The above -entitled design review application came before the Eagle City Council for their action on January
23, 2018. The Eagle City Council having heard and taken oral and written testimony, and having duly
considered the matter, makes the following Findings of Fact and Conclusions of Law;
FINDINGS OF FACT:
A. PROJECT SUMMARY:
Dennis Baker and Associates, represented by Jim Nemeth with Idaho Electric Signs, Inc., is
requesting design review approval to modify the master sign plan for a multi -tenant
retail/restaurant/office building. The 1.08 -acre site is located on the southwest corner of South Eagle
Road and West Inlet Bay Lane at 600 South Rivershore Lane within Channel Center Subdivision.
B. APPLICATION SUBMITTAL:
The City of Eagle received the application for this item on November 9, 2017.
C. HISTORY OF RELEVANT PREVIOUS ACTIONS:
On May 5, 1997, the Eagle Planning and Zoning Commission approved a design review application
for a multi -tenant building (DR -08-97).
On December 11, 1997, the Eagle Design Review Board approved a design review application for a
master sign plan for a multi -tenant building (DR -31-97).

STAFF ANALYSIS PROVIDED WITHIN THE STAFF REPORT:
A. COMPREHENSIVE PLAN PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING
THIS PROPOSAL:
• Protect and enhance the small town character of the City by requiring signage which is creative and
distinctive, compatible with its surroundings, and an integral component of the style and character
of the building to which it relates.
B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS
PROPOSAL:
• Eagle City Code Section 8 -2A -2(B)
The general theme of the Design Review Overlay District is to specify desirable building and
landscape architectural styles and materials to create a sustainable and pleasing environment for
residents and visitors alike. The architectural designs, materials, and graphics set forth in this article
are compiled to create a theme unique to the area called "Eagle Architecture".
• Eagle City Code Section 8 -2A -6(A)(4)
Signage for any project shall provide for business identification and minimize clutter and confusion
on and off the site.
a. The "overall sign concept" for multi -tenant business centers to assure that it addresses the
continuity between tenant sign design and building design;
b. The reduction of hazards to motorists, bicyclists and pedestrians as may be caused by or
partially attributable to the distraction and obstruction of improperly located and designed
signs;
c. The provision for effective and necessary business identification systems adapted to the
building design;
d. The continued maintenance of signs throughout their life; and
e. The size, location, design, color, texture, lighting, landscaping, and hours of operations of all
permanent signs and outdoor advertising structures or features to ensure that any such
proposals do not detract from the function of, or design of, buildings, structures, surrounding
properties, neighborhoods, or streets.
• Eagle City Code Section 8 -2A -8(A)(3)
Architectural Compatibility: The number, area, and height of signs as outlined in this article are
intended to be maximum standards which do not necessarily ensure architectural compatibility.
Therefore, in addition to the enumerated maximum standards, the city shall give consideration to a
sign's relationship to the overall appearance of the subject property as well as the surrounding area.
• Eagle City Code Section 8 -2A -8(A)(4)
Materials And Appearance: It is the intent of this article to encourage interesting, creative, readable,
effective, uncluttered, and well maintained signage. Sign materials and appearance shall be
complementary to the building architecture and colors. The exhibits provided in the EASD book
are examples of the types of sign designs envisioned for the Eagle architecture theme.

