Minutes - 2018 - City Council - 02/27/2018 - RegularEAGLE CITY COUNCIL Meeting Minutes February 27, 2018 1. CALL TO ORDER: Mayor Ridgeway calls the meeting to order at 5:30 p.m. 2. ROLL CALL: BASTIAN, GOLD, PITTMAN, MITCHELL. All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: Mayor leads the Pledge of Allegiance. 4. PUBLIC COMMENT: None This time is reserved for the public to address their elected officials regarding concerns or comments they would like to provide to the City Council regarding subjects not on the agenda. At times, the City Council may seek comments/opinions regarding specific City matters during this allotted time. This is not the time slot to give formal testimony on a public hearing matter, or comment on a pending application or proposal. Out of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3) minutes. 5. REPORT: A. Stephen Hunt, Valley Regional Transit Principal Planner, to present ValleyConnect 2.0. Mayor introduces the issue. Stephen Hunt, VRT Principal Planner, displays a power point presentation and provides Council an overview of ValleyConnect 2.0. General discussion. 6. ADDITIONS, DELETIONS OR MODIFICATIONS TO THE AGENDA: INCLUDING THE CONSENT AGENDA: A. City Staff requests. None B. Mayor or City Council requests. Pittman removes Item #7G & #K from the Consent Agenda. Bastian removes Item #7E from the Consent Agenda. Gold adds Hefty EnergyBag Program to the Agenda under Item #8B Mayor: are there any objections to adding the Hefty EnergyBag Program to the Agenda under #8B? Seeing none. 7. CONSENT AGENDA: • Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Mayor, a Councilmember, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Appointment to the Eagle Arts Commission: In accordance with Resolution 17- 34, Mayor Ridgeway is requesting Council confirmation of the appointment of Vicki Walch to the Commission. Ms. Walch will be filling a vacant term that will expire February 2019. (SR) C. DR -36-17 — Common Area Landscaping within Feldspar Subdivision — Eagle Single Family. LLC: Eagle Single Family, LLC, represented by John Rennison with Rennison Companies, is requesting design review approval of the common area landscaping within Feldspar Subdivision. The 3.44 -acre site is located on the east side of North Taylor Street approximately 950 -feet north of the intersection of West State Street and North Taylor Street at 368 North Taylor Street. DR -18-98 MOD — Change of Use from Childcare (Daycare center)/School (private) to Office (business and professional), Including Modifications to the Exterior Building Elevations, Landscaping, and the Construction of an Additional Parking Area — Dennis Baker: Dennis Baker, represented by James Marsh with CSHQA, is requesting design review approval to change the use of the building from Childcare (Daycare center)/School (private) to Office (business and professional). The applicant is also requesting approval to modify the exterior building elevations, landscaping, and to construct an additional parking area. LLC: Endurance Holdings, LLC, represented by Kent Brown, is requesting a one (1) year extension of time for the final plat approval for Cedarfield Subdivision No. 2, a 34 -lot (32 buildable, 2 common) residential subdivision. The 7.32 -acre site is located at the southwest corner of North Echohawk Way and East Sadie Drive. (WEV) J. Findings of Fact & Conclusions of Law for PP/FP-03-17 — Piccadilly Village Subdivision No. 2 — Old Town I. LLC: Old Town I, LLC, represented by Mark L. Butler, is requesting combined preliminary/final plat approval for Piccadilly Village Subdivision No. 2, a 3 -lot commercial subdivision (re -subdivision Lot 14, Block 1, Piccadilly Village Subdivision). Enclosure Art Wrap Artist Agreement: Authorizing the Mayor to enter into an agreement with one (1) artist to create artwork to be placed on the glass recycle bin enclosure. The artist will receive $2,500 compensation for their artwork. (SR) Mayor introduces the issue. Pittman: Under DR -59-17, Item #7G, I would like to add a Conditions of Approval under Item #5, it is a new Condition of Approval and here is what I propose: "provide a revised fence and gate detailing showing the inclusion of a latching mechanism to assure the gates remain in a full open position 180 degrees from closed when open. The revised gate and fence shall detail shall be approved and reviewed by staff and two members of the Design Review Board prior to installation of the fence. General discussion. Seconded by Bastian. Pittman: I will be voting to approve the Findings and Facts and Conclusions of Law CU -10-17 because of agree with what they accurately reflect from the record of the Council's Public Hearing on February 13, 2018. I would like to clarify though that I did not vote to approve the application because I believe the building is to tall but with that said the Findings do accurately reflect my vote and therefore I plan to vote to approve them. I would like to have a roll call vote. General discussion. Pittman: I would like to make that motion to approve the Findings of Fact & Conclusions of Law as presented under the Consent Agenda. LLC: Ultimate Seven, represented by Kyle Cooper, is requesting design review approval to modify the building elevations of a multi -tenant retail/restaurant building to remove the trellis structure over the outdoor patio area on the east building elevation. The 2.08 -acre site is located on the northwest corner of Chinden Boulevard and South Bergman Way at 4363 West Gray Fox Street in Reynard Commercial Subdivision. (WEV) Mayor introduces the issue. Bastian moves to approve DR -61-16 MOD — Modification to the Multi -Tenant Retail/Restaurant Building Elevations—Ultimate Seven, LLC but the modification include the trellis as approved by the Design Review Committee. ALL AYES: MOTION CARRIES B. Hefty EnergyBag Program. Mayor introduces the issue and provides an overview of the program and asks the Council for their approval for him to communicate and sign a confidentiality agreement with the City of Boise. General discussion. Pittman moves for the Eagle City Mayor Ridgeway to have the opportunity to speak to Boise and sign a confidentiality agreement so that we can get the actual costs and details regarding the new recycling plan. Seconded by Gold. Discussion. Pittman: I will authorize the Mayor to sign the confidentiality agreement so we can get this figured out. Seconded by Mitchell. ALL AYES: MOTION CARRIES Further general discussion. 