A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE TWO FEET (2') OF THE REAR
YARD PUBLIC UTILITIES,S, LOT DRAINAGE, AND LILAC SPRINGS HOMEOWNER'S
ASSOCIATION, INC, PRESSURIZED IRRIGATION FACILITIES EASEMENT T LOCATED
WITHIN LOT ':I, BLOCK 7 (LILAC SPRINGS SUBDIVISION NO. 2) AS SHOWN ON THE
ATTACHMENT HERETO;AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Aaron Ulrich, requested a vacation to the final plat of Lilac Springs Subdivision
Phase 2 to vacate two feet (25) or the rear yard public utilities, lot drainage, and Lilac Springs
Homeowner's Association, Inc. pressurized irrigation easement, located within Lot I I, Block 7 (Lilac
Springs Subdivision No.2)(Exhibit"A");and
WHEREAS, On September 6, 2022, the Commission recommended approval of the vacation
(VAC-Oi-22),to the Council;and
WHEREAS,Legal notice of the City Council hearing on the vacation was published in the Idaho
Statesman on September 9. 2022, and September I6, 2022; and
WHEREAS, On September 27, 2022, the City Council held a public hearing on the proposed
vacation(VAC-02-22), and voted to approve the vacation;and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "'Vacation of Plats - Procedure". and Section 9-6_2 of
Eagle City Code,"Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, IDAHO.
The Eagle City Council hereby vacates two feet (2')of the rear yard public utilities, lot drainage,
and Lilac Springs homeowner's Association, Inc. pressurized irrigation easement, located within Lot I I,
Block 7, Lilac Springs Subdivision No. 2, as considered, heard and approved by the Council at its
September 27, 2022, public hearing for application number VAC-0e-22 and as shown on the attachments
hereto.
This Resolution shall be in full force and effect immediately upon its adoption and approval.
ADOPTED by the Council of the City of Eagle, Idaho. this 1 Ith day of October,2022.