AUTOMATED SIGN: A sign with a fixed or changing display capable of displaying words,
symbols, figures or images composed of, a series of light emitting elements or moving panels or
parts; including, but not limited to: tripaneled, digital, electronic message boards, light emitting
diodes (LED) signs or signs that in any other way move or create the illusion of movement. This
definition does not include signs with copy that is manually changed.
• Eagle City Code Section 8-2A-8(C)(2)(b)
For multi -tenant buildings which are not within the DDA, TDA, or within a "shopping center",
monument signs shall not exceed fifteen feet (15') in height and the sign area shall not exceed one
hundred forty (140) square feet per side.
• Eagle City Code Section 8 -2A -8(C)(8) Automated Signs:
a. Automated signs may be permitted as a part of a monument sign and shall be prohibited in all
other types of signs if the city determines the following:
(1) The lighting shall be harmonious with and in accordance with the general objectives, or with
any specific objective of this article;
(2) The lighting shall be installed, operated, and maintained to be harmonious and appropriate
in appearance with the existing and intended character of the general vicinity and will not
change the essential character of the same area; and
(3) The lighting will not be disturbing to existing or future neighboring uses.
b. Automated signs shall be prohibited in the downtown development area (DDA), the transitional
development area (TDA), and the community entry development area (CEDA).
c. All automated signs that utilize light to create change may change frame content through
dissolve, fade or scroll features only. No sign shall be operated in a manner which the sign,
sign structure, design or pictorial segment of the sign shows full animation, growing, flashing,
rotating content, or otherwise creating an illusion of movement, except for single color text
only message displays scrolling or traveling across the sign area.
d. The signs shall only change frame content not more than once every eight (8) seconds. The
change of content must change immediately within a period of less than one second.
e. Based on brightness measured in nit (an illuminative brightness measurement equivalent to 1
candle per square meter measured perpendicular to the rays of the source); automated signs
that utilize light to change frames shall contain an autodimmer allowing for no more than five
thousand two hundred (5,200) nit illumination between sunrise and sunset and up to three
hundred (300) nit illumination between sunset and sunrise.
f. The automated sign portion of any sign should be constructed into the sign in a manner in
which it is subordinate to the overall design of the sign. The automated sign portion of any sign
shall not exceed twenty percent (20%) of the face of any sign.
g. Where more than one sign is allowed only one sign may contain an automated sign.
h. The addition of an automated sign to any nonconforming sign is prohibited.
i. Any conforming existing sign or portion of a conforming existing sign that is refaced with an
automated sign shall require a design review approval.
• Eagle City Code Section 8 -2A -8(C)(13) Sign Illumination:
a. The city must find that any illuminated sign permitted under the specific regulations within this
article is designed such that brightness levels are controlled to assure a soft, subtle effective

light in accordance with other city regulations intended to create and maintain the Eagle
architecture theme, while encouraging energy efficient lighting.
b. Illumination types, styles, and practices not listed herein shall be prohibited unless otherwise
deemed by the design review board and city council to be consistent with the Eagle architecture
theme.
c. Floodlighting is permitted only through the use of incandescent, LED and high pressure sodium
light sources.
d. Exposed neon is permitted when used to create the sign letter(s) or as an architectural element
as part of the sign design. A clear covering may be permitted for protection of the neon element.
e. Halo illumination is permitted.
f. Metal halide is not permitted as a light source for signage.
g. All types of internal illumination is prohibited, except for automated signs and drive-
through/drive-up service menu board signs as regulated in this article.
• Eagle City Code Section 8 -2A -8(C)(15 Master Sign Plan:
A "master sign plan", as defined by this article, shall be required to be submitted to the city for
review and approval. The purpose of a master sign plan is to coordinate signs, and create a plan
that establishes a building or site's overall sign design. The master sign plan shall show sign colors,
styles and locations of buildings, maximum size, illumination, and materials to be used.
The master sign plan may be approved by the city with elements that require suspension or
relaxation of the height, area, number of signs, or locations of signs specified within this article if
the design review board finds that extraordinary conditions exist which allow suspension or
relaxation, but that any suspension or relaxation will still meet the intent of this article and:
a. The development site contains unique or unusual physical conditions such as topography,
proportion, size or relation to a public street that would limit or restrict normal sign visibility;
or
b. The proposed or existing development exhibits unique characteristics of land use, architectural
style, site location, physical scale, historical interest or other distinguishing features that justify
variation from conventional development; or
c. The proposed signage incorporates special design features such as logos, emblems, murals,
statuaries or similar architectural elements that are designed in a manner determined by the city
to be architecturally compatible to the sign and area.
C. DISCUSSION:
• On December 11, 1997, the Eagle Design Review Board approved a design review application for
a master sign plan for a multi -tenant retail building located at 600 South Rivershore Lane (DR -31-
97). The applicant is requesting design review approval to modify the master sign plan criteria to
allow the installation of an automated sign, to modify the tenant panel background colors and
update the colors on the monument sign. They are also requesting approval to permit corner
businesses to have two building wall signs.
• The existing colors and design of the monument sign complement the colors and design of the
building. The green roof, green trim and cream on the columns match the green accent color and
columns on the building. The red panel behind the clock matches the red used on the body of the
building. The applicant is requesting approval to repaint the body of the sign and columns with
colors that will complement the colors used on the monument sign located at 775 South Rivershore
Lane. The clock will be removed and replaced with a dimensional metal panel painted to

