Minutes - 2017 - City Council - 10/24/2017 - RegularEAGLE CITY COUNCIL Meeting Minutes October 24, 2017 INVOCATION 1. CALL TO ORDER: Mayor Ridgeway calls the meeting to order at 5:30 p.m. 2. ROLL CALL: KUNZ, BASTIAN, PRESTON, SOELBERG. Preston is absent. A quorum is present. Preston calls in at 6:00 p.m. for the Public Hearing. 3. PLEDGE OF ALLEGIANCE: Mayor Ridgeway leads the Pledge of Allegiance. 4. PUBLIC COMMENT: This time is reserved for the public to address their elected officials regarding concerns or comments they would like to provide to the City Council regarding subjects not on the agenda. At times, the City Council may seek comments/opinions regarding specific City matters during this allotted time. This is not the time slot to give formal testimony on a public hearing matter, or comment on a pending application or proposal. Out of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3) minutes., Judy Dahl, 735 N. Echo Hawk Way, I have one concern. I would like to see a wider distribution of notifications of developments and decisions. You need to find a way of getting opinions from everyone. I don't feel everyone is being represented. Discusses when the notifications should be put in place. General discussion. Sue Carney, 1887 N. Groveland Place, it is hard for us to keep up with everything and understand the process. We need to control growth and have it reflect the surrounding area. We all moved here for the feeling of a small and rural town. How is ACHD and ITD involved? General discussion. Ryan Kuhns, 1461 W. Floating Feather, this is a question for you Mayor: you said we will grow until it's built out? What does that mean to you? General discussion. Judy Dahl, I would like to propose that we establish an ordinance in regards to high density apartments, that they be redone every five years so that we can keep them from becoming slums. Discusses a renovation ordinance. Jim Webber, 284 Mango Drive, I moved here to have a country environment. Discusses the traffic. We came to have a rural less population place. I'm also concerned about water issues in the future. Heidi Hill, 1461 Fox Point Place, I'm concerned about the traffic for personal reasons. We had a daughter that was injured on Floating Feather. Roads need to be expanded before you put all of these homes in. What are we going to do with the traffic? General discussion. (?) Allen, 1036 Covey Run Court, I wanted to follow up on the last comment. I know you don't have control over ACHD but I have lived in cities when growth is preventive before the roads are built. You can't control the roads but you can control the neighborhoods. Jack Fieselamam, 264 Mango Drive, I wanted to talk about the growth at Eagle and Beacon Light Road. Mayor: that is on our agenda tonight and this will be discussed later. Tom York, 703 N. Foady Place, I'm impressed with the amount of interest that is represented this evening. I sent a letter early and made a request that a moratorium be established. Mayor: you are talking about an agenda item. Further discussion. 5. ADDITIONS, DELETIONS OR MODIFICATIONS TO THE AGENDA INCLUDING THE CONSENT AGENDA: A. City Staff requests. None B. Mayor or City Council requests. None. Kunz I have spoken to PZ Administrator Vaughan and there are a couple of minor corrections on some agenda items. 6. CONSENT AGENDA: • Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Mayor, a Councilmember, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the City Council. • Any item on the Consent Agenda which contains written Conditions of Approval from the City of Eagle City Staff, Planning & Zoning Commission, or Design Review Board shall be adopted as part of the City Council's Consent Agenda approval motion unless specifically stated otherwise. Commemoration of World War One Proclamation: Eagle Chapter, Daughters of the American Revolution and the David Thompson Society, Children of the American Revolution have partnered with the United States World War One Centennial Commission to commemorate the 100th Anniversary of the Great War that spanned from July 28, 1914 through November 11, 1918. (SR) C. Minutes of the October 10, 2017 City Council meeting. (SKB) D. Findings of Fact and Conclusions of Law for AA-05-17/DR-33-17 — Applicant Appeal of the Design Review Board's Decision regarding DR -33-17 (Common Area Landscaping, Nine Apartment Buildings, and Clubhouse within Heron's Edge Mixed Use Community) — Heron Family Trust: Heron Family Trust, represented by Mark Butler with Land Consultants, Inc., is appealing the Design Review Board's decision regarding the above referenced matter for the reasons specified in their appeal application, date stamped by the city on September 1, 2017 (attached hereto). The 9.34 - acre site is located on the northeast corner of the intersection of South Edgewood Lane and East State Street approximately 60 -feet north of East State Street. (WEV) E. DR -44-17 — Common Area Landscaping within Snopualmie Falls Subdivision No. 10 — Brahma. LLC: Brahma LLC, represented by Jesse Buster with Stack Rock Group, is requesting design review approval of the common area landscaping within Snoqualmie Falls