April 25, 2017
INVOCATION
1. CALL TO ORDER: Mayor Ridgeway calls the meeting to order at 5:30 p.m.
2. ROLL CALL: KUNZ, BASTIAN, PRESTON, SOELBERG. Bastian is absent. A
quorum is present.
3. PLEDGE OF ALLEGIANCE: Scout Troops #77 and #123 lead the Pledge of
Allegiance.
4. SERVICE RECOGNITION:
A. Volunteer of the Month - April: Andy Mesa of Scout Troop 77: Andy Mesa of
Troop 77 rallied a group of over 20 scouts, leaders and parents to prepare and serve a hot
meal to over 60 volunteers who worked to restore our weather-beaten Sports Complex
trails in a massive effort. Andy and company also reached out to area grocers for food
donations for the hungry volunteers. The effort of Andy, Troop 77, and the group of trail
workers netted the City 220 hours of labor, in one day. Thank you, Andy, and the
wonderful scouts in Eagle.
Mayor introduces Andy Mesa of Troop #77 and thanks Andy and the volunteers who
worked with him on the Sports Complex trails. Mayor presents Andy with a Volunteer of
the Month plaque and the Volunteer of the Month Proclamation.
Kunz: I would like to recognize Troop #77 for participating in Arbor Day last Saturday.
5. PUBLIC COMMENT: None
This time is reserved for the public to address their elected officials regarding
concerns or comments they would like to provide to the City Council regarding
subjects not on the agenda. At times, the City Council may seek comments/opinions
regarding specific City matters during this allotted time. This is not the time slot to
give formal testimony on a public hearing matter, or comment on a pending
application or proposal. Out of courtesy for all who wish to speak, the City Council
requests each speaker limit their comments to three (3) minutes.
5. PRESENTATIONS:
6. EXECUTIVE SESSION: §74-206 - When authorized. (1) An executive session at
which members of the public are excluded may be held, but only for the purposes and
only in the manner set forth in this section. The motion to go into executive session shall
identify the specific subsections of this section that authorize the executive session. There
shall be a roll call vote on the motion and the vote shall be recorded in the minutes. An
executive session shall be authorized by a two-thirds (2/3) vote of the governing body. An

Kunz: I move pursuant to I.C. 74-206(1)(f) that the City of Eagle convene an
Executive Session for the purpose of communicating with legal counsel for the
public agency to discuss the legal ramifications of and legal options for pending
litigation, or controversies not yet being litigated but imminently likely to be

Mayor introduces the issue.
Council goes into Executive Session at 6:40 p.m.
Council discusses Premiere Industrial, LLC and IMC.
Council leaves Executive Session at 6:00 p.m.
City Attorney McLain: While in Executive Session the Council did cover both litigation
matters that are on the Agenda tonight including a current lawsuit with Idaho Materials
and Construction. IMC did file an objection to the Agency Record. It is the City's
authority to determine what the Agency Record is. So, pursuant to the Court Rules it is
the City that must make a determination on that objection. Briefly outlines the objection.
For these reasons, I would recommend that the City approve that decision and have it
filed with the Court.
Kunz moves that the City of Eagle for Case No. CBO -1-17-04030 accept and
approve the City of Eagle's decision regarding the objection to the administrative
record. Seconded by Soelberg. Kunz: I would ask for a roll call vote. Preston:

7. ADDITIONS, DELETIONS OR MODIFICATIONS TO THE AGENDA:
A. City Staff requests. None
B. Mayor or City Council requests. Mayor adds Item #7C. Report from Chief
Calley on the flooding situation.
C. Chief Calley: there are no new updates causing us concern. There is good weather
coming. There is no increase. Discusses the pit capture.
Mayor: Three weeks ago we closed the greenbelt and the trails. Today I issued a
directive that no city staff can be on the trails. The only people to be on the trails will be
our first responders. Chief Calley and our officers are doing flood control. It is
dangerous down there. The officers are equipped with the necessary safety equipment and
they are patrolling the trails and pathways. The rivers flows could go for 60 or 100 more
days.

