The Board continued the item to February 23, 2017, at which time the Board made their decision. The Eagle Design Review Board having heard and taken oral and written testimony, and having duly considered the matter, makes the following Findings of Fact and Conclusions of Law; FINDINGS OF FACT: A. PROJECT SUMMARY: Eagle Center Properties, represented by Mark Butler with Land Consultants, Inc., is requesting design review approval to modify the master sign plan associated with the Eagle Center Shopping Center, including a building wall sign and a monument sign tenant panel for Papa John's Pizza. The site is located on the south side of East State Street approximately 1,750 -feet east of Eagle Road at 601 625 East State Street. B. APPLICATION SUBMITTAL: The City of Eagle received the application for this item on December 22, 2016. Supplemental information was received by the City of Eagle on January 30, 2017 (side view of building wall signage, dimensions of the tenant space, and photos of three (3) hip architectural roof projections), and February 6, 2017 (revised master sign plan criteria and justification letter). C. HISTORY OF RELEVANT PREVIOUS ACTIONS: On July 10, 2003, the City approved a design review application to modify the building's exterior paint colors (DR -32-03). On May 10, 2004, the City approved a design review application to modify the building's exterior paint colors (DR -32-03 MOD). On June 8, 2004, the Eagle City Council approved a master sign plan for the Eagle Center Shopping Center (DR48-03). On June 26, 2007, the Eagle City Council approved a design review application to modify the exterior building elevations of the Eagle Center Shopping Center (DR -32-03 MOD2). On November 27, 2007, the Eagle City Council approved a master sign plan modification for the Eagle Center Shopping Center including a modification to the monument sign and building wall signs 1 (DR -48-03 MOD). B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: • Eagle City Code Section 8 -2A -2(B) The general theme of the Design Review Overlay District is to specify desirable building and landscape architectural styles and materials to create a sustainable and pleasing environment for residents and visitors alike. The architectural designs, materials, and graphics set forth in this article are compiled to create a theme unique to the area called "Eagle Architecture". • Eagle City Code Section 8 -2A -6(A)(4) Signage for any project shall provide for business identification and minimize clutter and confusion on and off the site. • Eagle City Code Section 8-2A-6(A)(4)(c) Signs are to provide effective and necessary business identification systems adapted to the building design. • Eagle City Code Section 8-2A-6(A)(4)(e) The size, Iocation, design, color, texture, lighting, landscaping, and hours of operations of all permanent signs and outdoor advertising structures or features to insure that any such proposals do not detract from the function of, or design of, buildings, structures, surrounding properties, neighborhoods, or streets. Eagle City Code Section 8 -2A -8(A)(3) Architectural Compatibility: The number, area, and height of signs as outlined in this article are intended to be maximum standards which do not necessarily ensure architectural compatibility. Therefore, in addition to the enumerated maximum standards, the city shall give consideration to a sign's relationship to the overall appearance of the subject property as well as the surrounding area. • Eagle City Code Section 8 -2A -8(B) Definition: MASTER SIGN PLAN: A plan designed to show the relationship of signs for any cluster of buildings intended for business occupancy, or any single building containing more than one business or any arrangement of business buildings or shops which constitute a visual entity as a whole. These include developments such as shopping centers, mini -malls, business parks, and multi -tenant commercial, office or industrial buildings housing four (4) or more businesses. Additionally, a master sign plan may be submitted for a single business if the owner chooses to submit an application for a master sign plan for said business. • Eagle City Code Section 8 -2A -8(C)(13) Sign Illumination: a. The city must find that any illuminated sign permitted under the specific regulations within this article is designed such that brightness levels are controlled to assure a soft, subtle effective light in accordance with other city regulations intended to create and maintain the Eagle architecture theme, while encouraging energy efficient lighting. b. Floodlighting is permitted only through the use of incandescent, LED and high pressure sodium light sources. d. Exposed neon is permitted when used to create the sign letter(s) or as an architectural element as part of the sign design. A clear covering may be permitted for protection of the neon element. e. Halo illumination is permitted. f. Metal halide is not permitted as a light source for signage. g. All types of internal illumination is prohibited, except for automated signs and drive- through/drive-up service menu board signs as regulated in this article. • Eagle City Code Section 844-2(A) Site and Building Lighting: 6. Except as otherwise permitted within this title, incandescent lights, two hundred fifty (250) watt maximum high pressure sodium lights, 3000K maximum LED lights (or approved equivalent) shall be the only type of site and building lighting permitted. C. DISCUSSION: • On lune 26, 2007, the Eagle City Council approved a design review modification to update the exterior appearance of the Eagle Center Shopping Center. The modified elevations are similar to the Craftsman style architecture. The building was modified to include new hardi-board siding, copper roof, stone clad columns, major timber elements, and roof structures to enhance the building. Additionally, on November 27, 2007, the Eagle City Council approved a master sign plan modification for the Eagle Center Shopping Center where the building wall sign design and colors complemented the architectural theme of the building. The monument sign was updated to include cultured stone at the base of the monument sign and a cap was added to the sign that matched the colors and theme of the modified building elevations. Although the applicant received approval to modify the monument sign, to date, the sign has not been updated to the approved brown color and remains the original blue color (See Exhibit A). The applicant should be required to provide a revised monument sign elevation showing the monument sign with a muted earth tone color to complement the building, and all tenant panels to be a cream colored background. The revised monument sign elevation should be reviewed and approved by staff prior to the issuance of a sign permit. • Pursuant to the applicant's justification letter, date stamped by the city on February 6, 2017, the applicant is requesting to update their master sign plan similar to others that are in the vicinity or are similar to their commercial center. Proposed changes include: removing all required sign colors, allowing for halo illumination, exposed neon, non illuminated, or externally illuminated signage, and allowing tenants to utilize their individual colors, logos, and letter type. The applicant is also proposing an update the sign dimensions from 2 -feet high by 8 -feet wide to allow 10% of the overall area of the building face for building wall signs (464 -square feet maximum allowed between all tenant spaces). Additionally, the proposed modifications to the master sign plan will allow the monument sign design and color to remain as it exists today, background colors of the tenant panels will all be one color, and tenants are permitted to use their color, font, and logo on the tenant panel. See exhibits attached hereto for pictoral representation of the above description. • Pursuant to Eagle City Code Section 8 -2A -8(A)(4) and the existing language of the master sign plan the building and monument signage materials and appearance should complement the building architecture and colors. The current building wall signage is required to have copper colored square tube framing, and the applicant is proposing to remove that requirement from the master sign plan criteria which could potentially take away from the overall style of the building. Staff recommends that the applicant be required to revise the sign elevation to change the red and green color utilized in the Papa John's sign to a darker, more muted shade of red and green, and change the background color of white to a cream or off white color that would be more consistent with the other muted earth toned colors utilized on the building. • Staff recommends the following changes to the applicants document titled "Master Sign Plan Criteria for Eagle Center," with strike thru text to be deleted and underlined text to be added so as to be in compliance with Eagle City Code. Master Sign Plan Criteria for Eagle Center 601- 625 East State Street This sign program is designed to promote harmony and compatibility for signage within Eagle Center and will be strictly enforced by Landlord. I. Each tenant shall be required to submit signage plans to the Landlord for written approval. A City of Eagle sign application, accompanied by the written approval of the Landlord, shall be submitted to City staff for any proposed signs for City staff review and approval. All signs shall be in compliance with the criteria stated herein as well as Eagle City Code. In cases of any conflict between Eagle City Code and the criteria specified herein, the more restrictive requirements shall apply. Building Wall Signs not located under the three 3 hip architectural roofprojections) It is acknowledged that, from time to time, lease space areas are modified and therefore precise locations of building wall signage cannot be determined until a lease space tenant is secured. Therefore, all building wall signs shall be installed in a coordinated manner with specific locations to be approved by the Landlord and City of Eagle Staff at the time a tenant building wall sign is proposed. 2. The total square footage of building wall signage permitted for the entire frontage of the building is 464 -square feet based upon the "Area of the Building Face" being 4,644 square feet (258 feet long by 18 -feet high) and the Eagle City Code allowing 10% of the Area of Building Face for building wall signs. The building wall signage square footage for all tenants shall all be added together and shall not exceed 464 -square feet. Upon termination of their lease, the tenant or Landlord shall neatly seal all penetrations of the building wall mounted structure in a watertight condition that matches the texture, color, and material used in the construction of the building and refinished to match the pre-existing condition of the building surface. 11. Monument Sian Tenant Panels 9. The existing 15 -foot high multi -tenant monument sign with existing reader board is permitted on State Street. The monument sign colors shall be as approved through DR48-03 MOD2. a. Tenant copy will be fabricated from 118" thick flat cutout aluminum. b. Background color of the monument sign tenant panels will all be the same cream color. c. Tenant is permitted to use their eeler; font, an&logo and muted earth tone colors on the tenant panel. d. The monument sign is to be illuminated by ground mounted light fixtures that will be screened by plant material year round or boulders. e. The landscaping around the base of the monument sign shall be as existing, as approved and conditioned in Master Sign Plan File DR48-03 MOD. f. Tenants are required to obtain written approval from the Landlord to place tenant signage on the monument sign, prior to submitting a sign application to the City for City staff approval. 10. LANDLORD APPROVAL REQUIRED: Each tenant must submit two sets of detailed drawings of aII proposed signs indicating the location, size, layout, design, colors, illumination method, materials and method of attachment to the Landlord for approval prior to submitting for an Eagle City Permit Application and shall submit a sign application to the City of Eagle for staff level approval. 11. This may include, name of the business, tag line and any and all associated trademarks or logos. CODE COMPLIANCE - All displays and their installation shall comply with applicable City and State building and electrical codes. PAINTED SIGNS ARE PROHIBITED - Letters painted directly onto a wall surface shall not be permitted. , LIGHTING -The following types of signage illumination will be allowed by the Landlord per Eagle City. , reverse pan channel (neon or LED halo illuminated) or flood lighting (exact fixture to be approved by the landlord and City Staff). Internal illumination and or backlit illumination is prohibited. FABRICATION MATERIALS - All materials and fabrication methods must be approved by the Landlord prior to the installation of the display. Suggested materials to be used included, aluminum, stainless steel, brass, painted sheet metal and vinyl over poly or metal. COLORS- All colors must be muted earth tone colors and approved by the landlord. INSTALLATION - Signs must be installed by a licensed contractor. Tenant is required to insure that any penetrations caused during the installation of their sign be resealed to the specifications of the fascia or membrane manufacturer warranty. LETTER AND LOGO RESTRICTIONS - Copy and or logos utilized shall be the tenant's choice and must be approved by the landlord. EXPOSED ELEMENTS - No exposed hardware or fasteners may be used. No exposed conduit or raceways will be allowed without the prior approval of the landlord. Raceways may be allowed if there is determined to be an access issue for the installation of illuminated letters. If a raceway is required the raceway must be painted to match or compliment the architectural character of the building on which the display will be placed. HARDWARE - All exterior bolts, fasteners, clips or other hardware shall be of a galvanized or coated material. No black iron materials of any type shall be permitted. PENETRATIONS - All penetrations of the building shall be neatly sealed and kept in a watertight condition. The number and size of building penetrations shall be minimized. Upon removal of any sign, the fascia shall be restored to the texture color and finish of the surrounding wall area at the expense of the owner/occupant. LABELS - No labels shall be permitted on the exposed surface of the signs except those required by Federal and local ordinances. Those required shall be applied in an inconspicuous location. REPAIR OF DAMAGE - Sign user and the user's sign contractor shall be responsible for the repair of any damage caused by the installation or removal of any signage. Tenant or occupant has 30 days to repair the damage caused by the sign contractor once contacted by the landlord. Landlord had the right to repair the damage with a contractor of their choice and seed reimbursement if the repairs are not completed to the landlord's satisfaction. A meeting to consider the application was held before the Design Review Board on February 9, 2017. The item was continued to February 23, 2017, at which time the Board made their decision. B. Oral testimony in opposition to this proposal was presented to the Design Review Board by no one. C. Oral testimony in favor of this proposal was presented to the Design Review Board by no one (not including the applicant/representative). BOARD DECISION: The Board voted 5 to 0 (Baer and Koci absent) to approve DR -48-03 MOD2 for a design review application to modify the master sign plan for the Eagle Center Shopping Center, including a building wall sign and a monument sign tenant panel for Papa John's Pizza for Eagle Center Properties — Ken Friedman, with the following staff recommended site specific conditions of approval and standard conditions of approval with text shown with underline to be added by the Board and text shown with strike thru to be deleted by the Board. SITE SPECIFIC CONDITIONS OF APPROVAL: 1. Ail signs shall comply with the master sign plan criteria for Eagle Center as required herein. 2. The following document titled "Master Sign Plan for Eagle Center, 610-625 East State Street" shall be the master sign plan criteria for Eagle Center. Tenants are required to obtain written approval from the Landlord to place tenant signage on the monument sign, prior to submitting a sign application to the City for City staff approval. 