9. PUBLIC HEARINGS: Public hearings will not begin prior to 6:00 p.m. Public Hearings are legally noticed hearings required by state law. The public may provide formal- testimony regarding the application or issue before the City Council. This testimony will become part of the hearing record for that application or matter. A. A-02-17/RZ-05-17/CU-12-17/PPUD-06-17/PP-06-17 — Brookwav Subdivision — Trilogv Idaho: Trilogy Idaho, represented by Kent Brown, is requesting an annexation, rezone from RUT (Residential -Urban Transition — Ada County designation) to R -2 -DA -P (Residential with a development agreement — PUD), conditional use permit, preliminary development plan, and preliminary plat approvals for Brookway Subdivision, a 122 -lot (105 -buildable, 17 -common) residential planned unit development. The 61.34 -acre site is generally located on the west side of North Lanewood Road, approximately 1/2—mile north of the intersection of North Lanewood Road and West Floating Feather Road. Mayor opens the Public Hearing Patricia Minkiewicz, Deer Court, I'm confused, isn't the Planning and Zoning supposed to present their presentation? Mayor responds that the PZ gave their presentation. Patricia: this subdivision is to high density. The Comp Plan doesn't seem to include this type of subdivision. This is a bad precedent to be set. Our schools are already overcrowded. I see nothing positive about this at all. The area leading up to Beacon Light was not supposed to have this type of development, a country setting. I'm wondering what size the lots are. I'm appalled at this; West Eagle doesn't want to look like this. General discussion. Mayor: if anyone wants to testify on this issue, please come forward. ALL AYES: MOTION CARRIES 10. NEW BUSINESS: A. Introduction of draft ordinance language to provide for the regulation of oil and gas extraction and post -extraction. (CDM) Mayor introduces the issue and discusses the comments received from the public and the draft ordinance. We live in Eagle, we are with you and not against you. Discusses the difference between the Fruitland ordinance and the City's draft ordinance. A public hearing will be scheduled in April. There will also be a public hearing before the Planning and Zoning Commission. City Attorney McLain: another Attorney in our office is the City of Attorney for Fruitland. There will be two public hearings on this draft ordinance. This is a draft and I look forward to comments and suggestions from the Mayor and Council. Discusses and provides some comments on draft ordinance. Discusses the definitions in the draft ordinance. We will look at all ordinances of other jurisdictions. Johnathan Seel, 2896 Haven Drive, we live in the Area of Impact and if I understand it this Ordinance only applies to the City of Eagle and not the Area of Impact. Discussion on the vapor recovery, setbacks, fencing, lighting and the testing of wells. The City needs to be involved in the testing of wells. Thank you for your consideration. The water testing needs to be done by a third party independent source. I love the ideas that you have on the recycling. Discusses have a green bin for recycling. General discussion. Chaparral Drive, thank you to all of you, the definitions were not included and I think they should be included in the ordinance. Discusses Fruitland's draft ordinance. Discusses the positive changes that the Council made to the draft ordinance. You are really making intelligent and thoughtful decisions on this, thank you. Judy Echnow, 4150 W. Fulton Drive, tonight I am submitting Petitions for the Safety and Health of Eagle Residents. Gives the petitions to the City Clerk. Robert Sheppard, 368 S. Golden Eagle Lane, you have exceeded my expectations tonight. Discusses vertical vs. horizontal drilling. We can't have horizontal drilling in residential areas. Jane Rolling, 582 Palmetto Drive, I may greatly encouraged by the Mayor and City Council's comments and protecting our community. There is nothing about training for our first responders and I think the industry should have to pay for that. Discusses the ordinance only applying to the City of Eagle. Laurie Argabrite, 2463 E. Heathfield Court, I have traveled all over the country and I have seen the devastation that this has caused. There is urgency in getting this ordinance adopted. Discusses Avimor being annexed into the City of Eagle and the impact on the air quality. Shelly Brock, discusses the Fruitland Council meeting where it was discussed that if a city's ordinance imposes more stringent requirements than the county, then the city's measure would take precedent in the impact area of that city. 12. REPORTS: A. Mayor and Council Reports: Pittman reports on the PPDC meeting. Gold and Bastian reports on the URA's open house on March 6`h B. Page 9 1: .000NCIUMINUTES Temporary Minutes Work Area•CC-02-27-18min.doc e"`C- x-02 `7 MEMORANDUM To: City Council From: Mayor's Office Date: February 27, 2018 Re: Hefty EnergyBag Program The City of Boise has extended the opportunity for the City of Eagle to join in the Hefty EnergyBag Program (Orange Bag Program). This program would allow citizens who reside within City limits to continue to recycle plastics number 3-7. The City of Boise is unable to convey costs due to confidentiality clauses between Boise and Hefty. Should Eagle and Boise enter into a confidentiality agreement, the exact costs will be made available to Mayor and Council. The Mayor is requesting Council direction, via motion, on one of the following manners. 1. Direct staff to pursue a memorandum of agreement with the City of Boise and designating a maximum dollar limit that Council would be willing for the City of Eagle to accept in said agreement. 2. No Council action on this item will result in current service levels rejecting plastics #3-7 to remain the same.
