Minutes - 2022 - City Council - 08/09/2022 - Regular EAGLE CITY COUNCIL MEETING MINUTES August 9,2022 1. CALL TO ORDER: 2. ROLL CALL: Present: GINDLESPERGER,PIKE,BAUN,RUSSELL. All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: 4. ADDITIONS,DELETIONS OR MODIFICATIONS TO THE AGENDA: 5. PRESENTATION: A. Director of Ada County Highway District,Bruce Wong would like to share his appreciation to the Council and Mayor for their support of the Idaho Patriot Thunder. Mr. Wong thanks the Mayor and Council for their support of the event. It was the 12th year of Idaho Patriot Thunder,and each year the City loans flags to line the entry lane for the event. There were 741 riders,resulting in 9-11 miles of motorcycles checks to charities. Funds raised benefit Idaho National Guard Army Support Fund and Operation Warm Heart. Mayor Pierce is presented with a token of appreciation for the City's support. 6. REPORTS: A. Mayor and Council Reports: Pike reports on the Eagle Sewer District meeting,they approved their budget at last nights meeting. Tomorrow he will be attending the Senior Center meeting. Urban Renewal Agency is moving forward purchasing the property on the corner of Eagle Road and State Street. The public hearing for the Urban Renewal Agency budget will be held on the August 16,2022. B. City Hall Department Supervisor Reports:None 1. City Treasurer,Financial Reports for June 2022 and for Quarter ending June 2022 C. City Attorney:None 7. The 4.58-acre site is located on the northwest corner of East Hill Road and North Edgewood Lane at 200 North Edgewood Lane. (MNB) D. Service Quote Between the City of Eagle and WoodLab:A Service Quote between the City of Eagle and WoodLab for the fabrication of a custom conference table in an amount not to exceed$8,500.ARPA funds will be utilized for this expense. Service Order Between the City of Eagle and Fatbeam: A Service Order between the City of Eagle and Fatbeam for the installation of conduit network located at N.Moon Bello Way (west of Eagle Middle School)east to Eagle Road and at the corner of Hill Road and State Street traveling east to 2nd Street.An amount not to exceed$96,236.ARPA funds will be utilized for the expense. Development Agreement Associated with A-11-21/RZ-17-21/CU-11-21/PPUD-08- 21/PP-18-21—Soaring Feather Ranch Subdivision: Staff is requesting approval of the development agreement associated with the rezone from RUT(Rural-Urban Transition-Ada County designation)to R-E and R-2-DA-P(Residential-two units per acre with a Development Agreement-PUD). The City Council approved the associated annexation,rezone and preliminary plat applications on July 12,2022 (A-11-21/RZ-17-21/CU-11-21/PPUD-08-21/PP- 18-21). (MNB) G. Development Agreement Associated with A-12-21/RZ-18-21 &PP-19-21— Farmstead Landing Subdivision: Staff is requesting approval of the development agreement associated with the rezone from RUT(Rural-Urban Transition-Ada County designation)to R-2- DA(Residential with a development agreement- [in lieu of a PUD])for Farmstead Landing Subdivision. Mayor Pierce states that a table was needed for one of the conference rooms, and WoodLab, an Eagle Business,was approached to provide a price quote. Upon further discussion, it was proposed to have WoodLab apply their logo on the table,thus reducing the overall price. Staff is in the process of then approaching other local businesses,to sponsor their logo placement on the table as well. The intent is for the majority of the cost to be paid by local business sponsorships,with the remaining approximately$1,500 being paid by the city. Baun moves to approve consent item 8D a service quote between the City of Eagle and WoodLab not to exceed $8,500. Seconded by Russell. ACTION ITEM Fiscal Year 2022-2023 Budget Hearing: An Ordinance for Fiscal Year 2023 commencing on October 1,2022, and ending September 30,2023,appropriating sums of money to defray all necessary expenses and liabilities of the City of Eagle for said Fiscal Year. For detailed budget information follow this link,(KR) Mayor Pierce introduces the item. City Treasurer,Kellie Rekow provides a brief overview of the budget,and highlights some of the changes. Rekow makes herself available for questions. Mayor opens the public hearing. Mary Hunter 173 N. Sierra View Way Eagle,Idaho. Ms. Hunter inquires why the economic development budget was incorporated into the Executive Department. She also expresses concern with the 33% increase of the bottom line of the budget.Mayor Pierce states that the economic development director resigned, and they are looking at revising the focus for economic development and fostering the local smaller businesses rather than courting large corporations. With this shift it made sense to shift the remaining staff member was placed under the direction of the executive