complement the new colors proposed on the monument sign. The background color of all tenant
panels will be dark blue and the font and logos of all tenant signage will be white. Pursuant to
Eagle City Code, the materials and appearance shall be complementary to the building architecture
and colors. Staff defers comment regarding the proposed colors to the Design Review Board.
• The applicant is requesting approval to install an automated sign as part of the modifications
proposed to this monument sign. The automated sign is 17% of the face of the monument sign.
Pursuant to Eagle City Code, automated signs shall not exceed 20% of the face of the monument
sign. Additionally, automated signs may be permitted as part of a monument sign if the city
determines the following:
(1) The lighting shall be harmonious with and in accordance with the general objectives, or with
any specific objective of this article;
(2) The lighting shall be installed, operated, and maintained to be harmonious and appropriate
in appearance with the existing and intended character of the general vicinity and will not
change the essential character of the same area; and
(3) The lighting will not be disturbing to existing or future neighboring uses.
Staff defers comment regarding the automated sign to the Design Review Board.
The side view of the monument sign shows the automated sign to be five inches (5") deep and
mounted flush to the face of the monument sign. The applicant should be required to provide a
revised elevation plan showing the face of the automated sign to be flush with the face of the
monument sign or to project a maximum of one inch (1") from the face of the monument sign. The
revised elevation plan should be reviewed and approved by staff and two (2) members of the Design
Review Board prior to the issuance of a sign permit.
• Staff recommends the following changes to the "Master Sign Plan for 600 South Rivershore Lane"

A. General Approval Requirements:
1. Every tenant of the proposed building within 600 Rivershore Lane shall be required to submit
signage plans to the managing entity for written approval. A design review sign application,
accompanied by the written approval by the managing entity, shall be submitted to the City
for any proposed signs for City review and approval. All signs shall follow the criteria stated
herein as well as Eagle City Code. In cases of any conflict between Eagle City Code and the
criteria specified herein, the more restrictive requirements shall apply.
2. Each Tenant within the North Channel Center will be required to have a design review sign
application submitted for the approval of all building wall signs and monument sign panels.
3. All permits for tenant's signs and their installation shall be obtained by tenant or his
representative and shall conform to all local building and electrical codes as well as criteria
set forth hereafter.
4. All tenant signs shall be designed, constructed and installed at tenant's expense. Tenant shall
submit to the owner for approval before fabrication a copy of the proposed sign showing logo
colors, layout, lettering, and graphics.
5. No exposed conduit, brackets, fasteners, or wiring of any type will be permitted. No raceways
will be permitted.

6. All Signs shall meet Underwriter Laboratories and National Electrical Code requirements.

b) The monument sign will be approximately 15' tall with approximately 100-sauare feet of
approx. sign area of 70 Sq. ft which includes the automated sign.
c) The monument sign will be externally illuminated by 70 -watt high pressure sodium
ground mounted light fixtures (one on each side of the sign).
d) The multi -tenant sign monument sign will be used by the tenants located in this the

mounted flush to the face of the building. Materials may consist of cast metal, aluminum,
plastic, high density foam, or acrylic primed and painted. No internal illumination of any
halo illumination, or and exposed illuminated signs are
permitted .
c) The building signs shall be dimensionally stable (20" " Lmaximum height) as represented
on the building elevations. Signs shall be centered top to bottom and side to side on the
designated sign band. Corner business locations will be permitted to have a sign on two
building elevations.

