ROLL CALL: Present: WRIGHT, GUERBER, MCLAUGHLIN, MCCAULEY, SMITH. A quorum is present. 3. CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS. ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. Findings of Fact and Conclusions of Law for the Approval of A-04-22/RZ-04-22/CU-04- 22/PPUD-02-22/PP-08-22 — Annexation and Rezone from RUT (Rural -Urban Transition - Ada County Designation) to R-1-DA-P (Residential with a development agreement - PUD) and R-3-DA-P (Residential with a development agreement - PUD), Preliminary Development Plan, Preliminary Plat, and Conditional Use Permit for Carp Ranch Subdivision — Gemshore Eagle RE, LLC: Gemshore Eagle RE, LLC, represented by Stephanie Hopkins and/or Kevin McCarthy, P.E., with KM Engineering, LLP, is requesting an annexation, rezone from RUT (Rural -Urban Transition — Ada County designation) to R-1-DA-P (Residential with a development agreement — PUD) and R-3-DA-P (Residential with a development agreement — PUD), conditional use permit, preliminary development plan, and preliminary plat approvals for Carp Ranch Subdivision, a 77-lot (70-buildable, 7-common) residential planned unit development. Nickel with SLN Planning, is requesting an annexation, rezone from RUT (Rural - Urban Transition — Ada County designation) to R-1-DA (Residential with a development agreement), and preliminary plat approvals for Reining Horse Subdivision, an 8-lot (7-buildable, 1-common) residential subdivision. The 7.68-acre site is located on the north side of West Floating Feather Road approximately 380-feet east of the intersection of West Floating Feather Road and North Meridian Road at 3050 West Floating Feather Road. Koetter supports/opposes the application, and expresses concerns related to overcrowding proposed developments for the principal of setting precedence for future developments. Page 2 of 4 K:\P&Z\M INUTES\2022\PZ-11-07-22m in. doc MOTION: McLaughlin moves to recommend approval of A-01-22/RZ-01-22/PP-04-22 Reining Horse Subdivision with all the standard and site -specific conditions of approval except that the lots should be reduced to six lots by merging the northern three lots on the east side into two lots, that the farmers union irrigation situation be resolved before final approval, and that site -specific conditions 9, 10, and 11 be stricken. Comment by Planner Miller to recommend including the conditions of development associated with the annexation and rezone. McLaughlin moves to include the conditions of development associated with the annexation and rezone. Further comment by Planner Miller to include maximum density setting. McLaughlin moves to include that condition 3.1 will be changed to 0.78 dwelling units per acre (DUA). Seconded by Smith. Discussion amongst the Commission. McCauley moves to recommend approval A-01-22/RZ-01-22/PP-04-22 Reining Horse Subdivision: the exact recommendation that Commissioner Mclaughlin made... while giving the developer the latitude to adjust lots as they see fit, not to exceed six lots.