9. LANDLORD APPROVAL REQUIRED: Each tenant must submit two sets of detailed drawings of all proposed signs indicating the location, size, layout, design, colors, illumination method, materials and method of attachment to the Landlord for approval prior to submitting for an Eagle City Permit Application and shall submit a sign application to the City of Eagle for staff level approval. 10. MISCELLANEOUS: CONTENT - All signage shall be restricted to the identification of the business or primary services located within the business premises. This may include, name of the business, tag line and any and all associated trademarks or logos. CODE COMPLIANCE - All displays and their installation shall comply with applicable City and State building and electrical codes. PAINTED SIGNS ARE PROHIBITED - Letters painted directly onto a wall surface shall not be permitted. LIGHTING - The following types of signage illumination will be allowed by the Landlord per Eagle City. Reverse pan channel (neon or LED halo illuminated), or flood lighting (exact fixture to be approved by the landlord and City Staff). Internal illumination and or backlit illumination is prohibited. FABRICATION MATERIALS - All materials and fabrication methods must be approved by the Landlord prior to the installation of the display. Suggested materials to be used included, aluminum, stainless steel, brass, painted sheet metal and vinyl over poly or metal. COLORS AND FONTS - All colors and fonts must be approved by the landlord and the City of Eagle. INSTALLATION - Signs must be installed by a licensed contractor. Tenant is required to insure that any penetrations caused during the installation of their sign be resealed to the specifications of the fascia or membrane manufacturer warranty. LETTER AND LOGO RESTRICTIONS - Copy and or logos utilized shall be the tenant's choice and must be approved by the landlord. EXPOSED ELEMENTS - No exposed hardware or fasteners may be used. No exposed conduit or raceways will be allowed without the prior approval of the landlord. Raceways may be allowed if there is determined to be an access issue for the installation of illuminated letters. If a raceway is required the raceway must be painted to match or compliment the architectural character of the building on which the display will be placed. HARDWARE - All exterior bolts, fasteners, clips or other hardware shall be of a galvanized or coated material. No black iron materials of any type shall be permitted. PENETRATIONS - All penetrations of the building shall be neatly sealed and kept in a watertight condition. The number and size of building penetrations shall be minimized. Upon removal of any sign, the fascia shall be restored to the texture color and finish of the surrounding wall area at the expense of the owner/occupant. REPAIR OF DAMAGE - Sign user and the user's sign contractor shall be responsible for the repair of any damage caused by the installation or removal of any signage. Tenant or occupant has 30 days to repair the damage caused by the sign contractor once contacted by the landlord. Landlord had the right to repair the damage with a contractor of their choice and seed reimbursement if the repairs are not completed to the landlord's satisfaction. 3. STANDARD CONDITIONS OF APPROVAL: I . A building permittzoning permit shall be required prior to construction of any sign which is not attached to a building with an active building permit. 2. Approval shall expire without notice to the applicant on the date of expiration of this Design Review, as stipulated in Eagle City Code (one year from the City Council approval date). 3. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable County, State and Federal Codes and Regulations shall be complied with. All design and construction shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the Commission and/or Council. 4. New plans which incorporate any required changes shall be submitted for staff approval. Staff may elect to take those plans to the Design Review Board and/or the City Council for review and approval. 5. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the City of Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 7. Any modification of the approved design review plans must be approved prior to construction/installation of such changes. Failure to do so may result in the requirement to modify the project to comply with the approved design review and/or result in the inability to issue a certificate of completion for this project. CONCLUSIONS OF LAW: 1. The application for this item was received by the City of Eagle on December 22, 2016. Supplemental information was received by the City of Eagle on January 30, 2017 (side view of building wall signage, dimensions of the tenant space, and photos of three (3) hip architectural roof projections), and February 6, 2017 (revised master sign plan criteria and justification letter). Revised information was received by the City of Eagle on February 14, 2017 (monument sign elevation) and February 15, 2017 (justification letter and Papa John's Pizza sign elevations). 2. The Board reviewed the particular facts and circumstances of this proposed design review application (DR -48-03 MOD2) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review Overlay District, and based upon the information provided with the conditions required herein, concludes that the proposed design review application is in accordance with the Eagle City Code and the Eagle Comprehensive PIan.