Subdivision No. 10. Additionally, the applicant is requesting approval to relocate the required playground equipment required within this phase to Snoqualmie Falls Subdivision No. 4. The 72 -acre site is located on the east of Palmer Lane and south side of Nordic Drive. (WEV) G. DR -45-17 — Subdivision Sign and Entry Feature for Legacy Development — Brahma, LLC: Brahma, LLC, represented by Jesse Buster with Stack Rock Group, is requesting design review approval to construct a subdivision sign and entry feature for the Legacy development. The subdivision sign and entry feature is located on the northeast corner of Palmer Lane and Nordic Drive. (WEV) H. DR -06-15 MODS — Modification to the Common Area Landscaping within Snopualmie Falls Subdivision No. 9 — Brahma, LLC: Brahma LLC, represented by Jesse Buster with Stack Rock Group, is requesting design review approval to modify the landscaping within Snoqualmie Falls Subdivision No. 9. The 39.83 -acre site is generally located south of Floating Feather Road and east of Palmer Lane, at the terminus of West Nordic Drive. (WEV) I. WA -06-17 — Schneider Fence Waiver — Dylan and Erika Schneider: Dylan and Erika Schneider are requesting City Council approval of a waiver to allow the placement of a six foot (6') tall decorative cedar fence within the front yard area of the property located approximately 1/4 -mile east of Eagle Road at 470 E. Floating Feather Road. (WEV) J. DR -39-17 — Common Area Landscaping within Lonesome Dove Subdivision No. 2 — Zach Evans Construction: Zach Evans Construction, represented by Robert Powell, is requesting design review approval of the common area landscaping within Lonesome Dove Subdivision No. 2. The 4.36 -acre site is located at the southeast and southwest corners of East Riverside Drive and South Lone Brook Way. (WEV) K. FP -17-17 — Final Plat for Lonesome Dove Subdivision No. 2 — Zach Evans Construction: Zach Evans Construction, represented by Bryan Appleby with Rennison Engineering, is requesting final plat approval for Lonesome Dove Subdivision No. 2, a 74 -lot (63 -buildable, 11 -common) residential subdivision (re -subdivision Lot 1, Block 1, and Lot 1, Block 2, Lonesome Dove Subdivision). CPA -02-17 — Eagle is HOME Comprehensive Plan Update — City of Eagle: The City of Eagle is requesting the adoption of the Eagle is HOME Plan, an update and replacement to the City of Eagle 2015 Comprehensive Plan, pursuant to Idaho Code §67- 6509. (NBS) This item was continued from the October 10, 2017, City Council meeting. Mayor introduces the issue. The Mayor and Councilman Soelberg makes opening statements. Planner Baird -Spencer displays a power point presentation that the Mayor presents. General Council discussion. Mayor opens the Public Hearing Ian Burnett, 1417 N. Foresto Bello Way, discusses the changes to the Middle School Planning Area. I have invested over a $1M in my property. Discusses the density in the current and former comp plan. Discusses the Chase property. Leave the Middle School Planning Area as it is. Kathy Bennett, 1581 N. Foresto Bello Way, we are against the change in the Comp Plan from the 2015 comp plan. Discusses the Middle School Planning Area and the current density. We moved to Eagle because we liked the rural area. Discusses the development in Eagle, her surrounding area and housing density. Ryan Kuhns, 725 W. Floating Feather, we are here to help you help us. We are asking you to help us keep the community that we love. I discussed with the Planning and Zoning when I moved here what was going to be planned for across the street from me. We want to keep it what it was. There is one piece left in the Middle School Planning Area and let's finish the area out as it was meant to be. Rich Brower, 485 W. Floating Feather Road, I watched the last meeting online. I appreciate all of the time you have put into this. I agree with everything that Mr. Kuhns has stated. I would like for you to put off the vote until the next Council is put in place. Discusses the Chase property development. Ken Baker, 2102 N. Canter Place, we moved here for the same reasons everyone else came. I reiterate everything that has been said so far. Discusses the consequences of growth. We only have so many natural resources so control the growth. Ron Henry, 1458 N. Foresto Bello, I am a builder and have built 40 houses in Eagle. I am currently building in Legacy. I have seen a lot of different things in the building in Eagle. Discusses the Chase Property and the density. I am not in favor of higher density. The objection we have is specifically to the Middle Schools area. Hal Bunderson, 582 River Heights Drive, the staff has been very responsive and they have extended themselves. I own 15 acres east of town and it is designated as Residential Estates. Discusses the change of usage to this property. We would like to have this incorporated into the City of Eagle. Harmony Stahl, Elko Nevada, I came to talk to you about a piece of property that my father inherited several years ago. The current designation is a Business Park and we would like to see the designation to Mixed Used. We have not had any offers to purchase the property and we