4. Freehanging Signboards (Exhibit B)
a) Under canopy signs are permitted in the size and design as illustrated on the elevation
plans in Exhibit B with a minimum distance of 7'6" clearance in the walkway.
5. Temporary Signage:
a) Temporary signs and banners advertising special events or grand openings are permitted
on a limited basis subject to Owner's approval and must comply with the current City
Ordinance.
C. Miscellaneous Requirements:
1. Tenant shall be permitted to place upon the main entrance of its premises not more than 144
square inches of white lettering not to exceed two inches in height indicating the hours of
operation, emergency telephone numbers, and/or the name of the business. Tenant may
install on the front entrance, if required by the U.S. Post Office, the numbers only for the
street address in allocation approved by the Owner. This shall be uniform as a part of the
building.
2. In the event Tenant has a non -customer door for receiving merchandise only, Tenant's name
may be uniformly applied on said door in a location as directed by the owner. When more
than one tenant uses the same door, each name may be applied.
3. Tenant shall, at the termination of the lease, remove Tenant's sign and repair any damaged
area and restore the building to its original condition when Tenant's sign was erected. This
work to be performed at Tenant's expense.

Based upon the information provided to staff to date, staff recommends approval with the site specific
conditions of approval and the standard conditions of approval provided within the staff report.

BOARD DELIBERATION: (Granicus time 1:03:31)
Upon completion of the applicant's and staff's presentations, the Board discussed during deliberation that:
• The Board affirms the addition of the automated sign and colors to be used on the tenant panels and the
monument sign structure.
• The face of the automated sign and the tenant panels shall be flush with each other.
• The horizontal and vertical space between the tenant panels shall align with the horizontal and vertical
space around the automated sign.
• The modification to the master sign plan is an opportunity to add dimension to the tenant panel signs.
• The relief that is created by the brick, columns, gable feature, and roof element provides visual interest
and relief to the face of the monument sign.
BOARD DECISION:
The Board voted 5 to 1 (Grubb against, Germano absent) to recommend approval of DR -31-97 MOD for
a design review application to modify the master sign plan for a multi -tenant retail/restaurant/office
building for Dennis Baker and Associates, with the following staff recommended site specific conditions
of approval and standard conditions of approval provided within their findings of fact and conclusions of
law document, dated January 11, 2018.
PUBLIC MEETING OF THE COUNCIL:
A. A meeting to consider the application was held before the City Council on January 23, 2018, at which
time the Council made their decision.
B. Oral testimony in opposition to the application was presented to the City Council by no one.
C. Oral testimony in favor of the application was presented to the City Council by no one (not including
the applicant/representative).
COUNCIL DECISION:
The Council voted 3 to 0 (Pittman abstained) to approve DR -31-97 MOD for a design review application
to modify the master sign plan for a multi -tenant retail/restaurant/office building for Dennis Baker and
Associates, with the following Design Review Board recommended site specific conditions of approval
and standard conditions of approval.
SITE SPECIFIC CONDITIONS OF APPROVAL:
1. Provide a revised elevation plan showing the face of the tenant panels and the automated sign to be
flush with each other when viewed from the side. The revised elevation plan shall be reviewed and
approved by staff and two (2) members of the Design Review Board prior to the issuance of a sign
permit.
2. The following document titled "Master Sign Plan for 600 South Rivershore Lane", shall be the master
sign plan criteria for this building.

