1. CALL TO ORDER: Meeting called to order at 6:00 p.m.
2. ROLL CALL: Present: WRIGHT, GUERBER, MCLAUGHLIN, MCCAULEY. Absent:. SMITH.
A quorum is present. Chairman Wright presiding.
CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS.
• Consent Agenda items are considered to be routine and are acted on with one motion.
There will be no separate discussion on these items unless a member of the
Commission, member of City Staff, or a citizen requests an item to be removed from
the Consent Agenda for discussion. Items removed from the Consent Agenda will
be placed on the Regular Agenda in a sequence determined by the City Council.
• Any item on the Consent Agenda which contains written Conditions of Approval
from the City of Eagle City Staff, Planning & Zoning Commission, or Design
Review Board shall be adopted as part of the City Council's Consent Agenda
approval motion unless specifically stated otherwise.
A. Minutes of May 16, 2022. (MJR)
B. Findings of Fact and Conclusions of Law for the Approval of CU-05-22 — Waiver of
Lot Coverage — Jared Borg: Jared Borg, represented by Curt Barber, is requesting a
conditional use permit to waive the 15% lot coverage requirement of the R-E zone to permit
the construction of a 5,400 square foot detached garage building, bringing total lot coverage
up to 16.3%. The 1.9 acres site is situated on the North side of West Washam Road, at 1450
West Washam Road. (MNB)
C. Findings of Fact and Conclusions of Law for the Approval of A-12-21/RZ-18-21 & PP-
19-21— Farmstead Landing Subdivision — WH Eagle 80, LLC: WH Eagle 80, LLC,
represented by Dave Yorgason, is requesting an annexation, rezone from RUT (Rural -Urban
Transition — Ada County designation) to R-2-DA (Residential with a development agreement
[in lieu of a PUD]), and preliminary plat approvals for Farmstead Landing Subdivision, a
169-lot (140-buildable, 29-common) residential subdivision. The 80.23-acre site is located on
the north side of West Floating Feather Road between North Park Lane and North Linder
Road. (MNB)
Mclaughlin moves to approve the consent agenda as presented. Seconded by Guerber. ALL
AYES... MOTION CARRIES.

PUBLIC HEARINGS: ALL PUBLIC HEARING ITEMS ARE CONSIDERED ACTIONITEMS.
A. A-11-21/RZ-17-21/CU-11-21/PPUD-08-21/PP-18-21 —Annexation, Rezone,
Conditional Use Permit, Preliminary Development Plan, and Preliminary Plat for
Soaring Feather Ranch Subdivision — Sheridan Hodson: Sheridan Hodson, represented
by Katie Miller of BaileyEngineering, is requesting an annexation and rezone from RUT
(Rural -Urban Transition — Ada County designation) to R-E and R-2-DA-P (Residential -
two units per acre with a Development Agreement - PUD), conditional use permit,
preliminary development plan, and preliminary plat approvals for Soaring Feather
Ranch, a 32-lot (28-single family, 3-common, and 1-commercial) subdivision. The 17-
acre site is located approximately 2,000 feet south of Beacon Light Road between
Linder Road and Park Lane. (MNB)

