This Eagle Employee -Student In -Service Education Program Agreement ("Agreement")
made and entered into on the date last indicated below, by and between THE CITY OF EAGLE,
a municipal corporation formed in accordance with the laws of the State of Idaho, hereinafter
referred to as "the City" and ALANA DUNN, hereinafter referred to as "Employee;"
RECITALS
WHEREAS, the City's personnel policy manual provides certain qualifying employees
with an opportunity to participate in a employee -student in-service education program ("in-service
program");
WHEREAS, Employee is a permanent City employee;
WHEREAS, Employee has completed any required probationary employment period and
has more than a satisfactory employment record with the City;
WHEREAS, the Employee's Supervisor, Sharon K. Bergmann, City Clerk/Treasurer, has
determined the Employee's curriculum plan is beneficial to the City of Eagle;
WHEREAS, the Employee's meritorious service and performance for the City make the
Employee eligible for the in-service program's benefits; and,
WHEREAS, the budgetary expenditures present and future, involved in the Employee's
application for financial assistance under the in-service program are within the City budget.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
Section 1.
Employee will enroll in the Herberger Institute for Design and Arts at Arizona State
University pursuing a Bachelors of Art Degree in Art History as set forth in Exhibit A, attached
hereto and incorporated by reference herein as "Curriculum Plan". This is an online program and
it is understood by the Employee that work hours will not be utilized for online studies. Employee
will be reimbursed for tuition and registration costs for the in-service program upon completion of
each semester under the following terms:
A. Employee shall present to the City Clerk/Treasurer proof of tuition paid in the form
of a receipt from Arizona State University itemizing payment the University received from
Employee.
B. Employee shall present to the City Clerk/Treasurer a copy of Employee's grades
from Arizona State University for each semester within thirty (30) days of Employee's
receipt of said grades.

C. The City will reimburse Employee, from the City budget, 100 percent of tuition and
registration costs Employee paid to Arizona State University for a grade of "A" or
equivalent, 80 percent for a grade of "B" or equivalent, 50 percent for a grade of "C" or
equivalent, and 0 percent for grades below "C" or equivalent.
D. Reimbursement is limited to a maximum of six (6) -credit semester hours during a
regular semester or equivalent. If Employee enrolls in more than the above -stated
maximum semester credit hours, or their equivalent, Employee shall no longer be eligible
for the City In -Service Education Program and reimburse the City for all tuition, paid leave
received by Employee to attend the "institutes" on campus, and registration fees paid to
Employee unless the City agrees to waive the maximum semester credit limit in writing
prior to commencement of the semester in which additional credits are sought.
E. Employee shall give the City Clerk/Treasurer notice of any change to Employee's
Curriculum Plan set forth as Exhibit A hereto. Any material changes to the Curriculum
Plan must receive prior written approval from the City Clerk/Treasurer. Failure to obtain
prior written approval of changes to the Curriculum Plan will result in the termination of
Employee from the City's In -Service Education Program and require repayment to the City
of tuition and paid leave received by Employee to attend the "institutes" on campus, and
registration fees received by Employee from the City. Employee and City may enter into
a written agreement establishing a repayment schedule for such reimbursement. If no
repayment schedule can be agreed upon between the parties, Employee shall have one (1)
year to repay the monies received by the City from the in-service program.
Section 2.
Employee shall maintain permanent full-time employee status and perform at or above
satisfactory employee performance levels. In the event Employee changes her permanent full-
time status, the reimbursement provisions of this Agreement may be mutually amended in writing
between Employee and the City. If no amendment can be mutually agreed upon the reimbursement
requirements of Section 3 herein should be followed.
Section 3.
In return for participation in the City's In-service Education Program, Employee agrees to
reimburse the City for all tuition and registration fees paid by the City by continuing her full-time
permanent employment status for at least two (2) years after Employee's receipt of the last
reimbursement payment from the City (hereinafter referred to as "Repayment Plan"). If
Employee's employment is voluntarily terminated from the City or if Employee is terminated for
cause, Employee shall repay the City for all reimbursement as set forth in Section (1) (E) of this
Agreement.

During the Repayment Period, the City and Employee recognize that the City may not have a job
available, as a full-time position that utilizes Employee's newly acquired educational training from
the in-service program. The City shall use its best efforts to accommodate Employee's educational
training as much as possible during the Repayment Period. If no such employment opportunity
exists even at a part-time level, Employee's repayment obligation set forth under Section (1) (E)
of this Agreement will be prorated based on the amount of time left in the two (2) year Repayment
Period.
Section 4.
The waiver by either Employee or the City of the breach of any provisions of this
Agreement by either party shall not operate or be construed as a waiver of any subsequent breach.
Section 5.
This Agreement shall be governed by and in accordance with the laws of the State of Idaho
and venue shall be in the Fourth Judicial District Court. In the event an arbitration, suit or action
is brought by any party to this Agreement to enforce any of its terms, or in any appeal therefrom,
it is agreed that the prevailing party shall be entitled to reasonable attorney fees and costs to be
fixed by the arbiter, trial court, and/or appellate court.
Section 6.
If any provisions of this Agreement, or the application of such provision to any person or
circumstance, shall be held invalid, the remainder of this Agreement, or the application of such
provision to persons or circumstances other than those to which it is held invalid, shall not be
affected thereby.

Re: Eagle Employee -Student In -Service Educational Program
In the Spring of this year, 2017, I intend to continue with my pursuit of a Bachelors of Art degree
in Art History through the Herberger Institute for Design and the Arts at Arizona State University. I
intend to archived this degree as a part-time student by the end of the Spring 2019 semester. This
program is completely online.
The cost associated with Bachelor's degree program is $500 per credit hour. Due to the
program being entirely online, each semester includes various fees such Financial Aid Trust fee,
Technology fee and Course fee. At best estimation, a 3 hour class would cost $1,594 and a 4 hour class
would be $2094, with the total cost of the program being $16,346 (4*$2,094)+(5*$1,594). At best
estimation, this Spring 2017 semester would cost $1,594. Summer 2017 would be $1,594. Fall 2017
semester would be $4,188. Spring 2018 would be $4,188. Fall 2018 would be $3,188 and Spring 2019
would be $1,594. Therefore, with tuition and fees included in the 2016-2017 budget, total costs would
be $3,188. Fall 2017 and Spring 2018 would be $8,376 in the 2017-2018 budget. Fall 2018 and Spring
2019 would be $4,782 out of the 2018-2019 budget year.
