Minutes - 2022 - City Council - 10/11/2022 - Regular EAGLE CITY COUNCIL MEETING MINUTES October 11,2022 1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 5:30 p.m. 2. ROLL CALL: Present: GINDLESPERGER, PIKE, BAUN, RUSSELL. All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: 4. ADDITIONS,DELETIONS OR MODIFICATIONS TO THE AGENDA: 5. RECOGNITION: A. Recognition of Jenna Beckstrom for representing the State of Idaho and City of Eagle in the Miss Teen USA pageant. 6. REPORTS: A. Mayor and Council Reports: Mayor reports on Harvest Festival this last weekend. There were approximately 6,000 in attendance and Trolley rides were given. The event was a great success. B. City Hall Department Supervisor Reports: Director Baird- Spencer states that the Eagle Pedestrian-Bike bridge project has begun construction. C. Eagle Police Department:No report D. City Attorney:No report. 7. PUBLIC COMMENT 1: This time is reserved for the public to address their elected officials regarding concerns or comments they would like to provide to the City Council regarding subjects not on the agenda. At times, the City Council may seek comments/opinions regarding specific City matters during this allotted time.This is not the time slot to give formal testimony on a public hearing matter,land use application,or comment on a pending application or proposal. Out of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3) minutes. Bert Mantell 4690 N. Hartley Rd. Eagle, Idaho. Mr. Mantell provides handout regarding the Citizen Shooting Range Advisory Committee that the Idaho Department of Fish and Game is organizing shooting range committee that is being formed. He feels that it would be good to have representation for the City of Eagle on this committee,he offers to serve,but is amiable just to have someone representing Eagle on the committee. Mr.Mantell discusses the shooting of metal targets and provides a handout about rifle bullet ignition. Tom Letz 302 Taylor Street Eagle, Idaho. Mr. Letz is inquiring about the parking lot that was removed by the Two Rivers HOA and what progress has been done. Mayor Pierce states that he does not have an update to provide this evening. 8. EPD is also seeking authorization for the Mayor to sign the grant application.An amount not to exceed $4,947.10. E. Independent Agreement Between the City of Eagle and DJ Rory P LLC: Independent Agreement between the City of Eagle and DJ Rory P LLC to provide DJ services for the Mother Monster Mash.An amount not to exceed$500. DR-41-22 —Demolish Existing Office (Medical and Dental) Building and Build a New Multi-tenant Office(Medical/Dental and Business/Professional)Building within Channel Center Subdivision: DRB Investments, represented by James Marsh with CSHQA, is requesting design review approval to demolish an existing office(medical and dental)building and to construct a new two (2) story, 14,300-square foot office (medical/dental and business/professional) building. The 1.199-acre site is located at the northwest terminus of South Rivershore Lane at 467 South Rivershore Lane (Lot 6, Block 1, Channel Center Subdivision). (BAW) G. The 35.29-acre site is located at the northeast corner of West State Street and North Ballantyne Lane at 1770 West State Street.(MJW) I. Findings of Fact and Conclusions of Law for the Approval of PP-15-21 MOD—Amberly Ranch Subdivision Preliminary Plat Modification—Core Building Co.:Core Building Co., represented by Rick Perez, is requesting a modification to the preliminary plat approvals for Amberly Ranch Subdivision, a four lot (3-buildable, 1-common) residential subdivision totaling 7 acres, to remove the requirement to extend central water service to the site. The 7- acre site is located approximately 640 feet west of the intersection of West Beacon Light Road and North Ballantyne Lane.