PARTIES
THIS TEMPORARY COOPERATIVE AGREEMENT ("Temporary Agreement") is
made and entered into this 411-4_ __ day of APR/ _ , 2018, by and
between the IDAHO TRANSPORTATION DEPARTMENT, hereafter called the STATE,
and the CITY OF EAGLE, hereafter called the CITY.
PURPOSE
The STATE grants the CITY temporary access to the property as indicated in Exhibit A
for reconstruction of the Boise River bank. Access to the pedestrian path was granted in a
Cooperative Agreement dated January 20, 2004. This Temporary Agreement will end when
reconstruction is completed, which is expected to be on or about S T ~ . / tcl
Authority for this Agreement is established by Section 40-317 of the Idaho Code.
The Parties agree as follows:
SECTION I. That the STATE will:
1. Upon execution of this agreement by both parties, allow access to STATE property
as indicated on Exhibit A for reconstruction of the Boise River bank.
SECTION II. That the CITY will:
1. Hire a Contractor for reconstruction of the Boise River Bank according to the
attached drawings shown as Exhibit B, and per permits granted by the Corps of
Engineers and Idaho Department of Water Resources and/or other applicable
regulations. Reconstruction shall be perfornied as identified on Exhibit B, page 3 of
4, as a white line or indicated as "White Line".
2. Coordinate with adjacent landowners for access to the site and staging areas. No
access will be permitted from SH -44 Eagle Alternate Route.
3. Not hold the STATE liable for improvements or personal property owned and/or
stored by CITY, its agents or assigns, on land covered by this Temporary Agreement.
CITY agrees to defend, save and hold harmless regardless of outcome STATE from
any claim whatsoever arising out of use and occupancy of land covered by this
Temporary Agreement. Satisfactory proof of insurance as required by Idaho Code
Section 6-901, et seq. will be provided to STATE by CITY as of the effective date of
the Agreement.
4. Not make any improvements to the Property not shown on Exhibit A without prior
written consent of STATE.
5. Provide the STATE "As Built" plans of any engineered river "barbs" ,if constructed,
no later than one week after completion of the work.
IN WITNESS WI•IEREOF, the STATE and CITY have executed this Agreement as of the day
and year first written.

Installation of riprap and backfill to repair a river embankment and redaim lost area, removal of damaged
asphalt, and preparation for rebuilding a section of public greenbelt, to a Higher construction standard, and to be paved
later.
Embankment Repair
Install backfill, geotextile and riprap as indicated below in Figure 6 and 7.
1. Riprap area:452 running feet from the trail tread level to the toe of the river. Riprap layer estimated
to be 4020SF.
2. Estimated to be approximately 402CY of total fill with an average bank angle of approximately
.75:1_
3. Backfill material: Toad mix with low fine content. Fines should be 3-5%.
4. Geotextilefabric under riprap -- non -woven fabric meeting ITD Standard Specification for Type II
riprap geotextile. (See ITD Standards for highway construction, subsection 718.06)
5. Riprap material: 6" to 24" riprap.
6. The tree in the center of Figure 6 (see white X) must be removed Om to bank repair.
