Ordinance - 1997 - 312A - Amend Zoning Administration And Enforcement - 11/25/1997SUMMARY OF ORDINANCE NO. 312A ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY, IDAHO, AMENDING EAGLE CITY CODE, TITLE 8 "ZONING," CHAPTER 7, "ZONING ADMINISTRATION AND ENFORCEMENT," SECTION 8, "NOTICE REQUIREMENTS" A summary of the principal provisions of Ordinance No. 312A of the City of Eagle, Ada County, Idaho, adopted on February 10, 1998, is as follows: Section 1: Amends Eagle City Code, as follows: A. Section 8-7-8, "Notice Requirements," is amended to provide that the Zoning Administrator may determine any additional area that may be impacted by a proposed land use change; that, for Comprehensive Plan Land Use Map Amendments and/or Zoning Ordinance Map Amendments pertaining to more than ten (10) parcels of land, the following notice requirements shall apply: (1) Posted notice shall not be required unless all parcels are contiguous and abut a public right-of-way wherein a minimum of one four foot by eight foot (4'x8') plywood sign shall be placed adjacent to the right of way; (2) If parcels are not contiguous or do not abut a public right-of-way, three (3) notices, bearing a minimum 6"x6" graphic representation showing the proposed amendments, shall be published in the official newspaper of newspaper of general circulation within the City, with the third notice appearing a minimum of ten (10) days prior to the public hearing; and, that Section 8-7-8D.1.0 is amended to show that referenced Section 8-3- 2E refers to mobile home/temporary living quarters, and that Section 8-7-8D.2 changes the signage location for parcels within five hundred feet (500') or more of road frontage from "each end of the project road frontage angles" to "each end of the property roadway frontage." Section 2: States that the provisions of Ordinance No. 312A are declared to be severable, and that if any provision or application of such provision to any person or circumstance is declared invalid for any reason, such declaration shall not affect the validity of remaining portions of Ordinance No. 312A. Section 3: States that Ordinance No. 312A shall take effect and be in force from and after its passage, approval, and publication as required by law. Provides that a summary of Ordinance No. 312A may be published in lieu of the entire ordinance in compliance with Section 50-901A, Idaho Code.