(MNB) J. Resolution 22-07: A resolution of the Eagle City Council to vacate two feet (2') of the rear yard public utilities, lot drainage, and Lilac Springs Homeowner's Association, INC, pressurized irrigation facilities easement located within Lot 11, Block 7 (Lilac Springs Subdivision No.2). Resolution 22-08-Amending and Restating the Personnel Policy Manual: A resolution of the City of Eagle,Idaho adopting the amended and restated City of Eagle Personnel Policy and Providing an effective date. Permanent Pathway Easement Agreement Between the City of Eagle and G20 LLC for a Public Pathway within Estrada Village Subdivision No 2: G20 LLC is requesting approval of an amendment to their permanent pathway easement agreement for Estrada Village Subdivision No 1 to be expanded to include the public pathway easement located within Estrada Village Subdivision No 2. The 8.85-acre site is located on the north side of East Hill Road approximately 1200-feet west of the intersection of South Edgewood Lane and East Hill Road. (MNB) M. FP-13-22—Final Plat for Terra View Subdivision No.1—Terra View,LLC:Terra View, LLC, represented by Jonathan Zacarias, P.E., with T-O Engineers, is requesting final plat approval for Terra View Subdivision No. 1, a 54 -lot (47 -residential, 7-common) mixed use subdivision. The 12.78-acre site is located at the northeast corner of State Highway 16 and West Beacon Light Road. (MJW) N. Resolution 22 - 05 - Amending and Restating the Meeting Room Policy: A resolution of the City of Eagle,Idaho adopting the amended and restated City of Eagle Meeting Room Policy and providing an effective date. (TEO) O. Development Agreement Associated with A-02-20 and RZ-02-20—Willow Run Senior Living Facility: Staff is requesting approval of the development agreement associated with the annexation and rezone from RUT(Rural-Urban Transition-Ada County Designation)to R-4- DA (Residential with a development agreement [in lieu of a conditional use permit]) for the Willow Run Senior Living Facility. The 10.44-acre site is located on the east side of North Linder Road approximately 90-feet south of the intersection of West Temple Drive and North Linder Road at 6910 and 6940 North Linder Road. Becky MacDonald 921 W.Rush Road Eagle,Idaho. Ms.MacDonald was born and raised in Eagle and it is her hope that Council will approve this application so her brother can live nearby. Alec MacDonald 921 W. Rush Road Eagle,Idaho. Mr. MacDonald states they are in favor of the conditions placed by the Planning and Zoning Commission conditions and hope Council decides in favor of the application. Discussion regarding irrigation on the site. Tucker Maile 6503 W.Holliday Drive Boise,Idaho. Mr.Maile is in hopes of Council approval of the application. He was raised on Rush Road and hopes to return and raise his family. Thomas Maile discusses irrigation and site access. Mayor closes the public hearing. General discussion. Baun moves to approve item 10A PP-08-20/CU-01-22 Preliminary Plat and Conditional Use Permit for Maile Meadows Subdivision with the following changes,we agree with Planning and Zoning,striking conditions 8, 11, 12, 13,the 2nd half of 14, 15 and adding 18. A-05-22/RZ-05-22/CU-06-22/PPUD-03-22/PP-09-22—Annexation,Rezone, Conditional Use Permit, Preliminary Development Plan, and Preliminary Plat for Willowbrush Subdivision—Jon Hastings: Jon Hastings,represented by Antonio Conti,P.E.with Ackerman- Estvold, is requesting an annexation and rezone from RUT(Rural-Urban Transition—Ada County designation)to R-2-DA-P(Residential with a development agreement—PUD)and preliminary plat approvals for Willowbrush Subdivision,a 13-lot(10-buildable,3-common)residential planned unit development. The 5.97-acre site is located at the southwest corner of North Park Lane and West Beacon Light Road at 2795 North Park Lane. (MJW) Mayor Pierce introduces the item. Antonio Conti 7661 W. Riverside Garden City,Idaho reviews the application. Planner III, Mike Williams reviews the staff report and areas for special consideration. Mayor opens the public hearing. Joe Chakini, 2695 N. Park Lane. Mr. Chakini lives just south of the proposed development, and feels that 1 acre lots would be a better fit for the existing areas. Kenneth Hebert 2396 W. Buckhorn Ct. Mr. Hebert feels the transition should be less impactful to existing neighbors. Having larger lots on the perimeter would be a better option. Peter Radetic 5747 W. Rotherham Ct. The density of the proposal is concerning. The 8 house proposal does not fit with the R-2 zoning. People come to Eagle because of lower density, and it is important stay true to that. Tom Schappacher 4425 W. Azure Teal Lane Eagle, Idaho. Mr. Schappacher is in favor of the transition of the lot sizes. It is important to