7. PUBLIC COMMENT 1: This time is reserved for the public to address their elected officials regarding
concerns or comments they would like to provide to the City Council regarding subjects not on the agenda.
At times, the City Council may seek comments/opinions regarding specific City matters during this allotted
time. This is not the time slot to give formal testimony on a public hearing matter, land use application, or
comment on a pending application or proposal. Out of courtesy for all who wish to speak, the City Council
requests each speaker limit their comments to three (3) minutes.
8. ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS: CONSENT AGENDA:
Consent Agenda items are considered to be routine and are acted on with one motion. There will be no
separate discussion on these items unless the Mayor, a Councilmember, member of City Staff, or a citizen
requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent
Agenda will be placed on the Regular Agenda in a sequence determined by the City Council. Any item on the
Consent Agenda which contains written Conditions of Approval from the City of Eagle City Staff, Planning &
Zoning Commission, or Design Review Board shall be adopted as part of the City Council's Consent Agenda
approval motion unless specifically stated otherwise.

B. D&S Electrical IF Sole Source Contract: Having declared and published as a sole source contract
under Idaho Code 67-2808(2)(viii) and 67-2808(2)(b) and having received no opposition, the City is
entering into a contract for the provision of polyurethane T22 vaults. (W)
C. Permanent Pathway Easement Agreement Between the City of Eagle and Schneider Custom
Homes for a Public Pathwav within Eastfield Subdivision: Schneider Custom Homes is requesting
approval of a permanent pathway easement agreement for the public pathway located within Eastfield
Subdivision. The 4.58-acre site is located on the northwest corner of East Hill Road and North
Edgewood Lane at 200 North Edgewood Lane. (MNB)

D. Service Ouote Between the Citv of Eagle and WoodLab: A Service Quote between the City of Eagle
and WoodLab for the fabrication of a custom conference table in an amount not to exceed $8,500.
ARPA funds will be utilized for this expense. (ELZ)
E. Service Order Between the Citv of Eagle and Fatbeam: A Service Order between the City of Eagle
and Fatbeam for the installation of conduit network located at N. Moon Bello Way (west of Eagle
Middle School) east to Eagle Road and at the corner of Hill Road and State Street traveling east to 2nd
Street. An amount not to exceed $96,236. ARPA funds will be utilized for the expense. (ELZ)
F. Development Agreement Associated with A-11-21/RZ-17-21/CU-11-21/PPUD-08-21/PP-18-21 —
SoaELng Feather Ranch Subdivision: Staff is requesting approval of the development agreement
associated with the rezone from RUT (Rural -Urban Transition - Ada County designation) to R-E and R-
2-DA-P (Residential -two units per acre with a Development Agreement - PUD). The City Council
approved the associated annexation, rezone and preliminary plat applications on July 12, 2022 (A-11-
21 /RZ-17-21 /CU-11-21 /PPUD-08-21 /PP-18-21). (MNB)
G. Development Agreement Associated with A-12-21/RZ-18-21 & PP-19-21— Farmstead Landing
Subdivision: Staff is requesting approval of the development agreement associated with the rezone from
RUT (Rural -Urban Transition - Ada County designation) to R-2-DA (Residential with a development
agreement - [in lieu of a PUD]) for Farmstead Landing Subdivision. The City Council approved the
associated annexation, rezone and preliminary plat applications on June 28, 2022 (A-12-21/RZ-18-21 &

H. FPUD-06-22 & FP-08-22 — Final Development Plan and Final Plat for Arvory Crest Subdivision
No. 3 — Lennar Homes: Lennar Homes, represented by Ken Firmage with FS One, LLC, is requesting
final development plan and final plat approvals for Arvory Crest Subdivision No. 3, a 34-lot (29-
buildable, 5-common), residential subdivision. The 7.64-acre site is located on the south side of West
Floating Feather Road approximately 1,390-feet southeast of the intersection of West Floating Feather

I. FPUD-08-22 & FP-10-22 — Final Development Plan and Final Plat for Arvory Crest Subdivision
No. 4 — Lennar Homes: Lennar Homes, represented by Ken Firmage with FS One, LLC, is requesting
final development plan and final plat approvals for Arvory Crest Subdivision No. 4, a 34-lot
(32buildable, 2-common), residential subdivision. The 18.28-acre site is located on the south side of
West Floating Feather Road approximately 1,275-feet east of the intersection State Highway 16 and

J. FPUD-04-22 & FP-04-22 — Final Development PI an and Final Plat for Snoqualmie Basin
Subdivision — Red Butte. LLC: Red Butte, LLC, represented by David Sterling, P.E., with T-O
Engineers, is requesting final development plan and final plat approvals for Snoqualmie Basin
Subdivision, a 35-lot (26-residential, 4-commercial, 5-common) mixed use planned unit development.

A. ACTIONITEM: An Exclusive Franchise Agreement between the Citv of Eagle. Idaho and Hardin
Sanitation for Solid Waste Collection Services: An exclusive franchise agreement for the collection,
hauling and disposal of municipal solid waste and construction and demolition waste in the City of
Eagle, Idaho. (JP) Public comment will be taken on this item.

B. ACTIONITEM: ACHD FY 2023 Budget: Staff will provide an overview of the ACHD draft FY 2023
Budget and the implications to the City's projects within the City's Capital Plan and request City Council
direction. (NBS)
C. ACTION ITEM: Ordinance 880 — Eventvr Subdivision: An ordinance annexing certain real property
situated in the unincorporated area of Ada County, Idaho, and contiguous to the corporate limits of the
City of Eagle, to the City of Eagle, Idaho; changing the zoning classification of certain real property
described herein from RUT (Rural -Urban Transition — Ada County Designation) to R-2-DA
(Residential with a development agreement); amending the zoning map of the City of Eagle to reflect
said change; directing that copies of this ordinance be filed as provided by law; and providing an
effective date. The 8.11-acre site is located south of West Moon Valley Road, approximately 1,000-feet
south of the intersection of West Moon Valley Road and Highway 44. (MNB)

D. ACTIONITEM: Ordinance 882 — Beaconwood Subdivision: An ordinance annexing certain real
property situated in the unincorporated area of Ada County, Idaho, and contiguous to the corporate
limits of the City of Eagle, to the City of Eagle, Idaho; changing the zoning classification of certain real
property described herein from R2 (Low Density Residential — Ada County Designation) to R-2-DA-P
(Residential with a development agreement - PUD); amending the zoning map of the City of Eagle to
reflect said change; directing that copies of this ordinance be filed as provided by law; and providing an

E. ACTIONITEM: EXT-04-22 — Final Plat Extension of Time Associated with PP/FP-01-21 —
Middlefork Estates Subdivision: Michael and Julie Harrison are requesting an extension of time for the
final plat approval of Middlefork Estates Subdivision, a 3-lot residential subdivision. The 3.15-acre site
is located on the west side of North Meridian Road approximately 1,725-feet north of West Floating

including any subject on the agenda with the exception of Public Hearing and land use items. Comments
regarding Public Hearing and land use items need to be made during the open public hearing for said item(s) it
accordance with Idaho Code. At times, the City Council may seek comments/opinions regarding specific City
matters (excluding Public Hearing and land use items) during this allotte time. Out of courtesy for all who
wish to speak, the City Council requests each speaker limit their comments to three (3) minutes.
13. EXECUTIVE SESSION: 74-206 (1) An executive session at which members of the public are excluded may
be held, but only for the purposes and only in the manner set forth in this section. The motion to go into
executive session shall identify the specific subsections of this section that authorize the executive session.
There shall be a roll call vote on the motion and the vote shall be recorded in the minutes. An executive
session shall be authorized by a two-thirds (2/3) vote of the governing body. An executive session may be
held: (f) To communicate with legal counsel for the public agency to discuss the legal ramifications of and
legal options for pending litigation, or controversies not yet being litigated but imminently likely to be
litigated. The mere presence of legal counsel at an executive session does not satisfy this requirement;
