1. CALL TO ORDER: Meeting called to order at 6:00 p.m.
2. ROLL CALL: Present: WRIGHT, GUERBER, MCLAUGHLIN, SMITH, MCCAULEY. Absent:
MCCAULEY. A quorum is present.
3. CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS.
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will
be no separate discussion on these items unless the Chairman, a Commissioner, member of City
Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items
removed from the Consent Agenda will be placed on the Regular Agenda in a sequence
determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle
shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval
motion unless specifically stated otherwise.

A. ZOA-04-22 — Zoning Ordinance Amendment (Ordinance 888) — City of Eagle: An
ordinance of the City of Eagle, Ada County Idaho, amending Title 8 "ZONING", Chapter 7
"ZONING ADMINISTRATION AND ENFORCEMENT"; providing a severability clause; and
providing an effective date. (MNB)
City Planner, Morgan Bessaw, provides an overview of the application.

City of Eagle. Seconded by McCauley. ALL AYES ... MOTION CARRIES.
B. A-04-22/RZ-04-22/CU-04-22/PPUD-02-22/PP-08-22 — Annexation and Rezone from RUT
(Rural -Urban Transition - Ada County Designation) to R-1-DA-P (Residential with a
development agreement - PUD) and R-3-DA-P (Residential with a development agreement -
PUD), Preliminary Development Plan, Preliminary Plat, and Conditional Use Permit for
Carp Ranch Subdivision — Gemshore Eagle RE, LLC: Gemshore Eagle RE, LLC,
represented by Stephanie Hopkins and/or Kevin McCarthy, P.E., with KM Engineering, LLP, is
requesting an annexation, rezone from RUT (Rural -Urban Transition — Ada County designation)
to R-1-DA-P (Residential with a development agreement — PUD) and R-3-DA-P (Residential

with a development agreement — PUD), conditional use permit, preliminary development plan,
and preliminary plat approvals for Carp Ranch Subdivision, a 77-lot (70-buildable, 7-common)

Floating Feather Road approximately 500-feet west of the intersection of North Cove Colony

expresses concerns related to interconnectivity and traffic impacts when the stub streets are
connected.
Bob Luffel, 1141 North Cove Colony Way. Luffel supports/opposes the application, and
expresses concerns related to blending densities with surrounding subdivisions, and traffic
impacts when the stub streets are connected.

Chuck King, 3146 West Wind Court. King supports/opposes the application, and expresses
concerns related to interconnectivity and traffic impacts when the stub streets are connected.
Craig Karnes, 3709 West Floating Feather Road. Karnes represents himself and his adjacent
neighbors. Karnes supports/opposes the application, and expresses concerns related to blending
densities with surrounding subdivisions and proposes some solutions regarding the same.

Tom O'Donnell, 3527 West Barefoot Street. O'Donnell supports/opposes the application, and
expresses concerns related to traffic impacts.
Michael Parks, 3559 West Barefoot Street. Parks supports/opposes the application, and expresses
concerns related to interconnectivity and traffic impacts when the stub streets are connected.

Rebecca Elliott, 3401 West Barefoot Street. Elliott supports/opposes the application, and
expresses concerns related to traffic impacts.
Michelle Bryan, 3423 West Barefoot Street. Bryan opposes the application, and expresses
concerns related to interconnectivity, traffic impacts when the stub streets are connected, and
neighborhood meeting notices.
Lorie Roberson, 1142 North Ripple Creek Place. Roberson opposes the application, and
expresses concerns related to interconnectivity between the neighboring subdivisions.
Christy Neil, 1101 North Ripple Creek Place, Creekwater HOA President. Neil supports/opposes
the application, and expresses concerns related to traffic connectivity.

when the stub streets are connected.

Scott Kline, 3188 West Wind Court. Kline opposes the application, and expresses concerns

John Pointer, 147 North Cove Colony Way. Pointer opposes the application, and expresses
concerns related to interconnectivity and traffic impacts when the stub streets are connected.
Ceely Robertson, 2957 West Colony Court. Robertson opposes the application, and expresses
concerns related to the proposed density and traffic impacts.
Sunny Hope, 916 North Cove Colony Way. Hope supports/opposes the application, and expresses
concerns related to interconnectivity, traffic impacts when the stub streets are connected, and
neighborhood meeting notices.
Carol Richens, 3517 West Wind Street. Richens opposes the application, and expresses concerns
related to interconnectivity, traffic impacts when the stub streets are connected, and neighborhood
meeting notices.
Stephanie Hopkins, the applicant's representative, addresses concerns raised during the public
hearing and provides rebuttal.

Guerber moves to recommend approval of A-04-22/RZ-04-22/CU-04-22/PPUD-02-22/PP-08-
22 — Annexation and Rezone from RUT (Rural -Urban Transition - Ada County
Designation) to R-1-DA-P (Residential with a development agreement - PUD) and R-3-DA-
P (Residential with a development agreement - PUD), Preliminary Development Plan,
Preliminary Plat, and Conditional Use Permit for Carp Ranch Subdivision — Gemshore
Eagle RE, LLC with the following stipulations:
• That the density north of the ditch and west of north Delahey Avenue be reduced by
7-lots or 10% of the 70-lots.
• That a traffic circle be installed at the south end of Delahey where it leads to the
adjacent subdivision. That further traffic calming considerations be taken on
Delahey.
• That bollards be installed on Peabody Avenue at the ditch, that Barefoot be
extended to Peabody Avenue.
• Maintain the connection to Wind Court. There are people going to be in cove colony
that are going to go south, those in Cove Colony are going to take Wind Court and
go south in order to take ... I don't believe people are going to go on floating feather,
go south on Delahey, when all they have to do is to go south and go... to include staff
recommendations: that the pipeline revision is made.
• That the location of streetlights is included in a revised plat.
• That the PI be relocated as suggested by staff.

Guerber amends motion to contain everything previously said with the exception of:
Change Wind Court to be a pedestrian connection, and that five of the lots north of the
ditch be removed and two of lots the lots south of the ditch be removed for a total of seven.
Second concurs.
Planner Williams provides additional comment regarding the site -specific conditions, provides a
list of the site -specific conditions to clarify the record.
Guerber amends motion to change Site Specific Condition #21 that a gate be installed
instead of bollards at the southern portion of Peabody Avenue, at the ditch.
Second concurs.
FOUR AYES ... ONE NAY (Smith). Motion carries.

6. NEW BUSINESS:
A. FY 2023-2027 Capital Plan Update & FY 2024-2028 Capital Plan Project Solicitation: Staff
will present the adopted FY 23-27 Capital Plan and solicit project(s) for consideration in the FY
24-28 Capital Plan. (NBS)
Director of Long Range Planning and Projects, Nichoel Baird Spencer, presents the item and
responds to questions from the Commission.
7. REPORTS:
