ORDINANCE NO. /7
SECTION 1. PURPOSE. The purpose of this ordinance is
to provide for the safety, promote the health and prosperity,
and for the protection of the property of the citizens of
Eagle, Idaho, by prohibiting utility companies from providing
any service to any structure until a zoning certificate has been
issued.
SECTION 2. DEFINITIONS AS USED IN THIS ORDINANCE.
(a) Utility means any public or private corporation or
company which supplies the public or a group of individuals
with the following commodity, service or both; Telephone,
gas, electricity, water, or sewage disposal.
(b) Service means providing, attaching or hooking up to
any building, mobile home or other structure any line or pipe,
which line or pipe is intended to provide any of the following
services: Telephone, gas, electricity, water or sewage disposal.
(c) Zoning Certificate means that permit in standard form
adopted and in use by the City of Eagle, State of Idaho, pursuant
to existing ordinances.
SECTION 3. UTILITY SERVICE PROHIBI1ED UNLESS 70NLNG
CERTIFICATE FIRST FURNISHED. It shall be unlawful for any utility
company to provide any service to any building, mobile home,
or other structure situated in the confines of the City of
Eagle, State of Idaho, until such utility company has been
furnished with a copy of a Zoning Certificate which has been
issued for such building, mobile home, or other structure by
the City of Eagle.
SECTION 4. PENALTY. A violation of this ordinance shall
constitute a misdemeanor and shall be punishable as provided
in the ordinance of the City of Eagle, State of Idaho.
SECTION 5. ISSUANCE OF COPIES. The City Clerk of the
City of Eagle shall from the effective date of this ordinance
issue Zoning Certificates to successful applicants in number and
amount sufficient for such successful applicant to furnish all
utility companies with a copy thereof.
SECTION 6. EFFECTIVE DATE. This ordinance shall be and
is hereby declared to be in full force and effect on this I
day of 1974.
Regularly passed and adopted by the Mayor and Council of
the City of Eagle, Idaho, this day of ,1974.

WE, the undersigned, Mayor and Council of the City of
Eagle, Ada County, State of Idaho, at a regular meeting of said
City Council on the 9th day of July, 1974, upon motion duly made,
seconded and carried, suspended the rules of said Council and
adopted Ordinance No. 19 of the City of Eagle.