d) The multi -tenant monument sign will be used by the tenants located in this building.
e) The background color of all tenant panels shall be dark blue (220-397) background and white
copy and/or white logo.
f) One Tenant panel of the monument sign will be available for each business. Design and
wording are subject to the Owner's approval.
3. Building Wall Signs (Exhibit A)
a) Gooseneck light fixtures used to illuminate any signage shall be screened or located so they
do not shine onto any roadway or any nearby property.
b) Wall signs are to be dimensional from a minimum of to maximum of 8" in depth and
mounted flush to the face of the building. Materials may consist of cast metal, aluminum,
plastic, high density foam, or acrylic primed and painted. No internal illumination, halo
illumination, or exposed illuminated signs are permitted.
c) The building signs shall be dimensionally stable (20" maximum height) as represented on the
building elevations. Signs shall be centered top to bottom and side to side on the designated
sign band. Corner business locations will be permitted to have a sign on two building
elevations.
4. Freehanging Signboards (Exhibit B)
a) Under canopy signs are permitted in the size and design as illustrated on the elevation plans
with a minimum distance of 7'6" clearance in the walkway.
5. Temporary Signage:
a) Temporary signs and banners advertising special events or grand openings are permitted on a
limited basis subject to Owner's approval and must comply with the current City Ordinance.
C. Miscellaneous Requirements:
1. Tenant shall be permitted to place upon the main entrance of its premises not more than 144
square inches of white lettering not to exceed two inches in height indicating the hours of
operation, emergency telephone numbers, and/or the name of the business. Tenant may install
on the front entrance, if required by the U.S. Post Office, the numbers only for the street address
in allocation approved by the Owner. This shall be uniform as a part of the building.
2. In the event Tenant has a non -customer door for receiving merchandise only, Tenant's name
may be uniformly applied on said door in a location as directed by the owner. When more than
one tenant uses the same door, each name may be applied.
3. Tenant shall, at the termination of the lease, remove Tenant's sign and repair any damaged area
and restore the building to its original condition when Tenant's sign was erected. This work to be
performed at Tenant's expense.
3. A sign permit is required prior to the installation of any signs on this site.
4. Upon completion of the monument signs, the applicant shall request a site inspection to be completed
by the Planning and Zoning Department. Upon verification that the monument signs have been
completed in compliance with the approved plans, a certificate of completion will be issued.
5. Provide a revised elevation plan showing the horizontal and vertical space between the tenant panels to
be in alignment and consistent with the horizontal and vertical space around the automated sign. The
revised elevation plan shall be reviewed and approved by staff and one member of the Design Review
Board prior to the issuance of a sign permit.

NOTE: In the event a Standard Condition of Approval conflicts with a Site Specific Condition of
Approval contained herein the Site Specific Condition of Approval shall control.
STANDARD CONDITIONS OF APPROVAL:
1. The applicant shall comply with all requirements of the Ada County Highway District and/or the Idaho
Transportation Department, including but not limited to approval of the drainage system, curbs, gutters,
streets and sidewalks. A letter of approval from the highway district having jurisdiction shall A
building permit/zoning permit shall be required prior to construction of any sign which is not
attached to a building with an active building permit.
2. Approval shall expire without notice to the applicant on the date of expiration of this Design Review,
as stipulated in Eagle City Code (one year from approval date).
3. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable
County, State and Federal Codes and Regulations shall be complied with. All design and construction
shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the City
Council.
4. New plans which incorporate any required changes shall be submitted for staff approval. Staff may
elect to take those plans to the Design Review Board and the City Council for review and approval.
5. Any changes to the plans and specifications upon which this approval is based, other than those required
by the above conditions, will require submittal of an application for modification and approval of that
application prior to commencing any change.
6. Any change by the applicant in the planned use of the property which is the subject of this application,
shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory
and legal restrictions in force at the time the applicant or its successors in interest advises the City of
Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said
requirements or other legal relief is granted pursuant to the law in effect at the time the change in use
is sought.
7. Any modification of the approved design review plans must be approved prior to
construction/installation of such changes. Failure to do so may result in the requirement to modify the
project to comply with the approved design review and/or result in the inability to issue a certificate of
completion for this project.
CONCLUSIONS OF LAW:
1. The Council reviewed the particular facts and circumstances of this proposed design review application
(DR -31-97 MOD) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review
Overlay District, and based upon the information provided with the conditions required herein,
concludes that the proposed design review application is in accordance with the Eagle City Code and
the Eagle Comprehensive Plan.
2. The Council reviewed the particular facts and circumstances of the proposed design review in terms of
Eagle City Code 8-2A-8(C)(8)(a)(1-3), and has concluded:
(1) The lighting will be harmonious with and in accordance with the general objectives, and with any
specific objective of this article;
(2) The lighting will be installed, operated, and maintained to be harmonious and appropriate in
appearance with the existing and intended character of the general vicinity and will not change
the essential character of the same area; and
(3) The lighting will not be disturbing to existing or future neighboring uses.
3. The Council reviewed the particular facts and circumstances of the proposed design review in terms of

Eagle City Code 8-2A-13(B)(2)(i), and has concluded:
i. The monument signs and building wall signs will be required to be harmonious with the architectural
design of the existing signs throughout the development, and will not cover or detract from desirable
architectural features.
