Rich BOISE IDAHO Pgs=2 DAN RYALLS EAGLE CITY RESOLUTION No. 17-25 2017-094 10/04/2017 04:21 NC III IIIA IIIIlIIIIIII 111 00416866201700943860020021 A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE THE PUBLIC UTILITY, IRRIGATION, AND DRAINAGE EASEMENTS BETWEEN LOTS 1 AND 9, BLOCK 2 (AMENDED PLAT OF FLINT ESTATES SUBDIVISION) AS SHOWN ON THE ATTACHMENTS HERETO; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Jackson's Food Stores/Scott Stom, requested a vacation to the amended final plat of Flint Estates Subdivision to remove the public utility, irrigation, and drainage easements between Lots 1 and 9, Block 2 (Amended Plat of Flint Estates Subdivision); and WHEREAS, On June 5, 2017, the Commission recommended approval of the vacation (VAC -02- 17), to the Council; and WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Idaho Statesman on July 6, 2017, and July 13, 2017; and WHEREAS, On July 25, 2017, the City Council held a public hearing on the proposed vacation (VAC -02-17), and voted to approve the vacation; and WHEREAS, The City Council hereby fmds that the proposed vacation complies with the provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of Eagle City Code, "Vacations and Dedications". NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO. The Eagle City Council hereby vacates the public utility, irrigation, and drainage easements centered on the lot lines between Lots 1 and 9, Block 2, of the final plat of Amended Plat of Flint Estates Subdivision, as considered, heard and approved by the Council at its July 25, 2017, public hearing for application number VAC -02-17 and as shown on the attachments hereto (Exhibit A). This Resolution shall be in full force and effect immediately upon its adoption and approval. ADOPTED by the Council of the City of Eagle, Idaho, this 26th day of September, 2017.
