An Ordinance of the City of Eagle, Ada County, Idaho,
adopting general license conditions, providing for the establish-
ment of license fees, providing for trade, business and professional
licenses and the authority under said licenses, providing for
multiple licenses of business, providing for the expiration of
licenses, providing that all license fees be paid in advance,
providing a penalty therefor;
BE IT HEREBY ORDAINED;
Section 18:
18-101: GENERAL LICENSES:
(a) No person, firm, company or corporation shall engage
in, prosecute or carry on any trade, business or profession within
the limits of the City of Eagle, for which a license may be
required by this Chapter, until he or they shall have obtained
such a license.
(b) Every person, firm, company or corporation required by
any provisions to obtain a license to engage in any trade, business
or profession for which a license is required, shall pay to the
City Treasurer the sum or sums required to be paid. With the receipt
of the City Treasurer, which receipt shall set forth the kind of
business for which license is desired, they shall apply to the
City Clerk who shall issue a license to the parties applying in
accordance with the receipt of the City Treasurer, upon the com-
pliance by the applicant with the provisions relating to obtaining
licenses for the business, trade or profession for which such
license is desired.
(c) In every license to be taken out under and by virtue of
this Ordinance shall be contained and set forth the purpose, trade,
business or profession for which such license is granted, and the
name and place of abode of the person or persons taking out same.
Said license shall authorize the continuance of the business named
therein for the term of such license, but shall not authorize the
carrying on of said business in any other place unless the place
licensed shall be closed. In such cases, the City Clerk shall be
notified of the change and he shall note the same in the register
of licenses.
(d) In every case where more than one of the pursuits,
employments or occupations for which a license is required shall be
pursued or carried on in the same place by the same person at the
same time, license may be taken out for each according to the rate
severally described.
(e) All licenses issued as quarterly licenses shall expire
the last day of each quarter; viz., first day of March, first
day of June, first day of September, first day of December. All
quarterly licenses shall be dated and paid from the first day of
the month in which the liability therefor accrued and to the last
day of the current quarter.
(f) All licenses required by this Ordinance shall be paid
in advance.
(g) If any person or persons exercise or carry on any trade,
business or profession, or do any act for the exercising, carrying
on or doing of which trade, business or profession, a license is
required by this Ordinance without taking out such license as
required, or violate any of the provisions of this Ordinance, he,
she, or they shall, on conviction thereof, before the Police Judge,
for every such offense, besides being liable to the payment of the
tax, be subjected to imprisonment for a term not to exceed thirty
(30) days or to a fine not to exceed One Hundred Dollars ($100.00),
or both imprisonment and fine.
WHEREAS, there is an emergency therefor, which emergency is
declared to exist, the foregoing GENERAL LICENSE CONDITIONS, shall
take effect and be in force from and after its passage, approval,
and publication as required by law.
Passed by the City Council and approved by the Mayor of the
City of Eagle, Ada County, Idaho, this 14th day of June, 1971.
