant. A. GENERAL APPROVAL REQUIREMENTS 1. Every owner of any proposed building within Castlebury West Business Park shall be required to submit signage plans to the subdivisions managing entity for written approval. A design review sign application, accompanied by the written approval of the managing entity, shall be submitted to the City for any proposed signs for City review and approval. All signs shall be in compliance with the criteria stated herein as well as Eagle City Code. In cases of any conflict between Eagle City Code and the criteria specified herein, the more restrictive requirements shall apply. 2. Each building within the Castlebury West Business Park will be required to have a design review sign application submitted with the approval of the building elevations. 3. All permits for tenant's signs and their installation shall be obtained by tenant or his representative and shall conform to all local building and electrical codes as well as the criteria set forth hereafter. 4. All tenant signs shall be designed, constructed and installed at tenant's expense. 5. No exposed conduit, brackets, fasteners or wiring of any type will be permitted. No raceways will be permitted. 6. All signs shall meet Underwriters Laboratories and National Electrical code requirements. B. NUMBER, LOCATION, DESIGN AND CONSTRUCTION OF SIGNS: 1. Subdivision Monument Sign a) One single face entry monument signs shall be allowed at the northwest corner of Chinden Boulevard and Meridian Road (see Sign D). b) The monument sign will be 7' high with a sign area of 48 -square feet (approximately). Multi -tenant Monument Signs a) Two double faced, multi -tenant monument signs shall be allowed along Chinden Boulevard and shall be spaced a minimum of 50 -feet away from entry signs (see Signs BA & GB). b) Sign B will be 8' high with a maximum sign area of 50 -square feet. Sign GA will be 10' 9" high with a maximum sign area of 72 -square feet. Either halo illumination, push through with premium opaque vinyl faces, or ground mounted light fixtures shall be used to illuminate the monument signs. c) These multi -tenant monument signs will be used by the tenants located in the buildings within Castlebury West Business Park (see Signs B -A & GB). Tenant shall receive written approval from the subdivisions managing entity. d) The background color of all tenant panels shall be a textured finish Beige in color. e) Tenants are permitted to use their font on the monument sign. If non illuminated letters are to be used all tenants shall use 1/2" thick routed letters. If halo illuminated letters are to be used all tenant shall use 2 — 3" deep letters. If push through letters are to be used the maximum acrylic depth that may extend beyond the face of the background is 1". Push through letters shall be acrylic or Alex -glass letters. shall have a maximum width of the exposed acrvlic/plexi-glass of/a", premium opaque vinyl is required on the face of anv push through letters or logos. and no intermediate vinyl is permitted. f) A sign permit accompanied by written approval from the subdivisions managing entity shall be submitted to the City, reviewed and approved by staff prior to any signs being placed on the multi -tenant monument signs. 3. Saint Alphonsus Medical Group Monument Sign a) One double face monument sign is allowed for Saint Alphonsus Medical Group, to be located along Chinden Boulevard. b) Sign will be -1-28' high with a maximum sign area of 6360 -square feet. Monument sign will be illuminated by LED with both 1/2" routed push through letters and halo illuminated letters. 4. Automated Sign Criteria: a) Automated signs are permitted if the city determines the following: (1) The lighting shall be harmonious with and in accordance with the general objectives, or with any specific objective of this article: (2) The lighting shall be installed. operated. and maintained to be harmonious and appropriate in appearance with the existing and intended character of the general vicinity and will not change the essential character of the same area: and (3) The lighting will not be disturbing to existing or future neighboring uses. If the Design Review Board/City Council approves this application, staff recommends the site specific conditions of approval and the standard conditions of approval provided within the staff report. PUBLIC MEETING OF THE BOARD: A. A meeting to consider the application was held before the Design Review Board on April 26, 2018, at which time the Board made their decision. B. Oral testimony in opposition to the application was presented to the Design Review Board by no one. C. Oral testimony in favor of the application was presented to the Design Review Board by no one (not including the applicant/representative). Page 11 of 13 K:\Planning Dept \Eagle Applications Di2009\DR-19-09 MOD Castlebury West Bus Park MSP &Edo': BOARD DELIBERATION: (Granicus time 12:29) Upon completion of the applicant's and staff's presentations, the Board discussed during deliberation that: • The Board does not support the proposed monument sign height of 12 -feet because: a) The sign is not consistent with the surrounding signs. b) Eagle City Code Section 8-2A-8(C)(2)(a) states a monument sign for a single -tenant building shall not exceed 8 -feet in height. • The Board does not support the proposed design of the monument sign because: a) The sign does not complement the existing monument signs or buildings in the vicinity. • The Board discussed and suggested that the sign be redesigned with materials and colors that complement the other two existing signs. BOARD RECOMMENDATION: The Board voted 6 to 0 (Grubb absent) to deny DR -19-09 MOD for a design review application for a modification of the master sign plan for Castlebury West Business Park No. 1, including a monument sign for Saint Alphonsus Medical Group. See items 2a -c and 3i under conclusions of law for explanation of the decision. CONCLUSIONS OF LAW: 1. The Board reviewed the particular facts and circumstances of this proposed design review application (DR -19-09 MOD) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review Overlay District, and based upon the information provided with the conditions required herein, concludes that the proposed design review application is not in accordance with the Eagle City Code and the Eagle Comprehensive Plan. 2. The Board reviewed the particular facts and circumstances of the proposed design review in terms of Eagle City Code Section 8 -2A -8(c)(15), and has concluded: a. The sign location does not contain unique or unusual physical conditions such as topography, proportion, size or relation to a public street that would limit or restrict normal sign visibility; b. The existing business park development and signs do not exhibit unique characteristics of land use, architectural style, site location, physical scale, historical interest or other distinguishing features that justify variation from the size requirements identified in Eagle City Code; and c. The proposed monument sign does not incorporate special design features such as logos, emblems, murals, statuaries or similar architectural elements that are designed in a manner determined by the City to be architecturally compatible with the other two (2) existing signs and existing buildings. 3. The Board reviewed the particular facts and circumstances of the proposed design review in terms of Eagle City Code 8-2A-13(B)(2)(i), and has concluded: i. The monument sign is not harmonious with the architectural design of the existing signs and buildings within Castlebury West Business Park and detracts from the desirable architectural features of the buildings.
