Minutes - 2022 - City Council - 06/23/2022 - Special EAGLE CITY COUNCIL SPECIAL MEETING MINUTES June 23,2022 1. CALL TO ORDER: Council President Baun calls the meeting to order at 3:00 p.m. 2. ROLL CALL: Present: GINDLESPERGER, PIKE, BAUN, RUSSELL. All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: 4. ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS: CONSENT AGENDA • Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Mayor,a Councilmember,member of City Staff,or a citizen requests an item to be removed from the Consent Agenda for discussion.Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the City Council. • Any item on the Consent Agenda which contains written Conditions of Approval from the City of Eagle City Staff,Planning&Zoning Commission,or Design Review Board shall be adopted as part of the City Council's Consent Agenda approval motion unless specifically stated otherwise. A. Appointment to the Urban Renewal Alen y: In accordance with Resolution 14-19, Mayor Pierce is requesting Council Confirmation of the appointment of Jerry Brakebill to the Eagle Urban Renewal Agency.Mr.Brakebill will be filling a vacated term that will expire August 2022. (JWP) B. Temporary Noise Ordnance Waiver Request: Eagle Chamber of Commerce is requesting a noise waiver for the date of July 8,2022 for the Friday Night Fun event being held between 5:00 pm to 12:00 am. (TEO) President Baun introduces the item. Gindlesperger moves to approve item 4 consent agenda items A and B. Seconded by Russell. ALL AYE...MOTION CARRIES. 5. WORK SESSION: A. Comprehensive Plan Review Committee Final Recommendation: Staff will present the final recommendation of the Eagle Comprehensive Plan Review Committee and receive direction from the Council on the next phase of the amendment process. (NBS) President Baun introduces the item. Director of Long-Range Planning and Projects,Nichoel Baird Spencer reviews the history of the Comprehensive Plan Review Committee,the tasks assigned and the outcome of the review process. Director Baird Spencer review consensus outcome from the Committee and seeks Council direction on their desired next steps in the process. Discussion between Council and Director Baird Spencer. Council consensus that the re-write should be a combination of in-house and consultant utilized process to ensure a consistent voice within the document. Discussion regarding the funding/budgeting for the consultants and possibly additional support staff. It is estimated that the process will take between 12-18 months, after the consultants are in place. Discussion regarding options for moving forward with the review including time commitment for Council driven process and the by the public input. EXECUTIVE SESSION: 74-206(1)An executive session at which members of the public are excluded may be held, but only for the purposes and only in the manner set forth in this section. The motion to go into executive session shall identify the specific subsections of this section that authorize the executive session. There shall be a roll call vote on the motion and the vote shall be recorded in the minutes. An executive session shall be authorized by a two-thirds(2/3)vote of the governing body. An executive session may be held: (c)To acquire an interest in real property which is not owned by a public agency; (f) To communicate with legal counsel for the public agency to discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated. The mere presence of legal counsel at an executive session does not satisfy this requirement; A. ACTION ITEM: Action regarding acquisition of private property. B. The Committee recommendations should provide direction for a planning process or research that needs to be considered during the process, not strict standards, ultimatums, or strict directives. Council will create a scope of work that will guide the drafting of the plan, public participation, and additional community discussion. (Attachment A) 2) Detailed Chapter by Chapter comments — Results of chapter- by-chapter reviews by the committee. (Attachment B) 5 BROAD THEMES & PROCESSES • The overall structure of the plan is sufficient but there are a lot of redundancies in the polices and goals. • Overall, the plan needs all the background data and corresponding charts updated. Care should be taken to ensure that data and charts are not quickly outdated. • The plan needs to address growth in Boise and Gem Counties. Need to address what the population will be in 50-years. • Plan needs to address current utilities and facilities plan- fiber, cellular, schools, water. Consider limiting policies to those within control of the City and just cross referencing to the specific planning documents of each outside agency. 6 3 • 6/23/2022 • Plan should better address the integration of parks, trail and open space, creating a complete picture of the system City-wide. Current document has foothills and river plan as separate areas with separate policies, but the intent is to develop a system for all residents. Expand the vision of parks, trails, and open space to include- sledding hills, YMCA/recreation centers, swimming pools, habitat/wetland preserves, agriculture, and scenic resources. • Work with ACHD, ITD, VRT, and COMPASS to create an accurate picture of what the community's roadways will look like over the next 50-years. • Establish a plan that is implementable. Focus on 1-, 3-, & 5-year activities that can be implemented. This will require the Council to use the plan to guide decisions beyond land use actions and for the Council to use the plan to guide daily management of the City, the budget process and each departments annual accomplishments. Consider requiring an annual departmental work program not just a budget. 7 DIRECTED QUESTIONS & RESPONSES Should the Plan be re-written? Yes, it is time to re-write the plan. Some pieces can be streamlined and done quickly, but other sections will require time. The plan is bulky and has a lot of redundancies. The plan should be streamlined and well edited. The Committee did not come to a consensus about the chapters that were best outsourced to a consultant, but the chapters of highest concern were: Land Use, Parks, Trails & Open Space, and Transportation. 8 4 6/23/2022 What (plans, studies, coordination) needs to be done before the City begins the re-write process? Again, there was no clear consensus, but there was strong voice to complete the Downtown Committee work, complete the Parks, Trail & Open Space Planning, and update the impact fee studies so those documents/work could be integrated into the policies of the plan. Should the plan continue to use sub-areas for the organization of policies? The Committee likes the use of subareas and recommends that they continue to be used. All areas within the City should be placed within a subarea, this may occur with new areas, but also could occur by reducing or merging some of the existing areas. The Committee did feels that this is one of the areas with larger redundancies in policies and the document should be reviewed to ensure policies that are universally applied are in a general land use section and that the subareas focus on unique policies or areas of special concern. 9 Should the City continue to focus density into Downtown Eagle and along major corridors so to reduce the density in larger residential only areas? Yes, overall, the committee agreed to this policy direction. The Committee also agreed that there needed to be a larger conversation about land use densities city- wide and that they felt lot size was a better regulator than density. Should the City retain the Rural Planning area? Should it expand? Should agricultural industries be allowed in the area? Should the City address policies to protect active agricultural land outside of the rural planning area? Yes, retain a rural planning area within the City. Generally, the group agrees that the area is about the right size and location. Agricultural industries were tricky. Many felt that small-scale industries such as u- pick produce, riding areas, and vineyards/wineries were appropriate, but large-scale agricultural industries and manufacturing should not be part of the rural area. The city should establish a review process of prime agricultural land and establish policies for preservation versus development. 10 5 6/23/2022 Should the City continue to work toward fiscal sustainability? Yes, the City needs to continue to work on the Capital Plan and specifically capital maintenance, what it costs to maintain the improvements —parks, trail, and buildings, as the City grows. The City should look at how different land uses impact the demand for services and the income received by the City. Overall, the sentiment was to ensure development pays for itself. How often should the City amend the plan? The Committee resoundingly felt that the plan should be reviewed and, if needed, amended every 5 years.