Kunz moves to amend the Agenda, Item New Business #10, to move Items #C and
#D ahead of #B, so that #C becomes #B and #D becomes #C and #B would become
#D. Mayor is there any opposition to the Amendment. Seconded by Preston.
Mayor: the agenda will be amended.
8. CONSENT AGENDA:
• Consent Agenda items are considered to be routine and are acted on with one
motion. There will be no separate discussion on these items unless the Mayor, a
Councilmember, member of City Staff, or a citizen requests an item to be
removed from the Consent Agenda for discussion. Items removed from the
Consent Agenda will be placed on the Regular Agenda in a sequence determined
by the City Council.
• Any item on the Consent Agenda which contains written Conditions of Approval
from the City of Eagle City Staff, Planning & Zoning Commission, or Design
Review Board shall be adopted as part of the City Council's Consent Agenda
approval motion unless specifically stated otherwise.

C. Traffic Box Wrap Artist Agreements: Authorizing the Mayor to enter into
agreements with four (4) artists to create artwork to be placed on Traffic Boxes. Each

D. Volunteer of the Month Proclamation: A proclamation of the City of Eagle
declaring April 26, 2017 Scout Troop 77 Day in the City of Eagle for their dedication

E. Findings of Fact and Conclusions of Law for AA-04-17/DR-05-17 — Appeal of
Design Review Application DR -05-17 for a Master Sign Plan for Convenience
Store with Fuel Service and Fuel Island Canopy — Jay Walker: Jay Walker,
represented by Walter Lindgren with Lindgren: Labrie Architecture, PLLC, is
appealing the Design Review Board's decision regarding the above referenced matter.
PROJECT SUMMARY: Jay Walker, represented by Walter Lindgren with
Lindgren:Labrie Architecture, PLLC, is requesting design review approval for a
master sign plan for a convenience store (with up to two sub tenants) with fuel service
and a fuel island canopy. The site is located on the southeast corner of East Hill Road
and SH -55 at 2805 and 2809 East Hill Road. (WEV)
F. Findings of Fact and Conclusions of Law for AA-01-17/DR-51-16 — Appeal of
Design Review Application DR -51-16 for a Multi -Tenant Retail/Restaurant
Building 2 — Hawkins Companies: The City of Eagle, represented by William E.
Vaughan, AICP, Zoning Administrator, is appealing the Design Review Board's
decision on the above referenced matter.
PROJECT SUMMARY: Hawkins Companies, represented by Christian Samples,
is requesting design review approval to construct a 10,620 -square foot multi -tenant
retail/restaurant building. The 0.94 -acre site is located on the east side of South Eagle
Road approximately 600 -feet south of East Colchester Drive within Lakemoor
Commercial Subdivision (Lot 2, Block 10). (WEV)
G. Findings of Fact and Conclusions of Law for AA-02-17/DR-52-16 — Appeal of
Design Review Application DR -52-16 for a Multi -Tenant Retail/Restaurant

Development Agreement — Smith Brighton, Inc.: Smith Brighton, Inc., represented
by Mike Wardle, is requesting a development agreement modification to provide a
revised fencing exhibit to the development agreement and allow for a church site to
be located within Lanewood Subdivision No. 2. The 110.69 -acre site is located at the
northwest corner of North Linder Road and West Floating Feather Road. (WEV)

J. Comprehensive Plan Amendment Application Cutoff Date: Staff is requesting
City Council endorsement of May 1, 2017, as the application submittal cutoff for
independent comprehensive plan amendment applications. Comprehensive plan
applications (text and/or map) received after May 1, 2017, will be considered with, or
after, the Council's consideration of the 2017 Eagle Is HOME Comprehensive Plan

K. Building Department Contract Addendum: Building Official Steve Nash is
requesting approval for addendum to Mechanical Contract to all for Residential Plans
Reviewer. (SN)
M. FP -02-17 — Final Plat for Pamela Baker Park Subdivision — DMB
Development: DMB Development, represented by Dan Torfin., is requesting final
plat approval for Pamela Baker Park Subdivision, a 1 -lot, mixed use subdivision. The
17.47 -acre subdivision is located on the east side of East Colchester Drive
approximately 600 -feet southeast of the intersection of East Colchester Drive and

common) residential subdivision. The 7.32 -acre site is generally located at the
southwest corner of North Echohawk Way and East Sadie Drive. (WEV)
PZ Administrator Vaughan: Staff on behalf of the applicant, requests that Item 8#L be

