and clearly designate the boundaries as altered, to be filed
with the Ada County Recorder. Ada County Assessor, and; the
State Tax Commission within 10 days following the effective
day of this Ordinance.
Section 3. This Ordinance shall be in full force and
effect from and after its passage, approval and publication
as required by law.

CONCLUSIONS OF LAW
AND JUDGMENT
THIS CAUSE came on for hearing on October 11, 1979, and the
Court, having heard and considered the evidence, and considered
the stipulations of the parties, hereby finds the facts and
states the conclusions of law as follows:
FINDINGS OF FACT
1. The Petitioners, Donald E. Wilder and Audrey L. Wilder,
husband and wife, are residents of the City of Eagle, County of
Ada, State of Idaho.
FINDINGS OF FACT, CONCLUSIONS
OF LAW AND JUDGMENT -1-
2. The Respondent, City of Eagle, is a municipal corpora-
tion incorporated under the laws of the State of Idaho and
located in Ada County, Idaho.
3. Petitioners are owners of the following described real
property located within the corporate limits of the City of
Eagle, Ada County, State of Idaho:
A parcel of land lying in a portion of the E
1/2 of the SE 1/4 of the SE 1/4 (South of the
drain ditch) of Section 9, T. 4N., R. 1E.,
B.M., Ada County, Idaho, and more particularly
described as follows:
Beginning at a brass cap marking the South-
east corner of the said SE 1/4 of Section 9,
also said point being the REAL POINT OF
BEGINNING;
thence North 0°14'12" West 432.96 feet along
the Easterly boundary of the said SE 1/4 of
a which is also the centerline of Edgewood Road,
to a point on the centerline of a certain
drainage ditch;
thence North 88°44'10" West 24.22 feet along
the said centerline of a certain drainage
ditch to a point of curve;
thence Northwesterly along the said center-
line of a certain drainage ditch along a curve
to the right 58.66 feet, said curve having a

the said E 1/2 of the SE 1/4 of the SE 1/4 of
Section 9;

along the said Westerly boundary of the E 1/2
of the SE 1/4 of the SE 1/4 of Section 9 to an
iron pin marking the Southwest corner of the
said E 1/2 of the SE 1/4 of the SE 1/4 of
Section 9;
thence North 89°00'55" East 662.70 feet
along the Southerly boundary of the SE 1/4 of
Section 9 to the point of beginning, compris-
ing 10.89 acres, more or less.
4. The property described in Finding of Fact No. 3 is a
single parcel of property consisting of more than five acres.
5. The property described in Finding of Fact No. 3 is
currently and has consistently in the past been used by
Petitioners as pasture land for Petitioners' cattle, and has been
used at all times by Petitioners exclusively for agricultural
purposes.
6. The real property described in Finding of Fact No. 3
does not receive any special benefits from the City of Eagle,
resulting from the property being within the corporate limits of
the City.
7. The parcel of property described in Finding of Fact No.
3 is located in the Southeastern corner of the City, and its
detachment from the corporate limits of the City would not give
the City an unusual shape, would not create a hole in the City's
boundaries, and would not leave any small narrow necks of
property existing within the corporate limits of the City.
8. The parcel of property described in Finding of Fact No.
3, being located on the edge of the City, is not surrounded with

land within the City limits being used in a variety of ways, with
the uses being related to the existence of the community. On the
contrary, the parcel of property is surrounded only by agri-
cultural land, and the supervision of the City of Eagle over
lands adjacent to or in close proximity with the business and
homes located within the corporate limits of the City will not be
denied or adversely affected if the Petitioners' property is
detached and disannexed.
9. There is no indication from the evidence that the parcel
of property described in Finding of Fact No. 3 is being developed
for uses incompatible with uses for which adjacent or affected
lands within the corporate limits of the City are being employed.
10. The exterior of the physical symmetry of the outside
boundaries of the City of Eagle will be no less uniform after
detachment of Petitioners' property than it is now, there being
many irregularities presently in the symmetry of the City's
boundaries. When the Petitioners' property was annexed into the
City, the City limits of Eagle were considerably extended.
Therefore, the detachment of the Petitioners' property from the
corporate limits of the City will not, with respect to the
geometric shape of the City, adversely effect the due proportion
of the parts of a body, conformance and consistency, and
correspondence or similarity of form on opposite sides of an axis
or center. In short, detachment of Petitioners' property, as
described in Finding of Fact No. 3, will not materially mar the
symmetry of the City of Eagle.
11. None of Petitioners' statements supporting any
annexation of the City of Eagle had any effect on the City's
decision to annex Petitioners' property, nor did the City place
any reliance thereon.
FINDINGS OF FACT, CONCLUSIONS
OF LAW AND JUDGMENT -4-
12. The City of Eagle did not rely upon any representation
by Petitioners regarding the City's proposed annexation to the
City's detriment or prejudice.
CONCLUSIONS OF LAW
1. Petitioners' property (as described in Finding of Fact
No. 3) is a single parcel of property, located within the
corporate limits of the City of Eagle, consisting of over five
acres, and is used exclusively for agricultural purposes within
the meaning of Idaho Code §50-226 et seq.
2. Petitioners' property does not receive sufficient
special benefits to justify the retention of said property within
the corporate limits of such City.
3. Detachment of Petitioners' parcel of property will not
materially mar the symmetry of the City within the meaning of
Idaho Code S50-230.
4. The doctrine of equitable estoppel based on a property
owner's initial acquiescence to annexation of property is
inapplicable to subsequent proceedings to disannex that property
instituted pursuant to Idaho Code S50-226 et seq.
5. The City of Eagle did not rely to its prejudice or
detriment on any representation made by Petitioners, or either of
them, relating to the initial annexation of Petitioners' property
into the City of Eagle.
6. Petitioners have established as a matter of law all of
the elements prescribed by I.C. §50-226 et seq. necessary for
disannexation under said statutes. Therefore, Petitioners are
entitled to have their Petition granted, and have their property
detached and disannexed from the corporate limits of the City of
Eagle.
FINDINGS OF FACT, CONCLUSIONS
OF LAW AND JUDGMENT -5-

Based upon the foregoing Findings of Fact and Conclusions of
law, now, Therefore, IT IS. HEREBY ORDERED, ADJUDGED AND DECREED,
and this does so ORDER, ADJUDGE AND DECREE:
1. That Petitioners' Petition in the above -entitled action
is granted, and that the parcel of property described in Finding
of Fact No. 3 hereinabove, hereby is wholly detached and
disannexed from the corporate limits of the City of Eagle, and
that from this date forward the Petitioners' property shall be
free and apart from the government of the municipal corporation,
the City of Eagle.
2. That within twenty days after the execution and filing
of these Findings of Fact, Conclusions of Law and Judgment,
Petitioners shall file or cause to be filed with the County
Recorder of Ada County and with the City Clerk of the City of
Eagle, a certified copy of these Findings of Fact, Conclusions of
Law, and Judgment and Decree.
