Resolution - 2017 - 17-20 - Amend Comp Plan Text & Map For Bald Eagle Pointe Pud - 08/08/2017RESOLUTION NO. 17-20 A RESOLUTION OF THE CITY OF EAGLE, ADA COUNTY, IDAHO, AMENDING THE TEXT OF THE 2015 EAGLE COMPREHENSIVE PLAN IN THE RIVER PLAIN PLANNING AREA AND THE MOON VALLEY AND STATE PLANNING AREA; AMENDING THE FUTURE LAND USE MAP FOR THE BALD EAGLE POINTE PLANNED UNIT DEVELOPMENT; AFFIRMING THAT PRESCRIBED NOTICE AND HEARING REQUIREMENTS WERE MET IN ACCORDANCE WITH TITLE 67, CHAPTER 65, IDAHO CODE AND THE EAGLE CITY CODE; AND PROVIDNG AN EFFECTIVE DATE. WHEREAS, on February 10, 2015, the Eagle City Council passed Resolution #15-01 repealing all previous plans and adopting the 2015 Comprehensive Plan and Future Land Use Map; and WHEREAS, on January 12, 2016, the Eagle City Council passed resolution #16-03 amending the 2015 Comprehensive Plan and Future Land Use Map; WHEREAS, on February 14, 2017, the Eagle City Council passed resolution #17-05 amending the 2015 Comprehensive Plan and Future Land Use Map; WHEREAS, on March 28, 2017, the Eagle City Council passed resolution #17-11A amending the 2015 Comprehensive Plan and Future Land Use Map; WHEREAS, Section 67-6509(b) of the Idaho Code, provides that the City Council may adopt, amend or repeal a Comprehensive Plan; WHEREAS, The City Council hereby finds that the proposed amendment to the 2015 Comprehensive Plan complies with the provisions of Section 67-6508 of the Idaho Code; and WHEREAS, after providing legal notice, transmitting notice to other jurisdictions, agencies, and entities, holding public hearings of the Planning and Zoning Commission and City Council, the City Council, on July 25, 2017, amended the 2015 Future Land Use Map to change the future land use designation of 37.78 -acres of the 41.15 -acre site located on the south side of West State Street (SH -44) at the southeast corner of West State Street (SH -44) and West Moon Valley Road, as identified on Exhibit A, to Transitional Residential, as identified as application No., CPA-01-17/A-01-17/RZ-03-17/CU-01- 17/PPUD-01-17/PP-01-17; and WHEREAS, after providing legal notice, transmitting notice to other jurisdictions, agencies, and entities, holding public hearings of the Planning and Zoning Commission and City Council, the City Council, on July 25, 2017, amended the Eagle Comprehensive Plan Text in the River Plain and Eagle and State Street Planning Area to read as identified on Exhibit B, attached hereto and identified as application No. CPA-01-17/A-01-17/RZ-03-17/CU-01-17/PPUD-01-17/PP-01-17. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EAGLE, Ada County, Idaho, as follows: Section 1: The Eagle City Council hereby amends the 2015 Eagle Comprehensive Plan and Future Land Use Designation Map as approved by the Council at its July 28, 2017, meeting. The overall densities should transition from 2-3 units per acre along State Highway 44 to up to 1 unit/2 acres in Moon Valley Ranch. 6.8.6 Moon Valley and State Planning Area: 6.8.6.A(5): Along Moon Valley Road, uses should be designed to allow safe and efficient pedestrian and bicycle access in addition to vehicular circulation. These neighborhood uses should be scaled and designed to be compatible and transitional in lot size with the residential uses located south of Moon Valley Road in the River Plain Planning area.