9. UNFINISHED BUSINESS:
A. 300' Distance Waiver for the service and/or sale of alcoholic beverages— Rib
Shack LLC.: Andrew Petrehn, representing Rib Shack is requesting a distance waiver as
allowed in Idaho State Code 23-913. State Code does not allow alcohol to be sold or
dispensed to be consumed within three hundred (300) feet of any public school, church,
or any other place of worship, except with approval of the governing body of the
municipality. Mr. Petrehn is requesting a waiver from Council for his business premises
located at 395 W. State Street. Mr. Petrehn is seeking to add the service of liquor to the
above referenced premises. The service of beer and wine was approved on October 27,
2015. (SKB)
This item was continued from the April 11, 2017, City Council meeting.
Mayor introduces the issue and provides Council an overview.
Jim Pigman, 578 Monarc, I am part of the 7th Day Adventist Church/School, we
participate in activities during the day and evening on the grounds. The area near our
church and school is a very busy area. I would like to express my concern about the
consumption of high proof alcohol beverages. I would ask the Council Members to look
at the costs and risks. I am asking that the City Council decline the change in this law
and not allow the sale of alcohol beverages at this location.
Jody Geem, 8068 E. Jacob Drive in Nampa, I am the Director of the Eagle Adventist
Christian Center which provides pre-school and child care, we are open from 7:00 am to
6 pm Monday through Friday. We use the parking lot and the front lawn for activities.
Our community youth and sports teams use our gym in the evenings. There is a law that
prohibits this type of alcohol to be in close proximity to churches and schools for a
reason. I would respectfully request this application be denied.
Jessica Davidson, 2306 E. Skokie Court, I am a teacher at the school. We have 16
students currently in our school. We have after school programs and other events at the
school and church. There is also a public school bus stop right across from the Rib
Shack. We would respectfully request that the Council deny this application.
Dallas Kendal, Star, I am a member of the Church. Our main concern is safety. We also
allow community organizations to use our gym so on behalf of the Board I would ask the
City Council to deny the application for waiver.
Herman Doering, 11224 Musket Street, Boise, Head Elder of the Church, as you have
heard we do have concerns for the safety of the children and the adults. Discusses the
parking lots ingress and egress. There are a number of activities that take place at the
Church. The Church has been a part of the City of Eagle for 50 years. We respectfully
request that the Rib Shack application be denied.
Andrew Petrehn, Rib Shack, I will stand for questions and provide some background.
This location is 15-20 years old and for its duration it has had beer and wine and liquor by
the drink has been sold there for approximately 5 years. We have currently been there for
over a year with beer and wine. Discusses the operating hours.

Mark Butler, I have no financial interest with Mr. Petrehn. Years ago, Mr. Petrehn rented
a building from me and he was a very good tenant. I sold the building and Mr. Petron
then left the City. Casa Mexico sells alcohol, Mickey Ray's also sold alcohol and
DiVinci also sells alcohol. I don't see the safety factor.
Mayor discusses the change in the law. The change is property line to property line. The
business before the Rib Shack sold beer, wine and alcohol.

B. RZ-02-03 MOD3 — Modification to Development Agreement — Steve Peel: Steve
Peel, represented by David Sterling with T -O Engineers, is requesting a modification to
the rezone development agreement associated with Lot 49, Block 1, within Coast 2 Coast
Subdivision (aka Laguna Pointe Subdivision) to modify the permitted commercial uses
and building size allowances. The 1.51 -acre site is located on Riversedge Drive
approximately 260 -feet east of Eagle Road at 112 East Riversedge Drive. (WEV) This
item was continued from the April 11, 2017, City Council Meeting.

A. FP -05-17 — Final Plat for Senora Creek Subdivision No. 3 — MM&T Holdings„
LLC.: MM&T Holdings, LLC, represented by Matt Schultz with Schultz Development,
is requesting final plat approval for Senora Creek Subdivision No. 3, a 16 -lot, (12
buildable, 4 common) residential subdivision. The 4.72 -acre site is located on the west
side of North Park Lane approximately 1,500 -feet south of the intersection of North Park
Lane and West Floating Feather Road at 725 North Park Lane.

Matt Schultz, representing the applicant, displays overheads and provides an overview of
their application. We have all our approvals in place and have paid our joining fee to be a

part of the HOA. We would like to finish construction by July. Discusses the current
pump station. We are asking for a waiver. We are asking to be grandfather into that
existing system.

Kunz moves to approve FP -05-17 — Final Plat for Senora Creek Subdivision No. 3
for MM&T Holdings, LLC with the denial of the Request for a waiver for the Eagle
pressurized irrigation system and the applicant will be required to comply with all

C. Discussion of support documentation for the F-35 Mission: Major General Gary
Sayler with the Idaho Air National Guard will present information to the Council
regarding the F-35 Mission. Mayor Ridgeway is requesting approval of Resolution 17-13
urging the United States Airforce to select Gowen Field for the F-35 Mission. (SR)

Major General Gary Sayler, provides some history of the base and the Air National
Guard. Discusses the A-10 and some provides history of the plane.
Soelberg moves to approve the Mayor signing Resolution No. 17-13. Seconded by

D. PD -01-17 — Swanson Parcel Division — Wayne Swanson: Wayne Swanson,
represented by J.J. Howard LLC, is requesting approval of a parcel division for the
creation of two parcels. The 3 -acre site is located on the south side of West State Street,
approximately 550 -feet west of the intersection of West State Street and South Grandean
Way at 985 West State Street. (WEV)

Eric Howard, Howard Engineering, representing the applicant, we are in general
agreement with conditions of approval. Discusses the City Engineer requirements and the
12' easement. General discussion. We would like #4 stricken and we don't know where
the well is located.
Kunz moves to approve PD-01-17—Parcel Division for Wayne Swanson with the Site
Specific Conditions as they appear, however, sticking Site Specific Condition #4.

B. 2017 Lezislation Discussion on House Bill 301, Oil and Gas Amendments:

1. Presentation by Citizens Allied for Integrity and Accountability, represented by Shelly
Brock. (15 minutes)
Shelly Brock displays a power point presentation and provides the Council an overview
of the Legislation and House Bill 301. Discusses the need of an Ordinance, the
Ordinance would include Oil and Gas Leases, drilling operations, pipeline risks, flaring &
Fugitive Emissions. One of the biggest impacts is road damage. Further discussion on
the Ordinance.
Tom Kennedy, 752 E. River Chase Way, in my past I was a risk manager for mortgage
loans. One of our major concerns is that the loan was not going to lose value and in 2010
the home values fell. When one considers oil and gas drilling there needs to be safe
guards to protect home and real estate values.
2. Presentation by Idaho Department of Lands represented by Tom Schultz. (15 minutes)
Tom Schultz, Director of Idaho Department of Lands, my presentation is not to counter or
dispute. My presentation is in regards to House Bill 301. This bill was to protect private
property owners. Discusses the high points of the Bill. There have been no permits to
drill in Ada County or in the City of Eagle. General discussion.
3. Presentation by City Attorney Cherese McLain. (15 minutes)
City Attorney McLain provides an overview of the ordinance presented by CAIA, that is
an ordinance under the State of Texas. Our constitutional authority is different than some
of these other states. Regulations would be very limited. General discussion.
Council would like the City Attorney to do an analysis.

C. Discussion of support documentation for the F-35 Mission: Major General Gary
Sayler with the Idaho Air National Guard will present information to the Council
regarding the F-35 Mission. Mayor Ridgeway is requesting approval of Resolution 17-13

Paula Davina 332 Pebble Beach Ct, I am here as a member of the HPC. Discusses the
Oregon Trial that runs through the City of Eagle. The Ada County Commissioners are
considering marking the trails as it goes through the County. I hope the City would come
forward and support this. General discussion.
Bill Sifford, 901 2nd Street, McCall, I do have another source in the gas and oil industry if
you would like another source. Discusses the comments from Major General Gary
Sayler, we need to weigh in on this industry.

H301, Modifications to Oil and Gas Conservation Act
Purpose: The purpose of this bill is to protect private property owners, state endowment lands, and
taxpayers by updating Idaho law in accordance with other Rocky Mountain States by improving
processes, transparency, and reporting of oil and gas production.
Definitions: Definitions are added or updated to provide clarity to the code. The use of the term "oil
and gas" is inserted throughout the statute for consistency. Several definitions are added or modified in
Section 47-310 to assist in the new reporting requirements. These include: end purchaser; gas; gathering
facility; natural gas liquids; natural gas plant liquids; oil; oil and gas; oil and gas facility; oil and gas
operations; processing facility; royalty owner; and tract.
Commission: In an effort to increase the level of expertise on the Commission, the membership of the
Oil and Gas Conservation Commission (Commission) in Section 47-314 (pages 6 to 8) is altered to now
include: three (3) members with college degrees in geosciences or engineering appointed by the
Governor and confirmed by the Senate; the Director of the Idaho Department of Lands; and a county
commissioner from a county where oil and gas has been produced.
Authorities of Commission: The Commission is given direction on protecting correlative rights and
the rights of surface owners (47-315(2), page 9, lines 9-15). Additionally, the Commission must require
the Department to inspect all wells and production and processing facilities and file reports that list any
areas of concern (47-315(9), page 11, lines 4-10).
Permit to Drill: The timeline for permit approvals is changed from a maximum of 15 days to a timely
and efficient manner (47-316(1)(e), page 11, lines 39-40).
Drilling Locations: New section added clarifying that statewide drilling unit spacing for gas wells is
changed from 640 acres to either 160 acres as a quarter -quarter Section or 640 acres as a Section (47-
317, page 13, lines 9-26). Statewide spacing (640 acres) for horizontal wells is provided for as well (47-
317, page 13, lines 27-36). Changes to the size, shape, or location of a drilling unit may be requested,
and will result in notification of the potentially affected parties. After proper notice, a hearing will be
held if objections are received from owners or royalty owners (47-317, page 13, lines 39-43; 47-318,
page 14, lines 3-23).
Well Spacing: The Spacing statute is moved from 47-321 to 47-318 (pages 14 to 15). Oil and gas pools
may be divided into zones, and those zones may differ in size and shape as long as they prevent waste
and protect correlative rights (47-318(5), page 15, lines 33-40). Modifying the size, shape, or location of
spacing units may be requested, and will require notice (47-317(5), page 15, lines 10-12).
Setbacks: Setbacks of tank batteries and gas processing facilities are moved from rule into a new
Section of the statute, and the same 300 -foot setback is now also applied to oil and gas wells and
existing occupied structures (47-319, page 16, lines 4-13).
Integration: Integration application requirements increase the 55% participation threshold to 67% (47-
320(4)(h), page 18, lines 23 and 24). If 67% cannot be obtained after 120 days of effort, the applicant
can submit an application with only 55% participation (47-320(6), page 19, lines 13-27). Names of
addresses of integrated parties are no longer trade secrets (47-320(5), page 19, lines 6-12).
Unit Operations: Unit operation application requirements increase the 55% participation threshold to
67% (47-321, pages 21-22).
Metering: New metering requirements added in Section 47-322 on page 23. Meters must be installed
and used according to industry standards. Custody transfer and allocation meters must be calibrated
quarterly by a third party (47-322, page 23, lines 12-14).
Commingling of production: A producer shall not commingle production from two or more wells
without approval after notice and opportunity for a hearing (47-323, page 23, lines 21-23).
Reporting requirements to the department: New reporting requirements for active oil and gas
wells, gathering facilities, processing plants, transportation and storage, and purchasing are in
Subsection 47-324(1). Monthly reports must be submitted to the Department before the fifteenth day
of the second calendar month following the month of operations, or about 45 days after the month of
operations (pp. 23 to 24). This is much shorter than the current rule timeframe of six months following
initial production. Failure to comply with these reporting requirements may result in a civil penalty or
the Commission seeking to shut in the applicable oil and gas facilities (page 24, lines 42-45).
Public Data: All reports and permits submitted to the Department under the section will no longer be
exempt from disclosure under the Public Records Act, except for seismic data and data on confidential
wells (47-326(1), page 25, lines 20-44). The Department will provide internet access to all submitted
reports and permits by the end of calendar 2017 (47-326(1), page 25, lines 33-35).
Confidentiality: Confidential well status may be requested when a drilling permit is applied for.
Confidential status shall then be granted. All data and reports on the well will then be held by the
Commission as confidential for 180 days after well completion (47-327, page 26, lines 14-18). The
operator may request an additional six months of confidentiality for well logs (47-327(3), page 26, lines
21-32).
Commission Procedures and Powers: The Commission may act on its own motion, but negotiated
rulemaking is prohibited until July of 2018 (47-328(1), page 27, lines 1-7). Clarifies that a violation or
failure to comply with orders may result in a civil penalty (47-329(3), page 29, line 33).
Oil and Gas Conservation Fund: Severance taxes on oil and gas must be paid monthly (47-330(2),
page 31, lines 35-37). The local economic development fund is eliminated, and that severance tax
revenue will instead be given to the county in which the production occurred (47-330(5)(b), page 32,
lines 34-38 and 46-50).