department. Discussion. Mayor closes the public hearing. Pike states that he would hope that law enforcement staffing could be addressed to, with the Comprehensive Plan updates and addressing levels of service. Chief Ryan Wilke provides statistics for law enforcement staffing in the Ada County, for both city/county police departments and those city's utilizing contracted law enforcement services.Pike states he will not be voting in favor of the budget,as the request to increase Ada County Sheriff's office staffing is not included in the budget,and other city department requests were granted. ACTION ITEM:An Exclusive Franchise Agreement between the City of Eagle,Idaho and Hardin Sanitation for Solid Waste Collection Services: An exclusive franchise agreement for the collection,hauling and disposal of municipal solid waste and construction and demolition waste in the City of Eagle,Idaho. (JP)Public comment will be taken on this item. Mayor introduces the item. Bob Van Arnem,3049 S.Whitepost Way Eagle,Idaho.Mr. Van Arnem provides a handout to Council and reviews the same. There are 3 services that he is concerned may be lost with the draft contract. They are unlimited pickup year round of up to 10 bags,bundles,personal cans, unlimited curbside leaf pick up during recycling period at no charge and use of personal cans. Requests clarification of discounts for senior for multiple cans,the definition of bundles and makes a suggestion regarding the timing of leaf pickup. Russell Buschert,235 W.Floating Feather Rd.Eagle,Idaho. Mr.Buschert is frustrated with the decision making process. The smaller can users are paying a higher rate per gallon of trash that the larger can users. He is concerned that Eagle would be moving away from the electric vehicles that Republic Services is using.Mr.Buschart states that Hardin is not locally owned,it is owned by a corporation. Jay Holmes,409 Wingfoot Eagle,Idaho. He has been in Eagle for five years and likes the service received by Republic. The customer service has been good,he likes the drivers and the people answering the phones. He does not feel there is a reason to change.Mr.Holmes asks if the City Attorney has approved of the selection process,as well as the draft contract. He is concerned if his service will change. Nancy Viano 704 N.Nicholas Lane Eagle,Idaho. She has lived in Eagle for 35 years,and feels like the service has been great. From the customer service representatives to the truck drivers,they have been great. She encourages Council to visit with other agencies that regarding their satisfaction for services. Mary Hunter 173 N. Sierra View Way Eagle,Idaho.Ms.Hunter has been happy with Republic Services. She inquires the criteria used to select Hardin Sanitation. It would have been better to have clean fuel as part of the evaluation criteria. Stan Ridgeway, 1735 W.Rush Rd.Eagle,Idaho. Mr.Ridgeway feels that Mayor Pierce has a personal vendetta against Republic Services and does not believe the process has been transparent to the Eagle residents. The increase in rates for seniors and veterans is unfortunate.Discusses changes in spring clean up, leaf collection and commercial recycling that does not meet current expectation of residents. Mayor Piece provides facts regarding his personal experience with Republic Services. States that the City has done great things with Republic Services over the past years. Ms.Joslin likes the services provided by Republic Services,especially the clean burning vehicles.The use of diesel vehicles could cause increases in fees. Mark Fulwiller,Hardin Sanitation. Mr. Fulwiller confirms that fire suppression devices are installed in the front and rear of their vehicles. Discussion between Mr. Fulwiller and Mayor and Council to address some of the concerns posed tonight,including:the use of personal cans,the type of fuel the vehicles will utilize,proposed rates across the board reflect an approximate 25%reduction in rates. Hardin Sanitations local customer service is based in Meridian. General discussion. Change the contract for leaf pick up to be Oct. 15th. Senior discounted rates apply regardless of the number of cans utilized. The 3.15-acre site is located on the west side of North Meridian Road approximately 1,725-feet north of West Floating Feather Road at 1655 North Meridian Road. (DLM) Mayor introduces the item. Planner III,Daniel Miller reviews the application. Michael Harrison 1655 Meridian Rd. Mr. Harrison stated he never imagined it would take this long. There has been a delay from ACHD and he is unable to move forward due to this delay. Discusses the steps that have been take,and the remaining steps for the project. I think you would regret this decision for years to come. First, the increases in rates are greatest for those who need the most relief—seniors and veterans. For