preserve Eagle's identify with the growth that is coming in. Mayor closes the public hearing. Discussion amongst Council regarding proposed density and current Ada County zoning designation. Pike moves to approve action item 10 B A-05-22/RZ-05-22/CU-06-22/PPUD-03-22/PP-09-22 Annexation, Rezone, Conditional Use Permit, Preliminary Development Plan, and Preliminary Plat for Willowbrush Subdivision with the following: that conditions of development 3.7 and 3.8 with the trees, site specific conditions 5, 6, 7 which is setbacks, 8 including lot 10, 9. Then condition of development 3.1 site specific conditions 23, striking site specific conditions 24,25.Adding 26 as the 2 larger lots to the south,27 would be privacy fencing to the south.And correcting 3.6 and 13 from Palmer making it Park Lane. Seconded by Russell.Discussion.Pike amends to have site specific condition 24 and 25 in place and have lot 11 shall have open fencing around the entirety of the lot. Second concurs. CU-10-22 — Building Height Exception — North 45 Investments, LLC: North 45 Investments, LLC, represented by Walter Lindgren with Lindgren: LaBrie Architecture, is requesting conditional use permit approval for a building height exception to 54-feet,6-inches.The request is in association with a proposed four (4) story mixed use building. The .96-acre site is located on the east side of South Olde Park Place between West State Street and West Aikens Road at 45 and 75 West State Street and 64 and 96 South Olde Park Place. (MJW) Mayor Pierce introduces the item. Walter Lindgren,representing North 45 Investments and reviews the application. Planner III, Mike Williams reviews the staff report and areas for special consideration. Mayor opens the public hearing. Cheryl Bloom,2153 N. Holly Brook Place Eagle,Idaho. Ms.Bloom is opposed to the proposal based on height. The height is not appropriate for the site. The building is close to the street and will crowd the sidewalk. Mark Butler, 1675 E. Bishop Way Eagle,Idaho. [testimony via Webex]. Mr. Butler is in favor of the application. He feels a property of this size would support economic development in the downtown, and an opportunity that should not be missed. Mike Thomas, 597 E. Rooster Ct. Eagle,Idaho. Mr. Thomas is in favor of the proposal and to see something happen on this site. Peter Radetic 5747 W.Rotherham Eagle,Idaho. Mr.Radetic believes that it is a great location for economic development but does not feel that the four story building is in fitting with Downtown. Miguel DeLuna 1347 N. Cortina Ave. Mr. DeLuna agrees with Mr. Butler's testimony. He is in favor of the proposal and the design that was displayed. Mr. Hebert is concerned with the retail space below and the relation to the apartments and living space. Having a retail space that the people could enjoy would be better than cramming in a bunch of apartments. Nancy Soares 1016 S.Arbor Island Way Eagle, Idaho. Ms. Soares states that the surrounding buildings are much older and the façade proposed tonight would not fit in. She is concerned that the public parking is not in close proximity to this site. The height exception would mesh into the surrounding area. Scot Meyer 2261 E. Homer Rd. Eagle,Idaho. Mr. Meyer does not feel the height exception would fit in with downtown Eagle. If residential were to be allowed in the upper stories the demand for parking would be a negative impact. Dale Willman owner of 93 S. Eagle Rd. Eagle Idaho. Mr.Willman states that it is their intent to have something that will fit with the community. He grew up in Eagle and went to TriCity Meats with his grandfather,his heart is with Eagle and wants to bring something positive to the community. Walt Lindgrin rebuts testimony,discusses building height,parking requirements and downtown theme. Mayor closes the public hearing. Discussion amongst the Council. Gindlesperger does not feel that the height and potential design works for downtown Eagle. It is a beautiful building,but not in downtown Eagle. Pike states that the height restriction was originally placed because of the firefighting apparatus needed to service it. It would further the viability of the downtown, as it will generate business viability. He is in favor of the height exemption. Baun believes that a commercial component is needed