Obligation to Pay Royalties: This section adopts language from Montana, recognizing the obligation
of an operator to pay royalties w/n 120 days of first production. It also provides that interest shall
accrue if royalties are not paid w/n statutory timeframes. A new section establishes certain rights of
mineral interest owners who enter into oil and gas leases ((47-331, pages 33 to 34). Most of these new
requirements are fairly standard: a) Minimum royalties of 12.5% (47-331(2)(a)); b) royalty payment
deadlines (47-331(3)), and c) remedies for disputes can be brought in district court (47-331(4)).
Reports to Royalty Owners: Requires all royalty payments made in the state for oil and gas to include
a check stub with detailed information regarding the applicable lease or well number, month and year of
sales, volumes and prices of all materials produced, severance taxes paid, net value of production after
these taxes, owner's interest in the well, and revenue out to eight decimal places, list of deductions (if
any), and contact information if the owner has any questions (47-332, page 34).
The lessee must maintain all records pertaining to oil and gas produced and sold for at least five years
(47-332(4), page 34, lines 45-49, and page 35 lines 1-3).
Action for Royalty Accounting: This section adopts language based on Montana. Mineral interest
owners may request an accounting of oil and gas produced from an operator once every 24 months (47-
333, page 35, lines 7-22). Remedy provided for failure to account for or provide royalty to owner.
Surface Owner Protections: Surface use agreements are moved from rule into statute in Section 47-
334, and much more detail is given (pages 35 to 37). This language is based on Utah's statute. Surface
use bonds are set at $6,000, as opposed to the current rule that requires a minimum of $5,000 (47-

Public Records Act (74-108, Idaho Code): The Public Records Act is amended to include an
exemption from disclosure for confidential wells as described in Idaho Code 47-327 (page 38, lines 7-8).
While I serve on the Historic Preservation Commission, I am also a member of the Idaho Chapter of the
Oregon California Trails Association, and I would like to present some information on how these two
organizations are aligned in Eagle.
• Two portions of the Oregon Trail passed through Eagle. I have provided copies of the quadrangle
maps from the book, EMIGRANT TRAILS OF SOUTHERN Idaho, it was published as a combined effort
of the Bureau of Land Management and the Idaho State Historical Society. (Enclosure 1) Since the
scale of the maps is difficult to read, I have created an enlarged map that shows the location of the
trail through western Ada County. (Enclosure 2)
• In the Acknowledgements page of the TRAILS document the editors state, "The efforts of Mr.
Walter H. Meyer, Jr. and Mr Peter M. Lauderman in preparing emigrant trail and management plans
have contributed to the completion of this volume." Mr. Meyer resides north of Eagle on Skyline
Road and part of the Goodale Cutoff runs through his property. We are fortunate to have such a
resource in Eagle.
The National Trails Act that was passed 49 years ago. This act states in part: "National historic trails
shall have as their purpose the identification and protection of the historic route and its historic
remnants and artifacts for public use and enjoyment.ile I
The Oregon National Historic Trail, a route of approximately two thousand miles extending from near
Independence, Missouri, to the vicinity of Portland, Oregon, following a route as depicted on maps
identified as 'Primary Route of the Oregon Trail 1841-1848, in the Department of the Interior's
Oregon Trail study report dated April 1977
While this legislation applies only to roads on Federal lands, it is worthy to note the importance
these routes across our nation have been given.
• The City of Boise has commemorated the trail with monuments from Bonneville Point through Hill
Road. This is approximately 25 miles. (Enclosure 3) Between Hill Rd to the Ward Massacre Site
there is a monument in the Staples parking lot on Chinden Rd. The route through Eagle is not
acknowledged other than our statue of Thomas Aiken. I would like to propose that the City of Eagle
honor our past during the 50th anniversary of the National Trails Act in 2018 by recognizing where
the trail passed through our city.