Jerry Gibbs, 1834 N. Monterossa Way, Eagle, in the Bellaterra Subdivision homeowner and
HOA president. Concern of increased traffic into their subdivision.
Jodi Riley, 4455 W. Modena, a Bellaterra Subdivision homeowner. Concerned with access to
the Soaring Feather subdivision going through their (Bellaterra) subdivision. Also, concerned
about the amount of traffic the Soaring Feather subdivision will bring to the neighborhood.
Tom Brengle, 2475 N. Sun Valley Place, Eagle, Callaway Ranch subdivision homeowner,
and HOA member appreciates the support the developer and the city staff are giving to
resolve the sewer system issues.
Applicant addresses concerns raised during the public hearing and provides rebuttal.
Chairman Wright closes the public hearing.
Mccauley recommends approval A-11-21/RZ-17-21/CU-11-21/PPUD-08-21/PP-18-21 -
Annexation, Rezone, Conditional Use Permit. Preliminary Development Plan, and
Preliminary Plat for Soaring Feather Ranch Subdivision as presented with the site
specific and standard conditions as written with the following modifications.
Site specific condition 420: Lot 16, Block 1 and lot 1 and 2, 3 to be single stories not to
exceed 25 feet that will replace staff recommendation for annex and rezone. 3.16 will be
removed and be replaced as 920 on the staff recommendations for conditional use permit,
preliminary development plan and preliminary plat in the verbiage I just read lot 16 will be
added to that. Lot 16 will be added to that.
Site specific condition 98: Strike, it is a repeat of site specific condition #6.
Add verbiage as recommended by staff, page 9 of 22, in the grid to be 27.2 % instead of
20%.
Seconded by Guerber. ALL AYES... MOTION CARRIES.
B. A-13-21/RZ-19-21/CU-10-21/PPUD-09-21/PP-20-21 — Annexation Rezone with a
Development Agreement, Conditional Use Permit, Preliminary Development Plan,
and Preliminary Plat for Kingswood Subdivision — LPGD Utah, LLC: LGPD Utah,
LLC, represented by Jim Perry with Woodbridge Pacific Group, LLC, is requesting an
annexation, rezone from RUT (Rural -Urban Transition — Ada County designation) to R-2-
DA-P (Residential with a development agreement — PUD), conditional use permit,
preliminary development plan, and preliminary plat approvals for Kingswood Subdivision,
an 87-lot (74-buildable, 13-common) residential planned unit development. The 38.81-acre
site is located on the west side of North Linder Road approximately 1,430-feet north of the
intersection of North Linder Road and West Floating Feather Road. (MJW)

provides an overview of the application. City Planner, Mike Williams, provides an

Jerry Gibbs, 1834 N. Monterossa Way, Eagle, in the Bellaterra Subdivision homeowner and
HOA President. Bellaterra shares water with this new development subdivision, would like

an update of the irrigation plan between Kingswood and Bellaterra.
Jodi Riley, 4455 W. Modena, a Bellaterra Subdivision homeowner. Feels the residents were
not fairly notified of the hearing notices. This includes not given a fair opportunity to attend
both the Soaring Feather and Kingswood neighborhood meetings, as they were held at
precisely the same time. Thus, she and residents in the area had to listen to one or the other.
In addition, Ms. Riley is concerned by the lack of adequate traffic studies for these new
developments.

Jona, Bailey Engineering, 1119 E. State Street, Eagle, provides details on the structure of
their water engineering and sharing water rights.

Mclaughlin makes a motion to approve A-13-21/RZ-19-21/CU-10-21/PPUD-09-
21/PP-20-21-Annexation. Rezone with a Development Agreement. Conditional
Use Permit. Preliminary Development Plan, and Preliminary Plat for Kingswood
Subdivision as presented with the site specific and standard conditions as written with
the following modifications.
Site specific condition # 3.4: Add no repetition of elevation within every five houses.
Site specific condition #5: The bur be reduced to 50 feet wide with the condition of the city
code 8-2A-7J4B which would add ten foot fence on top of the berm to accommodate the
reduction of width.
Site specific condition #7: All setbacks will remain as provided by city staff.
Site specific condition #24: A type of vinyl decorative fencing will be placed next to Ms.
Macy's home.
I would like to amend my original motion to add under site specific condition #7 no
balconies on the second story home's on exterior lots.
Seconded by Guerber. ALL AYES... MOTION CARRIES.
6. NEW BUSINESS: None.
7. REPORTS:
A. Commission: Guerber notifies the Commission of the pending Comp Plan updates.
B. City Attorney: None.
C. Staff. Planner Williams, reviews the protocol used for the neighborhood meetings held for
Soaring Feather Subdivision and Kingswood Subdivision.
8. ADJOURNMENT:
Wright moves to adjourn. Seconded by Guerber. ALL AYES... MOTION CARRIES.