think that is because of the land designation. This land is prime for development. I am hoping that you will change our designation so it can become developed. Randy Limani, Arthur Berry and Co., I am here to support the previous speaker. We have not had any interest in the property because of the land use designation. With a new use designation, we can market this property with a well-planned mixed use. We have support from the neighbors for specialty retail. Cindy Greco, 8452 Bernado Trails Court, San Diego California, we own the 27 acre property that you have just heard about. Discusses the land zoning in the area. In 15 years, we have never had any interest in this property with the current land use designation. We have lost out on many sales. Discusses mixed use on their property. General discussion. Stan Cole, 108 West Main, Boise, I support what Cindy just mentioned. We would like to see the property as Mixed Used so it can be developed properly. Jack Fieselman, 267 Mango Drive, I have been a resident here for 25 years. Discusses the traffic in their area. Everyone cuts through our neighborhood and we have a lot of concern about this traffic. Discusses the traffic on Stierman and State Street. We are opposed to more congestion. We would ask you to look at this. Paul Werner, 928 Oceano Bello, I believe in the former testimony on the density in the Middle School Planning Area. Discusses the development of the Chase Property. I would encourage that a park be included in the triangle area and there would also be a trail connection to the City of Boise. Eagle needs to have more parks and trails it makes the City more livable Laren Walker, 301 Meadow Ridge Lane, I appreciate all that you are doing. I am here to support the comments that have made about the Chase Property and Middle School Planning Area. We have lived in Eagle for 21 years. Discusses the density in this area. Tom York, 703 N. Foady Place, I have a background in planning and I know what you are going through. Discusses the comp plan and the land uses. What are you getting in return from these developers? Saddleman Pl., I submitted two letters for land use changes. Displays overheads. Discussion that office parks have fallen out of favor for developers. Discusses mixed use and a comp plan change for her property. Becky McKay, Engineering Solutions, resident address, 1100 E. Valley High, I have lived in the City of Eagle and I have been a land use planner in the valley for years. I read the comp plan and watched the video on the work shop that you had. You set the guidelines and the responsibility relies with development community to reach those guidelines but if the parameters are too restrictive then it is an impediment for development. Eagle has rural and an urban character. I am representing the Chase Property and we will have another neighborhood meeting. Judy Dahl, 735 E. Echo Hawk Way, I would like to suggest that we protect the wildlife corridor in the Chase Property. Will Dry Creek be protected? We would like to keep Floating Feather a community road. Frank Stoppello, 782 Arlington Dr, discusses the early days and the comp plan which protected the rural area. Discusses the land use zoning around the Chase Property and how this will change our way of life. Leave the density at one unit per acre. Mark Butler, 1675 E. Bishop Way, I have been a land use planner for 27 years. I came to work in 1995 for the City of Eagle as a land use planner. I want to support the change of the before mentioned property to Mixed Use and approve Kath Pennisi property changes. Merlyn Bodily, 7075 N. Linder, I am speaking on the same property that Hal Bunderson spoke about. Discusses the zoning. We are requesting that zoning be changed so more people can enjoy that choice location. Susy Mitchell Kerr, 252 West Meadow Ridge, borders the Chase property and we have lived there since 1994 we love Eagle and have raised 5 children here. WE understand preserving the rural feel and also the wildlife corridor. We like to see this remain. Also the Dry Creek corridor remain. Tommy Ahlquist, 1718 N. Foresto Bello, I am in support of the previous people who have spoken previously about the Chase Property. Discusses the development of the property in a less dense plan. Jim Cummings 1524 W. Coreto Bello Way, we are so happy with our neighborhood and defeat the current Proposal. Eric Mott, 1493 N. Colline Bello Way, I support all of my neighbors. I own a number of small businesses in the valley and I am a long time resident of Eagle. Discusses the comp plan as it relates to business development in the downtown core. Robert Koellisch, 1434 W. Franciscan Dr, I am on the Planning and Zoning Commission and I am running for City Council. I want to make a correction. I did not make a recommendation that the comp plan needs to wait for the new council, I don't think it should wait. I did recommend the Comp Plan as a Planning and Zoning member to come before the Council. I have thereafter made some recommendations to the Council. Laura McCarthy, 2379 N. Equestrian P1, I haven't been to a Council meeting since 1990. I appreciate that you have a public comment up front.
