DECLARATION OF LOCAL DISASTER
EMERGENCY
WHEREAS, Idaho Code Section 46-1011 authorizes the mayor of a city to declare a local
disaster emergency; and
WHEREAS, Idaho Code Section 46-1002(3) defines the term "disaster" as the "imminent threat
of widespread or severe damage, injury, or loss of life or property resulting from any natural or manmade
cause; and
WHEREAS, due to the unprecedented accumulation of precipitation, unhealthy, unsafe, and
unsustainable conditions exist in the City of Eagle, Idaho ("City").
WHEREAS, Idaho Code Section 46-1002(4) provides that the term "emergency" includes the
"imminent threat of a disaster or condition threatening life or property which requires state emergency
assistance from, among others, the Ada County Highway District.
WHEREAS, a mayor's declaration of a local disaster emergency activates the response and
recovery aspects of applicable local or intergovernmental disaster emergency plans for the furnishing of
aid and assistance; and
WHEREAS, Idaho Code Section 46-1011(1) requires a mayor's declaration, declaring,
continuing, or terminating a local disaster emergency to be filed with the County Recorder's Office and
"given prompt and general publicity;" and
WHEREAS, Idaho Code Sections 46-1003(2), (3) and (4) authorize the City to execute
agreements to: prevent and reduce damage, injury, and loss of life and property resulting from natural or
man-made catastrophes; prepare assistance for prompt and efficient search, rescue, care, and treatment of
persons injured, victimized or threatened by disaster; and provide for rapid and orderly restoration and
rehabilitation of persons and property affected by disasters.
WHEREAS, the public interest and necessity demand the immediate expenditure of public
money to secure materials, equipment, and services from private and public entities to provide disaster
emergency relief and assistance to persons injured, victimized or threatened by the unhealthy, unsafe, and
unsustainable conditions in the City.
A local disaster emergency exists in the City of Eagle and that all efforts will be made to protect
the citizens and property of the City through activation of all local disaster emergency plans and state
emergency assistance; and
NOW THEREFORE, the Mayor of the City of Eagle, Idaho does hereby declare that:
This Declaration of Local Disaster Emergency ("Declaration") shall expire within seven (7) days
of the date of the filing of this Declaration unless the City Council expressly authorizes the continuance
thereof; and
This Declaration of Local Disaster Emergency and any termination proclamation to be made
when the threat to public health and safety has ended, shall be promptly filed with the Ada County
Recorder's Office; and
Prompt and general publicity shall be given by a press release notifying the public of this
Declaration.