example, one of our neighbors would see a significant increase. She lives on a VERY fixed income, and $7 a month in increase would be very difficult. You might not think this is so, but it is. Given current inflation and Social Security not keeping up with it, this is going to be a real concern for long time Eagle citizens on a fixed income. Second, these rates in effect subsidize additional "contributions" to the landfill for the largest users. Their increase in rate is less than that for 32 gallon and smaller 1 users. It makes no sense to encourage increases to our landfill through this rate structure. The County is working hard to decrease those"contributions", as they should. This does not help. Third, I ride my bike often on Homer Road and its environs (the unincorporated part of the City). I do that in part because our own roads, through growth, have become increasingly unsafe (just an aside as you work with ACHD). Hardin Sanitation services that area, and I am often following or jumping back and forth with their trucks. They are old, ugly, and they are so noisy (all dump trucks are noisy, but these are awful) and they spew fumes. This is not the type of service Eagle expects, and it should be rejected. I know that at least some of you voted to approve the Hardin RFP based on estimated cost savings, and I appreciate that. I think you will come to regret this decision in the very short term. I doubt the cost savings are real (5% per year increases, e.g.). Please reject this agreement in favor of a new RFP that shows a better"apples to apples" comparison of the rates to users versus the benefits to the City. Aligning limited budgets within a rapidly growing county is challenging; it is understood that working through what to fund and when to construct is difficult with competing entities. The City provides our comments and requests for consideration as the Commission: The City of Eagle Continues to have significant concerns about the equitable expenditure of funds and the timely construction of projects within our city. Between FY 2016 and Fiscal Year 2020 the City of Eagle citizens have paid ACHD over$30 million in taxes and over$12 million in impact fees. In return,the City has received less than$26 million in investment-the majority of which are bridge and culvert replacements and signal advancements. According to ACHD's own reporting the City of Eagle has the lowest investment and expenditure by ACHD within the County. ACHD staff informed the Commission on February 3,202, the City of Eagle was one of the lowest City in the County for expenditure in FY 20 and over the past FIVE years. Over the past 5 years,the City of Eagle has had no less than 6 projects annually slip in construction year, remain unfunded, or moved from funded to unprogrammed. This is nearly 1/3 of all the City of Eagle projects. In the ACHD draft FY 23 budget this trend continues. Over the past 10 years, the City of Eagle has been an active partner with ACHD in the design, development, and construction of projects within the City, leveraging local dollars to help supplement ACHD's design and construction of projects within the City. The City's expenditures for the projects currently identified within the proposed ACHD budget equals over$1.9M of local dollars. As addressed in the City's November 15, 2021, letter the Aikens Street Extension has been in the IFYWP for over 13 years and originally planned for construction in 2014. Based on the draft FY 22 ACHD budget the project will be unfunded with no funding identified for either ROW acquisition or construction. The City and the Eagle URA have expended thousands of dollars in the design and cooperative planning with ACHD for this project based on ACHD's planning documents and promises. The budget as proposed budget fails to implement the adopted FY 2021-2026 IFYWP. Additionally, the upcoming Downtown Mobility Improvements (AKA: Eagle & State Intersection Improvements) will further complicate and limit access in this area. The lack of access is having significant impacts on economic development in this portion of Downtown Eagle. Aikens Street currently dead ends just east of 1'Street. 1st street is one-way southbound requiring U-turn at the dead end (not constructed as a turnaround) in order to exiting the area to west onto Eagle Road. At the completion of the Eagle Road and State Street project, access to Eagle Road will be limited to right-in/right-out. Businesses in this area are struggling to be seen and be viable while only being 1 block south of State Street and 1 block east of Eagle Road. The City of Eagle urges ACHD to retain the Aikens Street Extension in the FY 2023 budget. If that is not viable, we request that ACHD host a project coordination meeting with the City and the Eagle Urban Renewal Agency to reevaluate the project.