and this seems light on that. Discussion regarding potentially utilizing the City's fiscal impact tool to analyze the difference between the three story vs.four story. Russell states that she would like more information provided. Discussion. Gindlesperger moves to deny item 10 C. Motion fails due to lack of second. Baun moves to re-open the public hearing and table this item to the October 25'and have staff work with the economic impact tool and the applicant to the fiscal impacts as well. ACTION ITEM: Ordinance 885—Farmstead Landing Subdivision: An ordinance annexing certain real property situated in the unincorporated area of Ada County,Idaho, and contiguous to the corporate limits of the City of Eagle,to the City of Eagle,Idaho;changing the zoning classification of certain real property described herein from RUT(Rural-Urban Transition —Ada County Designation)to R-2 -DA(Residential with a development agreement- in lieu of a PUD); amending the zoning map of the City of Eagle to reflect said change; directing that copies of this ordinance be filed as provided by law; and providing an effective date. The 80.23-acre site is located on the north side of West Floating Feather Road between North Park Lane and North Linder Road. (MNB) Mayor Pierce introduces the item. Out of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three(3)minutes Mark McAllister 755 N. Palmetto Eagle, Idaho. Mr. McAllister served on the Eagle Arts Commission and also the Downtown Advisory Committee. He and the other Arts Commissioners were surprised when they were notified of the pending reorganization of the Commission. He feels the volunteers were disserved by the way the reorganization was handled and hopes that the City learns from the experience and that a better path forward may be taken. Mayor Pierce provides information regarding the impetus for the change. Unfortunately,a member of the Commission made verbal commitments with vendor(s)for work or services,without bringing contracts to Council for action. The ordinance approved tonight was an effort to take additional actions to prevent that from occurring again. The City has had an excellent with the arts community and has always honored the contracts entered into by the Council, partnering on projects together. The City hopes to continue encouraging art in the Eagle community moving forward. 13. EXECUTIVE SESSION: 74-206 (1) An executive session at which members of the public are excluded may be held, but only for the purposes and only in the manner set forth in this section. The motion to go into executive session shall identify the specific subsections of this section that authorize the executive session.There shall be a roll call vote on the motion and the vote shall be recorded in the minutes. An executive session shall be authorized by a two-thirds (2/3) vote of the governing body. An executive session may be held: (f) To communicate with legal counsel for the public agency to discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated. Each year,this committee reviews applications from across Idaho for grants to improve public shooting ranges, including archery ranges, and makes recommendations for funding to the Idaho Fish and Game Commission. Grant awards are paid for by the Public Shooting Range Fund, created through federal manufacturer excise taxes from the sales of firearms, ammunition and archery equipment. Idaho's fund also includes fine and forfeiture monies remitted for wildlife crimes. Annually the Committee recommends up to $555,000 in grant funding. Representative Roles& Terms The committee has seven members, one from each Idaho Fish and Game region. IDFG is seeking candidates who use public shooting ranges and are familiar with the elements needed for safe ranges in their community. The Committee will reflect a diversity of active shooters, including hunters, recreational and competitive shooters. The Committee will be most active each February-March in conjunction with the shooting range grant cycle. IDFG will provide facilitation and logistical support to the Committee. Travel is not required. Meetings will be held after 5:00 PM PT using virtual meeting software. Representatives can serve up to two 2-year terms, with reappointment at the discretion of the Fish and Game director.
